**could someone bump up the link to the 2010 document about 2nd degree**?

(the defense tells the PA that if they do not settle a plea for second degree they will throw travis and all his friends and family under the bus)

the PA rejected that and anything short of the family asking for it.. well I do not see as that is what is going on right now imhoo.

To watch Defense Attorneys and Television Psychiatrist/Psychologist, MD's saying they believe her, they believe Travis did this and she is credible makes me feel only one thing.

I don't feel protected by them, I don't feel safe. Their ability to judge people is so far off they would fight for these people to be stroked and made whole again and returned home so they can heal.

And they are putting all of us and our families in danger. I would be worried if I were a wife or son or daughter of theirs that they have no judgment of danger and you are not safe around them.


:cry: ^ This is so sad and I'm in total agreement. Whether what they say is for show or they genuinely believe her or it's because they're paid for their opinions -- it IS scary.

I get into a simliar debate often and I make clear that my problem is not with defense attorneys (for example) in general but those who blindly take on clients 'just cause. I am well aware that we are all entitled to the best defense, we have the best legal system in the world (supposedly), and without defense attorneys our system would crumble. Obviously like anyone else I would want the best representation for myself or my loved ones.

Unfortunately we've all seen it happen too many times where there is such distorted, bizarre, backwards thinking that takes form in courtrooms as aggressive legal practice. This has real consequences on real people. It's not a game, it's not winning and losing, it's frightening that a defense team can put a defendant on the stand allowing them to hurl unfounded accusations which could garner sympathy and potentially allow this defendant to walk free, never paying for her crime and put her back on the streets to reoffend.

I'm concerned for the wrongly accused and wrongly convicted, but I'm more concerned with a system that's skewed to give defendants and their lawyers a much better chance at walking than it is in getting justice for society and the victims.

The more trials I watch, crimes I see perpetrated, and the more stories I hear from people on WS and beyond ... I've become much less trusting of the system and professionals as a whole. There are,however, plenty of excellent people who are standouts who go so far above and beyond who fight for what's right... Juan Martinez is one.

And that's my rant. Sorry, I'm so worn down from this :(

What am I missing? People keep talking about LWOP. As far as I have understood this is NOT something that JM is going to give in to. Why do people keep saying this. She cannot "cop" to a plea now because a plea is not on the table once the trial has started...is it? Very confusing because I don't see JM as letting this one go.

In most states, a plea deal is possible up until the jury pronounces their verdict. Both sides must agree, of course, with the judge's blessing.

I have no idea how it works in AZ. Hoping one of our attorneys can tell us.

As for the delay, if there is a technical problem with playing the now-famous-yet-unheard sex tapes, I think folks would know that, so it's gotta be some chasm ('kaz-um') of a problem that will have to be mitigated before court continues. Is it Juan problem or two? I hope it's Juan thing causing the poor wittle thing to cry.

I don't think the delay had one thing to do with the way Travis' family reacted in court. This was more serious. They would have just been advised to stay calm and court would continue. As for Jodi's tears.....it just looked like a brat who was told no...for whatever reason.

A plea can be entered at any time during a trial. But, I agree that JM is unlikely to accept any deal. However, it is possible that her attorneys were discussing making an offer to the state with her.



The case is not being tried in CA so CA law would not control.



The judge knows she is lying through her teeth and it is highly unlikely she would be discussing perjury with her.



She sure does. I can imagine what a tyrant she was as a child to her family. This is what her parents had to deal with.

Speaking of, maybe she doesn't want to testify today with her family there?

I have actually seen a secret recording made while both parties were in a two-party consent state excluded in AZ state court.

I wondered about that when she testified that he was (might have been?) in California too at the time she made the tape.

I'm going with HLN on this one because they'd be hearing things around the courtroom about what's going on .. so maybe Jodi thought she could control something about the sex tapes and she lost the fight .. someone upthread thought maybe she wanted to show an edited version which made only Travis look bad, but the decision has been made that if anything is shown it needs to be shown in its full unedited version. Could be!

I don't think she would care about that. My guess is something to do with the family/families or Jodi herself. Possibly something that happened between yesterday and this morning. Pure speculation, though, based on the court adjourning to "address" something out of the presence of the jury after already having had meetings in chambers all morning.

Actually, she's had five stories about her finger:

  • It was a broken glass at 'Margaritaville'
  • It was the female ninja
  • It was while she was bathing Napoleon
  • It was a broken glass while cleaning Travis' house
  • Travis broke it.

I'd vote to add 5.001 stories: don't forget many a cut and scratch were from her cat. The FERAL cat, that is!!

highly doubt that it is a plea considering she is on the stand and you know JM wants to go after her and he wouldn't offer a plea until after he is done slaying her on the stand.

AZLawyer had a great thought that maybe JM wants to get the finger x-rayed...that would be awesome!

Legal question....

If the DP is still on the table, it has to go through the entire jury process, right? Is that the case with LWOP?

It would be great if they found some reason; some law not to allow that tape to come in...

It is an interesting issue. Psychopaths do feel superior, but they also have an uncanny ability to "read" what other people want - that is why they are SO successful. I could see someone like JA feeling superior in a short testimony where they got to shine, but, over the days, I could also see someone like her becoming VERY frustrated when she is not getting the non verbal feedback from the jury she wants to see. How painful to see that they are not all with you, adoring you, and still be forced to continue. Especially if she is seeing them look to TAs family with any type of sympathy.

I don't think they are always right, but I think narcissistic personalities are very adept at telling if their stories are being heard. Typically, they can change their behavior to accommodate the listener's particular needs, but, in a case such as this, there is no real opportunity to do so because of lack of feedback.
Wholeheartedly agreed. Most psychopaths fare much better in a one on one environment when they can 'read' their intended target. That said though there are many psychopaths much more affable and likable than her too which would be more adept at conning a jury. I really hope she is indeed frustrated with being on the stand because heaven knows we all are. ;)

I do not know if I could be in the courtroom if this was my son or brother. Is it worth it to hear the lies......I don't know if I could ever get the words out of my head. It is bad enough to mourn the loss but to have to sit there while the murderer gets tell her story is cruel. I think I would stay home and think of my loved one in better times. Prayers go out to TA s family.

She testified yesterday about a bit of pre-planned sex play between her and Travis.

Travis drove up to her house, she was outside on the porch, he walked up to her and 'came' on her face .. then he left without a word and tossed her a Toblerone.

I can't see JM, or any attorney really, confronting her in chambers or anywhere but on the stand.

I don't think he would confront her. I think he would make any matter known to her attorney. Defense didn't have any problem letting the State know that if they didn't give Jodi what she wanted this is exactly what would happen. Now it's the State's turn, IMI. jmo
