Jury seated in federal hate crimes trial of 3 men convicted of murdering Ahmaud Arbery

A jury has been seated in the federal trial of three white Georgia men charged with hate crimes stemming from the murder of Ahmaud Arbery, a 25-year-old Black man who was out for a jog in 2020 when he was chased and gunned down.

The 16 jurors, including four alternates, were empaneled on Monday morning following a lengthy selection process that started on Feb. 7.

Opening statements are set to begin on Monday afternoon.

The jury is comprised of eight whites, three Blacks and one Hispanic. Alternates are three white members and one Pacific Islander.

The trial in U.S. District Court in Brunswick, Georgia, is expected to last seven to 10 days.

If convicted in the federal case, the men must first serve their state sentences before being transferred to federal prison.

First line of a prosecutor's opening statement in the federal trial against Ahmaud Arbery's killers:

"I want to talk to you all about what turned out to be the last day of Ahmaud Arbery's life."

AUSA on why the McMichaels and Bryan:

The short answer, you'll learn, is that all three defendants made decisions about Ahmaud because of the color of his skin.

AUSA notes that, though this is commonly described as a federal "hate crime" trial, the charge "does not require proof of hate."

"It requires that the defendant acted because of race."

AUSA quotes Travis McMichael using the N-word.

"Zero n***rs work with me. They ruin everything."

McMichael allegedly said he liked his contracting job because there's "not a n***r in sight."

He called Black people "criminals," "monkeys" and "sub-human savages," per AUSA.

Greg McMichael spoke derisively of civil rights leader Julian Bond, shocking an associate, the AUSA says.

AUSA says that gunman Travis McMichael referred to an image on social media of a man with a firecracker in his nose by saying:

"It would have been cooler if it blew the f***ing n****r’s head off."

AUSA:

Travis McMichael was "eager to blame the dead Black man for getting shot."

Greg McMichael said that the man on the ground was a "thief."

"Oh yeah, and that he probably stole" a gun from Travis's truck.

"You'll learn that none of that is true."

Arbery Killer Used Racial Slur to Describe Daughter’s Black Date, Prosecutors Say

But in what is perhaps the most disturbing example of racism from the trio, prosecutors allege that just days before Arbery’s murder, William “Roddie” Bryan made several racist comments after learning his daughter was dating a Black man.

“[She] has her a [n-word] now,” Bryan allegedly said in a message. Bryan also repeatedly referred to the man by the racial slur and called him a “monkey,”
Assistant U.S. Attorney Bobbi Bernstein said.

On the day of Arbery’s death, Bernstein said that he told authorities he saw the 25-year-old “running and knew he had to be a criminal.” When asked what evidence he had to justify that Arbery could have been the individual that had been previously breaking into a home under construction in the neighborhood, Bryan responded: “instinct.”

Pete Theodocion, Bryan’s lawyer, insisted to jurors on Monday that he did not take the case to “defend racism” but did acknowledge that his client used language that he is embarrassed about.

The defense lawyer insisted that Bryan does not see “the entire world through the prism of race” and would have acted the same way on the day of Arbery’s death if the man being pursued was “white, Hispanic or Asian.” “He never wanted any physical harm to Mr. Arbery,” Theodocion added.

Good morning! Ready for Day One of testimony in the federal hate crimes trial of #AhmaudArbery’s convicted murderers Travis McMichael, Gregory McMichael, and William “Roddie” Bryan. The prosecution calls its first witness today. @wsbradio

The Gov't's first witness is a man who'd been living in Satilla Shores seven years at the time of the #AhmaudArbery's shooting, Daniel Allcott. Allcott and his wife heard "three loud bangs" on Feb. 23, 2020. He hustled his wife & baby inside then went outside. @wsbradio

One day checking the mail, Allcott saw people he learned were #AhmaudArbery's family with a small wooden cross, near the intersection of the fatal shooting. He told them they could put the memorial in his yard, which was closest. @wsbradio

Second prosecution witness was Matt Albenze, another Satilla Shores neighbor. He also testified in the defendants' murder trial for the shooting of #AhmaudArbery last fall

Albenze saw #AhmaudArbery inside the English home under construction that Feb. 23. Arbery ran out of the house with long strides, sort of loping. Albenze said No, he had no reason to think Arbery had taken anything or would hurt anyone. @wsbradio

Albenze'd seen security cam videos from English of a Black guy on the property, as well as of a white couple there. He remembers seeing the Black fella on the dock, just looking around. He called Glynn Co PD when he saw #AhmaudArbery there again. "It seemed suspicious" @wsbradio

Albenze called the Glynn Co. PD's non-emergency number to "send somebody to check it out." He didn't call 911 because he had no reason to think it was an emergency: "It was just a fella in a house." #AhmaudArbery @wsbradio

A pool reporter notes, "Mr. Albenze seems permanently troubled by the events that took place that day." #AhmaudArbery @wsbradio

The prosecution's 4th witness was Sheila Ramos, an investigator with Glynn County Police. She testified about photos she took at the scene, ]including up-close, graphic ones of #AhmaudArbery's bullet wounds in his left torso, left underarm & left wrist. @wsbradio

