According to a note of the PGR, the diligence "won't happen" due to "the previously announced absence" of four friends of the McCanns who spend holidays in the tourist resort of Praia da Luz, Algarve, at the time that the child disappeared, on the 3rd of May of 2007.

Are we safe to assume that the four are the Tanner/O'Briens and the Paynes?It's easy to imagine that Webster and her "kids" would come back.

Public Ministry prepares an accusation for Exposition/Abandonment and Negligence against Maddie's parents

"The Public Ministry has collected enough evidence to accuse the McCanns even if there is or not a re-enactment of the facts that occurred in the day the girl went missing". The guarantee was given to 24Horas by a judiciary officer who has been following the investigation. The same source added that the indictment might only take place in July and that the McCanns can incur in a penalty "that can go up to 10 years in jail". Another source connected to the case concluded: "We know that the girl disappeared and there are strong evidences that she died in the apartment, apparently in an accidental way. There are also strong probabilities that her corpse was hidden. Nonetheless, independently from that, there is clear proof under the Portuguese Legislation that the parents of the child left her exposed to an eventual kidnapping, like they did with her twin siblings. That is a crime of Negligence and Exposition/Abandonment over people they had the duty to protect.

Ongoing Investigations

Contacted by the 24Horas, Guilhermino Encarnação, the assistant director of the Judiciary Police and the very person in charge of the Directorship of Faro, merely said: "the investigations continue and when there is something relevant to reveal" about the mediatic case "that will be done through the official channels".

A source from Portimão's Court assured to 24Horas that the Public Prosecutor Magalhães e Menezes, the responsible for the administration of the inquest, is already working in the accusations against the McCanns and that will be made public "very soon". That is, the probability for the McCanns to stop being arguidos in the following months is almost null. 24Horas also knows that Robert Murat and his companion [Michaela Walczuch] have strong possibilities of not being implicated in the accusation.

Exposure or abandonment

1 - Whom endangers the life of another person:
a) By exposing her in a place where the person is subject to a situation which she cannot defend herself from on her own; or

b) By abandoning her in a defenseless state, for motive of age, physical defect or illness, when the agent had the duty to guard, watch or assist to the person;
is punished with a prison term of 1 to 5 years.

2 - If the fact is practised by an ascendant or descendant, adoptant or adoptee of the victim, the agent is punished with a prison term of 2 to 5 years.

3 - If the fact results in:
a) Serious offense to the physical integrity, the agent is punished with a prison term of 2 to 8 years;
b) Death, the agent is punished with a prison term of 3 to 10 years.

God I hope this is true & this little girl will have justice at last! I don't hold out much hope for her being found to have a Christian burial though as I think this murdering pondscum will lie to the end! They will never admit the truth or divulge where her body is but I have no doubt that she is surrounded by angels regardless!

Colomom, darlin' that's not quite true. We care about her. And our collective prayers are going to bring her home eventually or at least bring the people responsible for her disappearance to justice. Hard as it is, we have to have patience and perserverance.

I checked Gerry's blog. So far nothing. I can't wait for him to write about this......

Maybe they were warned that charges might be brought. Remember when they were made arguidos? They new a couple of days ahead of time and they began putting out press releases saying it was time for them to go home, etc. trying to make it look like they were planning to go home even before they were named suspects. But it came out that the PJ had told them several days before the questioning that they were likely to become suspects.

Now they are saying they won't go to Portugal for the re-enactment, maybe because they have been warned by the PJ that they are likely to be arrested?... I know that is what the media links are alluding too, but maybe the McCanns have received "official" notice from a named source........

Yes! It's NEVER the McCanns' fault or responsibility for any of their decisions. They could very easily have said, "We understand our friends' decision but we are going anyway to provide whatever assistance we can."

But no.

It is never, ever the McCanns' responsibility for making any decisions or actions, is it?

Kate and Gerry McCann were dining with seven British friends at a tapas restaurant in the Ocean Club resort when Madeleine was reported missing. The friends are crucial witnesses but have said very little publicly. Police sources have claimed there are inconsistencies in their statements to officers. Jane Tanner told police that she saw a man walking away from the McCanns’ apartment at 9.15pm. Sources close to the couple have previously said that the man had a child wrapped in the blanket and was walking in a southerly direction. However, the London Evening Standard reported yesterday that Ms Tanner had seen man carrying a girl dressed in Madeleine’s distinctive pink-and-white pyjamas walking eastwards, towards the house of the official suspect Robert Murat, 33.

