Somehow the State is dragging its feet.
The question is why are they not ready more than two years after the events? What if none of the defendants waived their right to a speedy trial? Chad's trial would have been over by now.

There's a motion hearing for the state wanting LV moved to the same as CD. I don't see them successfully arguing against her constitutional right to a speedy trial because it's expensive or inconvenient. My money was on CD getting moved up to October (when JP wanted it to start). Lori Hellis I believe said this is what she thought would happen. Every day that passes though seems less likely. I can't believe there isn't more discussion about this as it's a huge deal.

Motion to Find Good Cause to Continue Trial & Prevent Improper Severance
This IS a HUGE deal. LV has agreed to her legal right to speedy trial. Thus her October trial date. Court has already ruled that LV and CD be tried together. So they both will be on trial together in October, right? I am stymied on lack of discussion as well.

There has been zero indications that CD will be tried in Oct. Why the state is pushing to try to get her moved back seems crazy to me. 1- I don't think they'll win the motion. 2- If they do, it opens the window for appeal. 3- Why didn't the state motion to have CD moved to Oct. which was JP's preference.

I haven't been thrilled with pretty much anything the state has done over the last couple of years. Lots of mistakes and after watching the Suzanne Morphew stuff, it does worry me a bit

I agree with you and wish we knew why?

Are prosecutors in general going soft on crime? I see it in the news every day.

Yes, I figured that there will be a Severance Hearing. That just got scheduled in my cousin's case where there is only one defendant, but two murders.

Truly never a dull moment. This is the first case that's given me this degree of whiplash.

So basically, she wants to be tried with CD, she's agreeable to continuing the trial till January but doesn't want to formally waive her speedy trial right. However, an appointment next month could throw a wrench in everything. This appears to be an incredibly lucky win for the state (minus the possibility of returning to the mental facility).

Maybe being tried with CD is the only way she can see him again.

But does HE want to see her? You can’t see it in his expressions. His attorney asked for separate trials. Tammy’s children blame Lori.
I think he is over her. His lust likely waned as he sat in jail.

Perhaps he thinks his only chance of getting away with it is to play dumb and blame her.

We've talked about this a lot. No one connected to her case seems to think she is faking mental illness. And she has an appointment with a neuropsychologist.

@mickey2942 insights?

Jmo

However, she can have a mental illness and still be competent enough to be tried

At least she finally got arraigned to face charges.

What professionals say, in court, or notes, can often be significantly different from what is discussed with colleagues at staff meetings or at a casual work lunch.

The situation here, is that the defense can, no doubt, find another professional to state that LVD is a full blown mental case, with dependent personality disorder, shared psychosis with CD. And who could argue with that? There is more than enough anecdotal evidence in this case to support those findings.

Again, this case reminds me of the rapist/kidnapper of Elizabeth Smart. Brian David Mitchell, who acted crazy, all of the time. But, planned, and executed a kidnapping. He was able to stay "hidden" in plain view. And function in society.

Brian David Mitchell was found Competent to be tried for the kidnapping of Elizabeth Smart. And personally, I think Wanda Barzee should still be incarcerated as well.

LVD will be found Competent for trial, I have no doubt. Her DSM-V diagnosis is a separate issue.

My own opinion. And I am not a WS verified expert in anything. So, FWIW.

Court TV pundits believe that by not waving a speedy trial Lori effectively severed the cases despite no requesting a severance. They think she is going first and will be pointing her finger at Chad.

Scott Reisch's take on the latest motions. He thinks that the prosecution shouldn't have asked for moving Lori's trial to January, because it could become an appeallate issue. Lori's attorneys are suggesting that they need more time and that she doesn't oppose to a small delay, despite not waving a speedy trial. It's not clear how the judge will decide on this.

@mickey2942 , IMHO you are certainly a verified expert poster!
