Despite questioning during a preliminary hearing that fueled rumors about former sheriff Shawn “Mickey” Stines’s daughter, his defense attorneys now say they have seen no evidence of an improper relationship between her and Judge Kevin R. Mullins.

They had declined to comment on a direct question regarding those rumors asked by a Lexington Herald-Leader reporter after the preliminary hearing for Stines earlier this month.

“ There’s a lot of wild speculation at this point,” attorney Kerri Bartley said. “There is nothing we’ve seen that would substantiate that claim.”

I hope we can finally lay that rumor to rest and move on from the attitude held by some that this murder was somehow justified.

The indictment, announced jointly by state and local prosecutors, charges Stines with shooting and killing Letcher County District Court Judge Kevin Mullins. Stines is scheduled to appear for his arraignment on Monday, Nov. 25.

Shawn “Mickey” Stines was indicted on one count of murder of a public official, according to a news release from Kentucky Attorney General Russell Coleman's office.

Stines allegedly gunned down Letcher County District Court Judge Kevin Mullins in his chambers on September 19. The 54-year-old victim was shot multiple times and died at the scene. The shooting was recorded on a surveillance camera and shown in court hearing.

The 43-year-old murder suspect is set to be arraigned on Monday at noon local time.

Stines has remained jailed without bond following his first court appearance on September 25 where he pleaded not guilty.

EX-SHERIFF ENTERS SECOND PLEA OF NOT GUILTY
Former Letcher County Sheriff Shawn “Mickey” Stines was back in the Letcher County Courthouse Monday, this time to plead not guilty to the murder charge contained in an indictment returned last week by the Letcher County Grand Jury.
Stines, who shot and killed Letcher District Judge Kevin Mullins inside Mullins’s chambers in September, was brought to the courthouse from the Leslie County Jail, where he has been held since he was arrested shortly after the shooting.
Stines did not speak during the short hearing. Rather, his attorney entered the plea for him after declining to have the charges in the indictment read publicly.
More information will appear in the November 27 edition of The Mountain Eagle, which will be on newsstands tomorrow, a day earlier than normal.

The former sheriff was led into the courtroom with handcuffs, glancing at his family on the front row.

Moments later, the judge said bond would not be considered, but his attorney said they would seek an adversarial bond hearing.

“We still have this little thing called presumption of innocence. It doesn’t matter if the evidence is out there. It still carries the presumption,” said Stines’ attorney Jeremy Bartley.

Bartley says they have a solid defense, part of which is based on a moment of extreme emotional disturbance.

The prosecutor says it’s too early to talk about motives or if he will seek the death penalty.

“After all the evidence is collected and thoroughly gone through, conversations with the family have been had, and we’ll get their thoughts in that process,” said appointed Commonwealth’s Attorney Jackie Steele.

No court date or time for an adversarial bond hearing has been set. Another judge will be named to oversee the remainder of the case.

WHITESBURG, Ky. — During an arraignment Monday at the same courthouse where District Judge Kevin Mullins was shot and killed in September, a lawyer for the former sheriff accused of the shooting said his client has "a compelling defense."

A deposition his client gave in a separate federal lawsuit days prior to the September shooting is a part of that, defense attorney Jeremy Bartley said.

At the Monday hearing, a judge denied bond for ex-Sheriff Shawn "Mickey" Stines, who had worked with Mullins for years before the shooting in the judge's private chambers, meaning he'll remain in jail in the meantime in Leslie County.

Stines' attorneys entered an initial plea of not guilty in circuit court and said they planned to file a motion for adversarial bond, though Bartley acknowledged it's "unlikely" they'll be successful.