3. WHY ARE THE McCANN'S EARLY TV INTERVIEWS BEING SCRUTINISED?

Commentators have seized on the lack of emotion shown by Kate and Gerry McCann during a series of televised statements and interviews in the weeks after Madeleine’s disappearance. It is claimed that this was an unnatural response and indicated that the couple were hiding something. In fact, criminal profilers had advised them to display no overt emotion in case Madeleine’s abductor “got off" on the sight of her parents in obvious distress. Off camera, they were deeply distressed and received help from counsellors.

4. WHO IS ADVISING KATE AND GERRY McCANN?

British lawyers Michael Caplan, QC, an expert in international law, and Angus McBride, a solicitor who specialises in protecting the reputation of individuals subject to media or criminal investigation. They have also hired a Portuguese lawyer, Carlos Pinto de Abreu, who filed the libel action against a newspaper which said the police suspected them of involvement in their daughter’s death.

5. WHY IS THE McCANNS' HIRE CAR PIVOTAL TO THE INVESTIGATION?

Portuguese police claim they have found traces of Madeleine’s hair and bodily fluid in the boot of the Renault Scenic, indicating that it was used to transport Madeleine’s body after her death. Scientists have said that it should be possible to establish whether the hair came from a dead or living person.

6. DOES THIS MEAN THE SCIENTIFIC RESULTS HOLD THE KEY TO THE CASE?

Not necessarily. Kate and Gerry McCann used the Budget rental car to move apartments, taking with them all their children’s toys and clothing, which would have contained large amounts of genetic material. It was also used by friends, relatives and people who worked on the campaign to find their daughter.

7. WHERE IS THE CAR NOW?
When the McCanns left Britain they drove the car to the airport. They have since said they will hold on to the vehicle to get their own independent scientific examinations done.

8. UNDER WHAT CIRCUMSTANCES WAS THE CAR SEIZED?

Police seized the car last month and took it to an underground car park opposite their offices in Portimão. Police sources say this is an unusual place to carry out such a delicate search.

9. IS THERE ANY OTHER EXPLANATION ABOUT HOW THE MATERIAL COULD HAVE GOT THERE?

If the DNA samples did come from Madeleine’s corpse it would seem an amazing coincidence that the McCanns hired a car used by their daughter’s abductor and killer. However, friends of the McCanns claim that the couple are being framed. It has also been suggested that the samples may have been labelled incorrectly.

10. DOES A LARGE QUANTITY OF HAIR PROVE THAT MADELEINE'S BODY WAS IN THE CAR?

No. The hair must show evidence that it came from a decomposing body. Other hair could be “transmitted” from items of Madeleine’s clothing and belongings.

11. WHY DID PORTUGUESE POLICE WANT TO READ KATE McCANN'S PERSONAL DIARIES?

Detectives wanted to check for inconsistencies with the information previously given to police and for clues about the personal relationship between Mrs McCann, her husband and other members of the party who went with them to Portugal. Mrs McCann was seen regularly writing several pages a day in the diaries.

12. WHAT EVIDENCE COULD BE HELD ON GERRY McCANN'S LAPTOP?

Mr McCann sent and received dozens of e-mails almost every day from friends and people involved in the campaign to find his daughter. It may be possible to retrieve those e-mails, which detectives hope could provide information about the events surrounding Madeleine’s disappearance and the couple’s connections with other people.

13. WHAT WERE THE MOVEMENTS OF THE McCANN'S FRIENDS ON THE NIGHT MADELEINE DISAPPEARED?

The McCann family had stayed at the Ocean Club resort with three other British couples and their five children, and a single woman. Russell O’Brien, a doctor from Exeter, left the restaurant for half an hour to look after his own daughter, returning shortly before Madeeline was reported missing.
His wife, Jane Tanner, was the only witness to report a man carrying away child from the McCann’s apartments. There is confusion about when members of the party arrived at the tapas restaurant and left to check on their own sleeping children.

