What if the marks on his arm were from a dog- any ol loose dog coming across his body on the lawn before he was fully covered in snow? Pawing at his arm.
That seems more likely considering there’s no signs of a struggle with a dog. No dog saliva, no dog hairs….

What if those marks have nothing to do with the cause of him being there?

( I still believe the taillight caused them, for the record)

JOK manually locks his phone at 12.32, and then 7 seconds later it never moves again. If he took it inside, and was in a fight, and the perps moved him back outside later, the phone would show the movement.

He wasn't moved immediately per snow plow driver at 2:30 who saw no body. IMO, someone else turned off and locked his phone at 12:32. IIRC his phone disconnected KRs car abt 12:29/30, he entered the home, she waited, then left to where her phone connected to JOKs house at approx 12:36 a reported 6-7 min drive in good weather. She didn't turn off his phone. Did John after being struck by her car turn the phone off himself?? Remember the people in the car behind her and all of the people who testified they were looking out the window for John's arrival??? No one saw John during that time period.

OK but even if someone else had his phone at 12.32 how would they bring it back outside later after 2.30 without registering movement in Apple Health?

The phone was not switched off - it was on the whole time.

Sooo…what’s the over/under on ARCCA having deleted those texts too?

I think they’ll have deleted them too.

Maybe Arrca got advice from the Albert's and Higgins about what to do with text messages and phone calls, moo

John O'Keefe never went inside of 34F.

Re: KR and John O'Keefe’s arrive at 34F just before 12:30 am.

Apple Health (an iPhone app) recorded him taking 80 steps approx. 200 ft. and climbing the equivalent of three floors with his location data pinging near 34F.

Keep in mind that John O’Keefe did not have an Apple Watch on at that time.

The step-counter relies on its accelerometer to detect rhythmic up and down movements associated with walking. However, other motions, such as getting jostled in a car, vibrations from bumpy road, or handling the phone can sometimes be misinterpreted as steps.

Was he holding his phone or on (back pocket) person?

Additionally, movements sitting, standing or shifting positions may cause the accelerometer and altimeter misinterpret these actions as climbing. Ex. Repeat up and down motions might mimic stair climbing.

Resulting in: registering vibrations or movements as climbing steps.

Cold weather, heavy vibrations, loud sound system, can interfere with the iPhone’s sensors, in addition, device not updated with latest IOS, and software glitches, which would possibly lead to erroneous elevation data.

Just an opinion, as always

I used to be quite in to the idea Proctor deleted the Ring videos but now I am not convinced. There is a lot of risk to doing that (for anyone) as the deletions would likely be logged on the cloud side.

Might there be another discovery violation where they simply didn't produce videos unhelpful? Possible given the Sallyport video history.

It's strange to me though, that the CW did discover the collision with JOKs car - which is absolutely load bearing evidence for the defendant. If you framing her - why do this?

This all makes no sense to me. Of course very helpful to the D on the botched investigation front.

MOO
Karen Read herself stated in interviews that she showed Kerry Russell and Jen McCabe the damage to her taillight in John's driveway. The bulb was exposed. She was concerned about driving because the jagged pieces might cause a short. So she said she picked out fragments out of the taillight cavity and dropped them on the ground.

As far as I know, no fragments or pieces of the taillight were recovered from John's driveway. Maybe they were picked up by the snowblower or shovelers and thrown a good distance and searchers didn't locate them. Or perhaps it didn't happen as she recalled.

The significant aspect of Karen's statements is that she confirmed Kerry's testimony that Karen showed them the damage to the taillight in John's driveway. While the critical video of them leaving is missing, a clip or transcript of Karen's statement supports Kerry's testimony.

Monday: Half day of testimony for jury.

Half day (afternoon) of voir dire interviews of ARCCA witnesses.

Judge Beverly Cannone’s response:

  • Found the defense in violation of the reciprocal discovery and that it was deliberate. And this needs to be figured out before ARCCA can testify.
  • Will have a voider hearing Friday. Needs the witnesses Friday. Order for production of records.
NOTE: There has been a date change. The ARCCA experts will be on the stand for teh voider on Monday, April 28, 2025
For the second time in two months, the judge overseeing Karen Read’s murder trial dinged her defense team for violating its obligations to turn over material to prosecutors.

