:twocents: For what it's worth: after re-evaluation, this "new stuff" isn't so new and dangerous for anybody EXCEPT the defense! Yes, first emotions were :maddening: "HOW DARE THEY/HE have material that no other party (outside of the "inner circle") has seen AND taken "out of context" comments were/appeared to be SLANTED"!:maddening:


REALITY CHECK: Nothing has really changed! The "dramatic information" offered by Jan was NOT a "do-over/take back", it was information SHE'S going to state UNDER OATH AGAIN......and ya betcha that John Schultz, Ph.D will have more to add/support/buttress the conclusion of manner of death.
Cheney Mason has provided a wonderful theory, a theory that the STATE does not have to pursue beyond LOGICAL behavior that one would expect from a responsible parent/adult/human of almost any age (think: even toddlers CALL 911 for help!).
Speaking just for the scientific community (how presumptuous, I know!:innocent:) but MOST if not all scientific specialists WILL NOT make claims UNDER OATH that what "so & so saw but I didn't" is WHAT I SAW!:banghead:
Now on the stand, being asked an opinion and stating it based within medical certainty (standards of practice) and /or after an extensive literature/professional & collegial search, THEN one can opine and emote, testify via lecture as some are prone to do or just babble but be ready to dance the "(s)he said & (S)HE said tango" aka the "battle of the experts"

Well exactly. I think it would be a Mothers first instinct too regardless of whose child was lifeless or struggling in a pool. I've been suspending normal thought processess to attempt to see the world ICA's way though. What would ICA do???
I can see her using an implement rather than dive right in, like Caylee was some form of leaf debris or a beach ball. I can't see her going further than the shed or kitchen for something long enough to fish something out of the pool though. Shovels are really heavy compared to mops and a mop has a longer reach and a T shape at the end to hook and drag with.
How many neighbours would she have visited to borrow a shovel from I wonder, If the first one wasn't home. This whole idea of an accident gone awry only makes ICA look colder and more calous IMO.

Ugly coping isn't going to work imo, ya know why? It's just another instance of Casey not giving a $hit about anyone but herself. After the jury learns of her thefts and lies, the way she treated her mother, friend, etc. I believe they will determine there was no ugly coping because that's the way Casey is all of the time. Lots of proof of it.

LE also gave her the opportunity of changing her story before she was arrested. They asked her if she was scared of what her Mother or others might think and the jury will get to hear those tapes. She insisted that no, nothing like that happened. After arrest when her father is battling it out with reporters and her Mother is crying because the media had reported a theory that Caylee had drowned in the pool, ICA denies it rolling her eyes. At about the 2:15 min mark they begin discussing the drowning theory.

All they need is someone who agrees with the above post on the jury, and KC will be free from prison in about ten years, I am guessing. It would no longer be first degree murder.

If I was on the jury, I wouldn't want to hear a lawyer speculating that it COULD have been an accident and COULD have happened that way...

Not when she has denied that it was an accident. Denied anything was wrong with her daughter. Gave several stories about a leaving her with a Nanny. And NOTHING about pool, water, or drowning.

Sure, she could have drown. She could have broke her neck. She could have died from being left in a hot car. There are many ways this little girl could have died. An accident? The neck breaking, etc.. searches before the 'accident' pretty much points to no accident. The placement of the tape on the childs head, that many strips of tape. And the total lack of remorse afterwards. I think the jury will have a hard time believing it was an accident.

I'm afraid that if someone agrees with the post you reference Solace, that she'll be acquitted. I don't know about this case, but in some cases the jury only has the option of a finding of murder in the first, not lesser charges. Even if the jury feels the defendant is guilty of murder in the second, not the first, they have to acquit if second degree is not a option. I guess it is all in the jury instructions???? I am hoping that the SA's case is so strong that DP can be proven without leaving wiggle room on intent etc., IMO intent is the only hope the defense has to a not guilty on a DP. That is why the drowning scenario would be the smartest defense - but they can't shake the stink off the Zanny the Nanny defense or SODDI defense quite so easily.

Since they haven't entered anything into evidence that would support a drowning theory, isn't it rather to late for that??

I think what he was trying to do/prove is that Dr. G couldn't state for fact, how she died. IT could have been suffercation, it could have been drowning. IF he could get her to state an alternative, then he would have used that against her. Poke holes in her statements. Make it seem like she was trying to "be mean" to ICA. <eye roll> Which is why Dr. G came back at him about what the tape on the head actually means.

Ugly coping will work. Ugly Coping can be many things. Lying, arguing, driving recklessly, stealing, fighting, drugs and/or drinking or murder. It doesn't change the fact that an illegal act is still prosecutable.

They're expecting us to believe Kronk "staged" the scene because he says he lifted the skull and dropped it and Dr. G during her deposition said she didn't believe that there was that much movement?