14. WHY WERE THE McCANNS ALLOWED TO LEAVE PORTUGAL IF THEY ARE SUSPECTS?

The Portuguese authorities allowed the McCanns to return to the UK after they agreed to reside only at their home in Rothley and to return for further questioning if necessary.
Portuguese law states that after someone is declared a suspect, police have eight months to conclude the investigation into that individual. If they require further time officers can apply to the courts for a four-month extension.
If the McCanns refused to comply with a request to return to the Algarve for interview, Portuguese police could issue a European Arrest Warrant under which extradition can be carried out within six weeks.

15. WHY ARE THE McCANNS SUSPECTS IN THEIR DAUGHTERS KILLING?

Portuguese police refuse to say why the couple have been made official suspects. Under Portuguese law police can not question someone as if they had committed a crime unless they are a “suspect”. It could simply be that police wanted to ask the couple about the evidence they had collected, and that the seriousness of the process has been misunderstood and exaggerated by cultural and language differences.

The men of Gonçalo Amaral, now replaced by the inspector Paulo Rebelo, also had the opportunity to conduct wiretaps after the disappearance of Madeleine and while the couple and his friends were in Portugal. Once the couple and his friends returned to the United Kingdom, PJ British authorities expected the continuation of work but it is still uncertain whether all the information could be provided.

According to the interpretation given by the magistrate Criminal Tribunal 1 ª Portimão instance, Pedro Frias, the Portuguese law, upheld by the Court of the relationship, investigators can only use the data obtained in real time. In practice, it would have taken the investigators have obtained a permit before the disappearance of Madeleine.

Pedro Frias did not refuse the use of or access to all eavesdropping or recording made in connection with the investigation, but it does investigators the right to use the content of SMS sent and received by the McCann couple before May 3, 2007.

The Public Ministry and the Judicial Police also wanted to ask the three operators of mobile telephony exist in Portugal - TMN, Vodafone and Optimus - listings in digital media (CD or DVD) of all communications on the couple and friends for the period April 28 to September 9, 2007.

The urgency of getting the image of a "Tapas seven" united and strong

The announcement by the Office of the Attorney General of the Republic (PGR) cancellation of the reconstruction requested by the Judicial Police, indicating that this decision was the consequence of the refusal of four friends of Madeleine's parents to make their trip back to Praia da Luz, caused a huge tuplet requiring Clarence Mitchell to react.

If the cancellation of diligence was not a real surprise, the confirmation of the PGR that there would be four witnesses to refuse to cooperate formally with the Portuguese authorities raises a question: why the other three have they accepted , Unconditionally, to cooperate with the Portuguese authorities?

Yesterday, there was an official release from the Portuguese courts and it was confirmed on the reocrd - not from 'a source' - that the Madeleine McCann police invesigators are considering one or more of the following issues:

1) child neglect/negligence by the McCanns for leaving their three children under four alone six nights in a row

2) the possibility that Madeleine was abducted
3) the possibility that Madeleine was killed/murdered
4) the possibility that one or more people disposed of a corpse without informing the proper authorities.

MADELEINE McCann’s parents could face charges of neglect.

The confirmation they could face “abandonment” charges came in court documents revealing the areas Portuguese police were considering.

Their inquiry also covers the possibility that someone abducted Maddie or that she was murdered and her body hidden.

Clarence Mitchell, the couple’s spokesman, emphasised the court papers did not mean the neglect charge would materialise.

He said the couple vigorously denied neglecting Madeleine, but were pleased abduction was being investigated.

A neglect charge carries a maximum penalty of 10 years.

Or, in view of the mass boycott of the reconstruction by the 'Tapas 9', perhaps: 'Leaving many stones unturned' - or even 'Trying to hide things under an enormous boulder'

Hi All, in the brief newsflash in Correio de Manha it is announced that there is now an Order not covered by secrecy of justice that the McCanns are now to become DEFENDANTS for the crimes of murder, exposure (to risk of serious harm) abandonment and concealment of Madeleine's corpse. This has also been confirmed on Portuguese TV and also in the newspaper 24 Horas.

This means that LE knows what was said and who said it... but it can't be used in court (so to speak). But it may point LE in the precise direction of what they need to find that can be used in court. Gosh, I hope they can solve this awful case. If there is some kind of conspiracy of silence, you just have to wonder what is so terrible that the remaining Tapasians won't talk. Although I realize that careers are at stake-- surely someone with any integrity at all would be willing to speak up for a little girl.