Judge Beverly Cannone determined that Read’s defense had not fulfilled its reciprocal discovery obligations with regard to a pair of accident reconstructionists first hired by the federal government. The decision came after the first day of testimony in Read’s second trial.

Was it ever talked about why John O'Keefe didn't go to the funeral of the other Boston cop that Higgins and Albert attended? Or why he was home that Friday from work? Seemed he had the day off on a Friday.

Question about cell phones recording steps. I have an iPhone and frequently look at my steps using the Health app. I notice it records my steps when I walk and phone is in my pocket but NOT when placed in a dog buggy that I am pushing, not when I hold it in a moving golf cart and not in a car. And, I’m not certain that it always registers when it is in a purse. Furthermore, anyone who walks with me will have a minimum of 10% more steps recorded on their phone even though we walked together for the same distance. SO - IF JO had his phone on him and was moved by car, wheelbarrow or merely lifted and carried - the movement wouldn’t register as steps, would it? And, how accurate is the app or whatever is calculating the steps? Is there a margin of error?

Having an iPhone in a pocket or bag would cause movement like sitting, standing, or shifting positions may cause the accelerometer and altimeter to misinterpret these actions as climbing.

I almost never pay any attention to my Apple Health app; however, today, I decided to walk up and down several flights of stairs and it didnt record them as climbing. I have an Apple Watch and it recorded the flights climbed. moo

Ummm…you are saying any ol’ loose dog that has no DNA then? Just because it’s not Chloe, it will still have DNA. Their testing was incompetent, so we will never know. I don’t think JOK’s DNA even showed on his own clothes, per their testing.

Sure not pawing type marks, holes in his shirt matched the arm . Photos.

Looked like punched holes to me, on shirt and arm. Teeth marks. The two on elbow looks like dog bite. The others look like John was pulling away from the teeth.

I was speculating if that’s the way he died. I go back and forth with what happened that night. I honestly don’t think anyone intended to kill him. I think whatever happened was an accident that went too far. This is my opinion.
I agree that it must've been an accident. I think the dog was the initial incident and the blunt trauma came from being hit with a heavy object or falling onto one.

That doesn't fit the apple health timeline.

JOK manually locks his phone at 12.32, and then 7 seconds later it never moves again. If he took it inside, and was in a fight, and the perps moved him back outside later, the phone would show the movement.

IMO the D timeline requires him to drop his phone outside IMO. There is no other way it can get to where it was found without movement registering later on.

Unless someone has a theory?

ETA - this is why I thought the D would go with an outside the house theory.
How about if the phone is turned off instead of simply being locked. Will it register movement then?

I have no doubt that ADA Brennan will deliver on every word from his opening statement.

The black box data - invaluable.

  • Prosecutor Brennan states in the opening that they know exactly when John O’Keefe was hit by Karen Read’s Lexus based on “black box” data of the vehicle.

Didnt Jackson say in opening that both KR and JOK exited the SUV. So, he knows the black box data is going to show that the driver side of KR’s door opened. Very curious if this is when KR said, “he didnt look mortally wounded as far as I could see." Or was that statement said when she went back to the scene of the crime before contacting KerR and JMc? We shall see. moo

I still think it was the taillight

They were not testing for John’s DNA
They were testing for DOG DNA.
They tested two different ways- zero DNA from a dog

I was just giving ya a bone to chew on and consider

This was debunked at trial in Guarano's testimony but i think I will just wait for him to testify again. The 3 flights were registered before they arrive at 12.24 (per WAZE) and are still half a mile out.

But see for instance p127

IMO the CW will establish the phone cannot have gone inside - because if it did, we'd have movement on the phone later that morning, sometime between 12.32 and 6am when it was recovered from under JOK

IMO there is simply no way to move the phone later on without recording steps/movement.
The Waze data is certainly not accurate. I used Waze last week on a long road trip, it lost my correct location many time and I would have to close it and re open for it to update and find me again. It was annoying but it’s my favorite.

Anyways back to the case, the Waze data had them at 12:24 still half a mile away. That’s not accurate because Nagel testified that he texted his sister at 12:21 right before turning on Fairview and they turned on the road right after KR, they flashed their lights to signal her to make the turn first. The house is the second house on Fairview from Cedarcrest, the road they both turned from. This is a very tight timeline, considering JOK disconnected from KRs car at 12:28 and she connected to JOK home wifi at 12:36, which is said to be a 7min drive atleast.
