8. That’s when Brown started crying and asked for a moment to compose himself before continuing his testimony. When he resumed a few seconds later, he told jurors “We found ‘em.” Said he stood there, looking away from the bodies, until police arrived 5 minutes later. #wthr

11. Worth noting the state chose NOT to present crime scene photos of the victims to the jury today. The prosecutor already told jurors they’ll see evidence from the scene, which he described as bloody & gruesome. State is setting scene first. That evidence is likely next. #wthr

12. Also worth noting: jurors seem to like the presentation style of prosecutor Nick McLeland & state counsel Stacey Diener. I noticed some jurors nodding their heads during the state’s questioning of witnesses, seeming to suggest they are easily following along. #wthr

Day one in court | Delphi murders trial

Delphi trial day 2 was a bit of an abbreviated day in court. This tread has the latest.


State calls Steven Mullin, the current Carroll County prosecutor’s investigator. He was the Delphi police chief at the time of the crime.


Mullin testified to his timeline of events the girls went missing. He also drew on a map to point the jury to a few geographical locations near the Monon High Bridge.


State calls their 7th witness, Jake Johns.Johns is a delphi resident who testified to his timeline the day the girl’s bodies were found. He was part of the search efforts and found Libby’s shirt in the water.


During cross examination the defense asked about sound on the trails, Johns testified that sound traveled easy out there.



State calls witness 8, Pat Brown.Brown is a delphi resident, he found the girls bodies.


Brown got emotional during testimony, and had to pause to compose himself when describing the moment he saw the bodies. “We found them… I thought they were mannequins.”- Brown said


During cross examination the defense asked about Brown was asked about sound on the trails. He testified that you could hear fine out there. He also said he had cell service at the area where he found the bodies.

Tania Brief, a senior staff attorney with The Innocence Project, is talking about a type of commonly used forensic examination accepted by law enforcement and courts for decades: tool mark analysis.

It is how the Indiana State Police Laboratory says it confirmed an unfired 40-caliber cartridge was ejected out of a handgun of Richard Allen. The unfired round was found between the bodies of Abigail Williams and Liberty German. This is the only piece of publicly disclosed evidence linking the accused killer to the crime scene.

In the probable cause affidavit used to charge Allen with two counts of murder, it is stated as fact, “(an) upsent .40 round between the bodies of Victim 1 and Victim 2 was forensically determined to have been cycled through Richard Allen’s Sig Sauer Model P226.”

To understand how such a match is determined, we talked with Chris Monturo who has 26 years of experience and a forensic consulting and testing company in the Cincinnati area.

Monturo explained while ammunition is generally made of soft metals like brass, copper and lead, firearms are made of much harder metals.

But The Innocence Project is pressing on against tool mark evidence. During its 30 years of existence, it has used DNA to exonerate 375 people who were wrongfully convicted. An examination found flawed forensic evidence played a role in 51% of those erroneous convictions.

“The question for courts is whether or not the science is current and reliable,” said Brief.

#UPDATE: Updates from session 1 of day 3 in the #Delphi double murder trial.

- The first witness called by the state was Deputy Darren Giancola. He was the first deputy to arrive on scene after the girls’ bodies were found.
- Then came at least 42 graphic photos of the crime scene. They were taken by ISP CSI Josh Page. Below are my observations.
- Libby was naked and Abby’s clothes looked damp.
- There were at least four blood stains on the ground or nearby trees.
- Libby had significant blood on her hands and neck.
- Abby also had blood stains, not as many as Libby.
- Branches were placed on top of the girls, more so on Libby.
- Libby’s mom and sister were visibly emotional.
- Richard Allen’s mom and step dad were holding hands as photos were shown.
- Richard Allen did not have much reaction to the photos.

A brutal. emotional day. 90 minutes of crimescene photos, 42, shown to the jurors. Jurors and family visibly uncomfortable.


Two witnesses took to the stand this morning. DeputyDarren Giancola, a detective for Carroll CountySheriff's Dept.He was the first LEO on scene.Emotional testimony when describing seeing Libby andAbby's bodies.


Giancola: "One was nude, the other was clothed. Bothhad large lacerations to their throats. They both had asubstantial amount of blood on their person andunderneath.”


Prosecutor McLeland asked if life saving measureswere performed on either of the girls, Giancola said."No. It was apparent they were both deceased."


Giancola was crossed by defense attornev Andrew Baldwin. He was asked to clarify the typography of thearea at the end of the bridge, and where the blood was.He testified to Abby's pants appearing wet.


State calls Jason Page- an ISP CSI.Page was responsible for photographing the crimescene. 42 images were shown of the girl's bodies andthe crime scene.


Page testified to the topography of the area of the crimescene and explained in detail all of the images he tookthat day.His testimony was calm, a bit mechanical and veryexplanatory.


Page cross examined by Brad Rozzi. Rozzi's questions were heated when asking about the integrity of the bullet at the crime scene. Rozzi asked about "the lack" of photos of the bullet itself or any photos/videos of it being removed from the ground.



Page testified to suggesting the state hire a blood spatter expert after the defense became interested in a tree at the crime scene with blood, they said was "placed there."They named it, "F Tree." The defense has argued before they believe the blood was a symbol of sorts.



Page was questioned by Rozzi about DNA and how long it takes to test it from a crime scene. He testified, it depends. "It could take days or weeks to test, but it could be rushed.”



Rozzi began asking questions about why the bullet wasn't photographed once out of the ground by itself. "Wouldn't it be helpful to know that the same cartridge plucked out of the ground was the same to be used in this courtroom?”



Page responded "Yes."He also said, "How this [a bullet] affects this case is not my interest. Anything we see that could be evidence we take a picture of it in place.”



Page testified that his main responsibility was to photograph the crime scene. He was not responsible for moving bodies, deciding what/if DNA should be tested, etc.



State calls Duane Datzman to testify. He was an ISP CSI at the time of the murders. His testimony centered around photos he took at the crime scene from an aerial view in a helicopter and from on the ground.


Datzman testified to finding the bullet at the crime scene between Abby and Libby's bodies.
