Interesting article on if Guiliani appeals his case...

Dec. 17, 2023
.....
Former U.S. Attorney Barbara McQuade suggested on Saturday while appearing on MSNBC's The Katie Phang Show that Giuliani will face a major roadblock in attempting to appeal his defamation ruling.

"One of the things that is a bit of an obstacle to an appeal is the idea that in Georgia, a person has to post what's known as an appeal bond," McQuade, who previously served as a U.S. attorney for the Eastern District of Michigan from 2010 to 2017 and appointed by former President Barack Obama, said.

She continued: "And the idea behind an appeal bond is that an appeal could be filed for good faith reasons, it can also be filed simply to delay the pay day, and so to avoid the latter, litigants are required to pay in advance an appeal bond which is usually something more than the amount of the judgment, so that it's there in case there is a finality in the case. I don't know that Rudy Giuliani is going to get an appeal bond, so he may not be able to do it at all."

So he would have to put up at least $295 million plus.... too bad, so sad.... NOT! :)
Love that journey for him!

Attorneys for Fulton Trump case defendant Trevian Kutti are jumping ship, several weeks after she recorded an Instagram Live video that legal observers say likely violated her bond agreement

Although the court filing did not provide a reason for why her Atlanta-based attorney, Darryl Cohen, and her Chicago-based attorneys, Steven Greenberg and Joshua Herman, were dropping Kutti, Cohen told The Messenger on Tuesday, "In order to have a good lawyer-client relationship, the client has to listen, the client has to be on board and you have to be paid."

Emphasizing he was speaking generically given the case's high profile and unusual nature, Cohen said, "All these things have to happen. I'm not saying any of those things did or didn't happen, but you can extrapolate."

Bring back debtor's prison?

  • #892
  • #893
In what context?
For Rudy, so he can spend the rest of his life paying back a tiny bit of his debt instead of getting away scot free via bankruptcy.

MOO maybe I misunderstood what debtor's prison was -- I thought it was being constrained and forced to work off one's debts.

Yesterday I had a very strong feeling that Mr Giuliani would file for bankruptcy.

I didn't think that was legal
Sure it is legal. And it is a good idea. Obviously, he doesn't have $148 million, so he is going to be insolvent. This is chapter 11, which is really a business reorganization. The defamation judgment is likely not dischargeable, but this allows him to control and orderly payment of debts, cram some down, etc.
