Strange that the German press didn't get the story until it seems some 20 hrs after the mirror.
Apparently it was the Mail who spoke to B directly on the Saturday , not sure if he contacted them or vice versa.

He boasted to the MoS yesterday that he planned to leave Germany. Now living in a tent in woods in the northern port city of Kiel, he said: ‘The police wanted to keep me in Germany so they could break me.

‘But it turns out I don’t even have to stay in Germany. And now as soon as I can raise some money, then I will leave.’

He plans to set up a crowd-funding website to raise money to leave.

Court decides: Christian B. is allowed to settle abroad

Brunswick. An instruction stating that Christian B. must remain in Germany has been repealed. The regional court must make a new decision on this.

According to a court order, the German suspect in the case of the British girl Madeleine „Maddie“ McCann, who disappeared in Portugal in 2007, was released from prison almost two months ago and was allowed to settle abroad. According to information on Monday, the Higher Regional Court in Celle, Lower Saxony, decided this in a legal dispute over so-called management supervision measures imposed against Christian B.

The instruction ordered by the Hildesheim Regional Court that B. may only live in Germany during his five-year period under management supervision is therefore inadmissible. The Higher Regional Court emphasized that there is no legal basis for this. The responsible Senate confirmed all other instructions, including the obligation to wear an electronic ankle bracelet to determine where to stay.

A temporary ban on leaving the country can still be imposed

The court also emphasized that a temporary ban on leaving the country could certainly be imposed on B., for example to gain time for „preparatory measures“. A ban on settlement in certain correspondingly specified regions is also possible. The design of management supervision remains the responsibility of the Hildesheim Regional Court.

B., who had multiple previous convictions for sexual offenses, was released from a correctional facility in Lower Saxony in September after serving a seven-year prison sentence for, among other things, rape. Regardless, the public prosecutor's office in Braunschweig classifies him as a suspect in the case of the missing Maddie. She announced this in 2020, so she has not yet filed charges.

No legal basis for custodial measures

According to a court expert, B. is at high risk of further crimes. However, there is currently no legal basis for measures involving deprivation of liberty. However, as part of management supervision, instructions were given to reduce the risk of relapse. B. must wear an electronic ankle bracelet and, among other things, maintain regular contact with a probation officer.

The „Spiegel“ recently reported that B. now lives as a homeless person in Kiel, Schleswig-Holstein. Accordingly, after his release from prison, he was temporarily quartered by the authorities and his lawyers in an apartment in Neumünster and a hotel in Kiel. However, B's stay became public and caused unrest and threats. According to the report, he most recently lived in a green area and was guarded by police officers around the clock.

Maddie disappeared from a holiday apartment in a holiday resort in Praia da Luz, Portugal, on May 3, 2007, shortly before her fourth birthday, while her parents were eating in a nearby restaurant. Despite years of searching, there is still no trace of it, and the case has always attracted great international media interest. According to German authorities, B. used to live temporarily in Portugal.

Without a trial transcript, it is impossible to know what factors the judges considered before pronouncing sentence.

I don't understand the first sentence.
As the appeal has been successful, what decision is there for the Regional Court to make ?

Who knows the German system is hard to translate imo, does it mean it has to go back to the regional court to alter its terms.

The Celle Higher Regional Court essentially confirmed the decision of the Penal Enforcement Chamber of the Hildesheim Regional Court on the supervision of Christian B. However, the Hildesheim Regional Court must make a new decision regarding the instructions for taking up residence in Germany.

Christian B. was sentenced to a total prison sentence of seven years by the Braunschweig Regional Court for, among other things, aggravated rape. After his release from prison, he was placed under management supervision by the Hildesheim Regional Court for a period of five years. He now has to maintain regular contact with the probation service and management supervision office and is also obliged to wear a so-called „electronic ankle bracelet".

The Celle Higher Regional Court essentially confirmed this decision of the regional court in its decision of October 28, 2025. However, the responsible Senate repealed the punishment chamber's instruction that Christian B. must take up residence in Germany after his release from prison. This represents an interference with the fundamental right to freedom of movement for Union citizens, which can only be restricted on the basis of legal regulation. Such a thing is not apparent. However, the Senate pointed out that it would be entirely possible to impose a temporary ban on Christian B. from leaving the country in order to gain time for preparatory measures, such as regulating technical matters. In principle, it would also be possible to prohibit him from staying in individual regions that need to be defined in more detail. However, the Higher Regional Court could not take over the more detailed design of this instruction. The chamber at the Hildesheim Regional Court must now decide on this instruction again.

Background: What does leadership supervision mean?

The management supervision aims to help criminals reintegrate into social life and prevent recidivism. It monitors and supports a convicted person after his release from prison by monitoring behavior and ensuring compliance with instructions and requirements. This is also possible if the person is abroad. This will then require recourse to (enforcement) legal assistance, where appropriate, as a means of cross-border legal enforcement.

There's imo a very good article interviewing a sitting judge about the day to day of the court in Braunschweig, the quoted piece I've shown is very telling in the CB/MM case or should I say non case.

What does a criminal judge do at the Braunschweig District Court? Insights and answers

The ordering of pre-trial detention in particular is a significant infringement on fundamental rights“, he says. „There really must be strong suspicion of a crime.“

NOWHERE TO HIDE

Christian Brueckner’s new woodland lair discovered as two female ‘helpers’ with pitbull guard Maddie suspect’s lair

In an exclusive interview, prosecutor Hans Christian Wolters said: “If he leaves Germany it will be incredibly difficult to continue monitoring him.

“But we don’t need Christian Brueckner here to keep investigating. He doesn’t speak with us anyway.

“We will keep going as long as we believe there is still evidence out there to find — and we believe there is. One piece of forensic evidence or a new witness could crack the case instantly.”

Sounds like he anticipates a job for life.

IMO there is no forensic evidence to be found pointing to anyone let alone a supposed abductor, but HCW changes his mind previously saying it wouldn't continue indefinitely.

As an aside is the Sun reporter stalking CB? Desperate for that story?

Wonder what the bench mark for normal is for a woman to be described as creepy, who decides?
