Officials with the Fulton county court handed the indictment to judge Robert McBurney.
Proposed trial date on 3/4/24. Judge Scott McAfee presiding. Though McAfee was assigned the case soon after the indictment was handed up on Monday evening, it could be transferred to a different judge later in the process.

9/15/23 Update: Judge Steve Jones has ordered an evidentiary hearing for two more of Trump's Georgia codefendants seeking to move their cases to federal court. David Shafer & Cathleen Latham — who both posed as electors — will make their case on 9/20/23.

9/16/23 Update: Fulton County Superior Court Judge Scott McAfee in the Georgia election interference case ordered that 900 summonses be sent out for the October trial for the first two co-defendants in the case, attorneys Kenneth Chesebro & Sidney Powell. Those who receive a summons will have to report to the court in two waives to fill out questionnaires. Some 450 jurors will report on 10/20/23 & another 450 will have to report on 10/27/23. A hearing is expected to be held this week to discuss Fulton County DA Fani Willis’ motion to restrict jurors’ identities during the trial.
9/18/23 Update: Clark & Still motions hearing. Clark: A federal judge appeared inclined on Monday to reject Clark’s effort to transfer from state to federal court his criminal case for conspiring to overturn the 2020 election in Georgia, striking his written testimony from consideration. The US district judge Steve Jones did not make a formal ruling from the bench at the court hearing in Atlanta but left Clark, the former assistant attorney general for the civil division, without the key evidence he had wanted to submit after he failed to appear in person. That means the judge will make a decision on whether Clark can remove his racketeering charges brought by the Fulton county DA’s office last month based on the oral arguments by Clark’s lawyer & parts of a supporting affidavit from former attorney general Edwin Meese. The judge’s refusal to consider Clark’s own written testimony suggests he faces an uphill struggle, given the burden rests on Clark to prove that he was acting within the scope of his official duties as a justice dept. official in order to successfully change venue to federal court. The judge did not articulate precisely why he would not accept Clark’s affidavit, but a declaration alone with no appearance on the stand is widely regarded as insufficient to meet evidentiary burdens because Clark would not be subject to cross-examination.
9/19/23 Update: Two attorneys Chesebro & Powell can have their legal teams seek voluntary interviews with the grand jurors who indicted them, a Georgia judge ruled on Tuesday. Fulton County Superior Court Judge Scott McAfee said he will "guide & maintain oversight" over any interviews. Superior Court Judge Scott McAfee said the interviews must be voluntary & stay within the bounds of Georgia law so grand jurors do not disclose their deliberations. McAfee also said he will decide which questions are to be asked & will oversee the interviews, if any of the grand jurors agree to be questioned. The court will independently contact each juror to ask if they want to submit an interview, either remotely or in-person.
