Another point on the intentional misconduct is that the prosecution TEAM had knowledge. Lally and Mclaughlin must have known (or should have known) in addition to Brennan. They've been around for this case and this issue for years. Are we to believe that nobody on the prosecution team, at any time, knew that Hartnett cut the back of the hoody despite the reports, testimony in 2 trials, studying the hoody, having the hoody mounted as a trial exhibit? Do we believe that none of them reviewed Hartnett's reports before examining her as a witness? If none of them had any idea (and you are willing to accept that explanation), what does that tell you about the state of this prosecution?

The craziest part is she tried to insinuate that the defense knew Brennan was gonna do that stunt with the shirt because she herself noted it being propped near the witness stand. Like she literally tried to turn it around on the defense. She is 100% bias against the defense and she shows it time and again. Most judges would’ve admonished Brennan and told him not to pull that crap in their courtroom again.

But it seems IMO (IANAL) that if Brennan opened the door about apparent holes in both sides of the sweatshirt fabric, and alleges how that occurred in his opinion…… then seems defense should be allowed to explore that territory now. And what might have caused it? But I see now that Alessi is pressing that this was a deliberate misrepresentation by HB? Sorry as I am way behind. Still seems the CW has opened up something here IMO by HB statements on something in evidence? And a new or differing interpretation of it? MOO

I know all states seem to have massive backlogs, no staff. This unfortunately has gone on forever it seems in reading news articles. NOT worth it to the best of the best, through with the petty pushing and being soley held responsible. Nasty tactics to let the ME's take the fall. Who would not.. 'seee yaaaa'... IMO

I guess the issue I have with this is even if he did it accidentally, what does that tell us about his attention to detail and evidence? A woman’s freedom is at stake here and he just “oops, looks like I missed that entirely” as if it’s no big deal? No.

That said, I absolutely think it’s possible it was intentional just to create more confusion since he clearly can’t attack the actual evidence of ARCCA.

and IF Brennan didn't know about the hoodie being tested... why didn't Lally? he tried this whole case last year. We may not see him often in this trial but he is sitting right there beside Brennan watching, as if he didn't know what Brennan was going to do with that exhibit. JMO

I just assumed she was vigorously keeping track of the evidence labeling as that seems to be very important to her. She must not have a lot of confidence in the 3 people paid to document such things for this trial. JMO

IMO, she may have been as surprised as the defense to this tactic and was trying to get her bearings as to how she could cover for him.
