It looks worse for DM I think. The iPad is set up to his ID and credit card, and he declines to give MS the password. Smich is at his house using the iPad, but it suggests DM has claimed it.

I think the important point for Dungey here is that the iPad was Dell’s to give in the minds of everybody. Similar testimony appeared in the TB trial. That does say something. What confers that specific authority? It’s an interesting question.

Yes. And why was he leaving "dough" for MS on July 4th. DM made all his minions work for their money. So what work did MS do for him? :waitasec:

I believe the older backup would continue to show the old name. When you do a recovery, you have to choose the backup date you want to use. And while I know there were a few back ups on DM's IPhones, from my understanding there was only one on the IPad. So basically, it was connected to DM's computer on July 4th and it was backed up at that time, probably with the old name. Then the next back up done in Jan 2013 had it renamed to Mark's IPad. Now we've been led to believe that this name change happened after it was connected in July 2012 but today we find out that they don't actually know if the name was changed at that time.

However it is noteworthy that all of the data on it from that time onward seems to be MS related. Right from the start. So Dungey suggesting that an email from 2013 claiming that DM gave it MS is not going to fly as to when he actually got it and started using it.

The ipad was initially hooked up to DM's computer, and (presumably) at some point between then and the next backup date of January 2013, the ipad's name was changed to 'mark's'... I don't believe they know what it had been called prior to that, because Falconer said that it could have been called 'mark's' even before July 4th (however, we are assuming that obviously DM and MS did not have the ipad prior to getting together with LB on July 3rd).

Okay, now I'm confusing myself - because if the initial attachment to the ipad to DM's computer in July 2012 is already showing 'Mark's', then why is Falconer saying it could have been changed to 'Mark's' any time prior to Jan 2013? ie if it wasn't changed until Dec 2012, then where is it showing up on July 4, 2012?

I'm not sure what Dungey's motive was for bringing forth that email. I got the impression that he was showing that DM 'gave' it to MS, as opposed to 'sold' it to MS...... but..... how does that really help him... and in fact.. doesn't that make his client's case worse? ie... if you assist in killing someone for compensation, it's M1... if DM 'gave' the ipad to MS, then wouldn't that be considered compensation, as opposed to what could have potentially been MS making a purchase unrelated?
In any case, I wasn't getting that Dungey was trying to suggest anything about the date when MS received the ipad? But who knows?
Was the purpose just to show that it was DM's first? And that DM had 'ownership' of it either way, whether it was 'given' or 'sold' to someone else?

The backup name is based on the name of your device. Change the device name and the backup name will change. The don't get replaced though, so you will always have old backups with the old name, and newer ones with the new name.
Well, due to phone data, we can see MS was there on July 3/4. Since these guys didn't delete any other incriminating back-ups, I doubt they deleted an iPad file with SL name on it. I even wonder if they are aware these back-ups are happening or they just think they're getting tunes updated?

Regardless of when the iPad became "Mark's", there is still the text from July 4 at 9:55pm where Smich is asking for Millard's password for his Apple ID. The iPad was connected to Millard's Apple ID. IMO Millard gave Smich the iPad shortly after Babcock was killed, and he helped him get it set up.

In addition to the "ashy stone" lyrics, there are also lyrics from the Bosma trial:

"My 380 iz no stranger. When I'm angered you're in danger."

The time stamp on those lyrics was July 7, 2012.

Although.. it is very circumstantial evidence to ask for DM's apple ID without indicating what it was for... for all we know, MS could have, on his own cellphone, been making an itunes purchase, using DM's account? Or even making a purchase on one of DM's other phones, or anyone's?

I wonder why they are not bringing forth that testimony/evidence in regard to that rap you mentioned above?

The communications with MWJ around the time preceding LB's murder, was it in regard to a 380 or a 32, or are they the same?? (I forget.. I know there was a lot of discussion about something like that back at the other trial).

I said last night that I could not see a man in his 70's thinking it would be a good idea to navigate those stairs so I bet it had been a while since WM had been in the basement of his home before his death.

Yes, I'll bet he *never* went down there. Ever. If you look closely at the picture.... it looks like the lowest step you can see in the picture is actually broken off. There is bare wood where the step is supposed to be, and it shows the step. I'm wondering if 'back in the day', the floor used to be covered with 'carpet'.. another 60s/70s thing? So they removed it at some point, and were too chintzy to do anything other than paint it. The picture tells us that it was definitely not polished. I guess basement finishing doesn't affect property values on that street?