The jury is watching other neighborhood security videos that ASAC Dial identifies for them, which show #AhmaudArbery leaving the framed-up house and running down the street. When Arbery passed the McMichaels', Greg was working on boat cushions in the driveway. @wsbradio

Dial testifies that Greg McMichael went into the house to get his son. Both men grabbed their weapons--Greg, a .357 from his bedroom; Travis, a Remington 12-gauge shotgun. They got into Travis's white F150. Neither called 911. Greg left his phone at home. #AhmaudArbery @wsbradio

Travis McMichael turned right down Burford, the same direction #AhmaudArbery had run. They first caught up to him in front of Roddie Bryan's house, #307. Arbery changed direction and tried to run back. Bryan was working out front of his house. @wsbradio

Bryan was on the front porch. Dial testifies Bryan never said he knew #AhmaudArbery or the McMichaels. Bryan yelled at the truck driver, "Y'all got him?" Bryan did not ask Ahmaud if he was okay, or ask the men in the truck why they were chasing him. @wsbradio

Bryan got his keys from the house, as the McMichaels kept pursuing #AhmaudArbery and caught up to him again at Burford and Zellwood. Travis tried to block Arbery's path. Greg tried to go around the truck to engage Arbery, who changed direction and ran back up Burford @wsbradio

Dial testifies Bryan in his black truck now also in pursuit, tried to block #AhmaudArbery's path. Arbery made contact w/his truck's door w/his hand. Glynn Co. Police found a dent in the truck, white fibers consistent with Arbery's shirt, a finger swipe & palm print @wsbradio

Dial: The quickest path of travel out of Satilla Shores--Satilla Drive, not turning onto Holmes--was blocked by Roddie Bryan's truck. He'd shot forward into the intersection. #AhmaudArbery was running from Bryan when he went down Holmes. @wsbradio

Dial: Arbery didn't make it to Zellwood because McMichaels were coming that way toward #AhmaudArbery from Zellwood up Holmes. He sees them, turns and goes back the direction he came. @wsbradio

Dial: Greg McMichael was by now in the bed of Travis's pickup; he'd been in his grandson's child seat before getting out on Burford. Travis McMichael got out of his truck at door with his shotgun; he raises it as #AhmaudArbery runs toward him. Arbery changes direction @wsbradio

Dial: #AhmaudArbery runs around passenger side of truck. When he's at front of passenger side Travis McMichael had moved from around the open driver's door to the front of his truck. When Arbery reached front of truck and turned left, "he was shot by Travis McMichael" @wsbradio

The jury sees the video of #AhmaudArbery's shooting. The three booming gunshots are spaced out by ~4 seconds each. ASAC Richard Dial says the GBI had the video enhanced and in the slow-motion video you can see Travis McMichael raise his shotgun. @wsbradio

Dial: Greg McMichael called 911 near the end of the chase. Neither McMichael or Roddie Bryan called 911 after setting out after #AhmaudArbery at any other time. Jury hears the 911 call. Now jury will see bodycam of Ofcr. R. Minshew responding to shooting scene.

The resolution declares that, "Feb. 23 will forever be known annually in the State of Georgia as The Ahmaud Arbery Day," and encourages Georgians to participate in the "Run with Maud"movement, of running 2.23 miles on Feb. 23.

The resolution notes that, "Mr. Ahmaud Marquez Arbery was a blessed Mother's Day gift from God, born to Wanda Cooper-Jones on May 8, 1994, in Brunswick, Georgia; and...Mr. Arbery was a known athlete prior to the senseless loss of his life because of the color of his skin...Mr. Arbery was a loving son, brother of Jasmine Arbery, uncle, grandson, nephew, cousin, and friend who left an impact on countless Georgians and Americans; and a compassionate and generous man, Mr. Arbery will long be remembered for his love of family and community."

Paul Harvey used to say, "And, now you know......the rest of the story." The defendants, some in LE and the DA's office had hoped it would never come out.

The outcome of guilty in the federal case may be the same as with the rejected plea deal. But, it is important for every person in this country to know what was in their hearts and minds as they hunted this poor young man. Each new piece of information that is entered into evidence makes my heart and my stomach hurt. I can only imagine if Mr. Arbery was my son or if these animals did this to my son/child. It is so inhumane, especially after these murderers tried to blame everything on this young man.

Sunlight. More sunlight. Direct sunlight for hours and days. Maybe then we can be disinfected from racism. RIP Ahmaud. I run with you and every other vulnerable person.

Thomas says Travis McMichael is a friend he'd also send funny videos to on social media, to get a laugh. Prosecutor asks him to read TM comment on some video (I can't see it), and Thomas asked if he's required by law to read it. #AhmaudArbery @wsbradio

Prosecutor told Thomas to spell what he's not comfy saying. It was the video of guy with firecrackers in nose, apparently--Travis McMichael commented "It would've been cooler if it blew that ******'s head off" and Thomas spells out the n-word #AhmaudArbery @wsbradio

After Travis McMichael's response, Thomas reached out to him. Did TM share why he was angry? Gov't asked. Thomas says, Don't know if he was angry but a gun was stolen from his truck. Did he ID suspect's race? DT: I believe I told grand jury he said white. #AhmaudArbery @wsbradio
