He did. Detective Tagler asked him if they could look at this phone or did they need to get a search warrant. He said that would be okay. Then she said "so I have your consent to look at your phone?" and he said yes.

It was on one of the early interview recordings.

Sad Defense argument: how can LE say they took his phone so he couldn't destroy evidence if he already destroyed the evidence?

(Because it autopopulates from Google, they wanted to preserve whatever might still be on the phone in the event he deleted evidence from his Google/cloud account.)

Currently he's got a despicable job.

I would be a horrible defence attorney trying to spin gold out of straw.
I just didn't like one statement they made yesterday, It was that if the judge didn't give them that delay it would be an "abuse or misuse? of discretion" something like that, felt a bit gaslightish to me.,

If he indeed felt forced to give them consent that came from the angel on his right shoulder. The devil on his left was whispering "You'll be sorry if you do!".

Maddie's bench has been placed. Jenny and her team did an amazing job of organizing and raising funds for it, and she continues to be an advocate for Maddie.

She said the bill being worked on, which she hopes gathers more traction in the 2026 legislative session, would identify the actions, “by admission or omission,” of caretakers in relation to those experiencing long-term abuse. The bill, she hopes, would put mandatory protocols in place for reporting abuse.

“Why did parents not notice years of abuse the children suffer?” asked Esquivel, who would not name the legislators she and others are working with, because they want to protect the work being done.

and I re listened to the interview and when he said "go for it", it was to look at his hands, not search the phone. So I stand corrected.
Regardless, I think their position is even if he did give permission it wasnt to search the whole phone.
Is this the other argument?
one side said they had exigent circumstance because a child was missing , the other side says they didn't have exigent circumstances because they knew he wiped his phone ( his admission) and nothing was on it and and that they could have seized the phone and waited for a warrant? What a catch 22.

Fox News discussion on whether the phone and cloud will be allowed or suppressed. An expert believed judge may be leaning toward suppression and if so, then she thinks the whole case may be dropped. Naturally, here, we're thinking LE is planning to use a conviction on SA to get the death penalty in the murder trial.

"Last night, the judge overseeing the Suppression Hearing for Stephan Sterns said he will issue a written ruling on Stephan Sterns' motion to block evidence relating to his cell phone and Google account."

Very sobering video.

What if all of the evidence on the phone is excluded? MS is still dead, and he did it. He isn't going to get out of that.

I for one would be very concerned if the SA charges were dropped. He is obviously guilty of the crime with no doubt. There is evidence that he disposed of the body. Where is the evidence that it was he who killed her? Don't get me wrong, I think he did kill her but I'm thinking about a jury here. There was another person in the house at the time. Some juror could have a reasonable doubt.

I certainly hope you're right. In addition to the defense attorney bring vigorous, the judge is taking everything seriously. No only is this a probable death penalty case (so as serious as it gets) there is also all the csam. Undoubtedly, he wants to review everything and be certain everything is handled properly.

I was watching Vinnie Politan Investigates tonight and they showed the last interview with SS before he asked for a lawyer. The detective said something like, "you gave them permission to search your phone" and SS agrees.

IANAL but my opinion is there is plenty of evidence that SS willingly gave LE permission to search his phone.

Just for fun, everyone should see Jumpsuit Pablo's video on the court hearing yesterday. That guy is hilarious, just watch it for the entertainment value alone and a good laugh during this horrible case. The video is 20 minutes and is all about the root beer barrels. ( 9 min is the funniest part IMO )

Doesn’t look like anyone from her local family is there — more specifically, her mother JS is absent! Interesting. OMO.
