Christian B.'s lawyer, Friedrich Fülscher, confirmed to NDR Niedersachsen on Tuesday evening that his client will have to wear an electronic ankle monitor after his release from prison . The 48-year-old will also have to report regularly to the probation office and the probation service. He thus confirmed a report by the news portal"Spiegel Online ." According to the report, B. must also establish a permanent residence, which he may not leave without permission. As Fülscher also confirmed to NDR Niedersachsen, Christian B. must surrender his passport. According to "Spiegel," he will receive an identity card limited to the territory of the Federal Republic of Germany.

Since they have managed this, and no suspicion of fleeing exists (for now) I dont understand what good it would do to the investigation to arrest him and potentially jeopardise it by giving all evidence to his lawyers and risk not winning the trial. Jmo

They would not charge if they are not certain it would 1. Lead to a trial and 2. Convict him.

BARD is needed even for the arrest warrant in Germany . And we saw in the previous trial that despite passing that threshold it still led to his acquittal. So his lawyers could introduce doubt in many places if the prosecution cannot 100% show CB was holding his mobile in PdL.
If BARD were needed for the arrest warrant, the conviction rate would be 100%. It’s not so this can’t be correct.

See my comment above - no need to arrest him and jeopardise their investigation now imo

Does this mean that a court has agreed he's a dangerous man who poses a risk of sexual offences to the public?

It may be that his refusal to participate in any therapy & the assessment of the psychiatric expert, have brought the court to this decision.

HaB and HB will now hopefully feel safer knowing this convicted rapist, child molester, depraved menace can't cross borders and that this is enough reassurance for German women and Mothers too.

Definitely the report of the court appointed psychiatrist from the other trial (with the not at all biased judge, who had also presided and gave him only 15 months for the sexual abuse of his gf's 5 year old girl) imo

It’s not what the defence wanted but on the whole I think it’s the sensible decision.

I wonder whether the court decision & thus their judgement/reasons to apply these measures, contradicts anything the trial judge concluded & ruled on.

Interesting, especially if this court’s decision contradicts any factors of the previous court’s decision.

Having control over him outside of prison is not as good as having control over him inside of prison but it’s certainly a lot better than what was speculated.

House arrest. We know he was skilled at breaking into homes. Will he try to break out of one?

May he harm no one anew.

I think it may be a mistake to have the impression that FF has ‘rescued’ CB.

In my opinion these lawyers aren’t involved because they’re freedom fighters or miscarriage of justice advocates. I think they’re running this case as a loss leader to increase exposure & attract high profile big money cases in the future.

IMO They got involved because they want to sell themselves during one of the biggest cases in history. Therefore I expect that the current situation is not favourable to their agenda either.

i think he’ll sleep with one eye open, hoping nobody climbs up & comes in via his bedroom window.

I think he’ll be relieved to be out of his cage but will quickly become frustrated by the control the state have over him

Interesting that one of CB's lawyers suggests these measures are akin to an attempt to keep CB in some kind of pre-trial detention.

So, are his lawyers expecting a murder charge at some point?

Since they took him on as a client he has been found not guilty on five charges, not charged in the MM case, and been freed from prison - all despite the best efforts of well-resourced prosecutors.

FF and team are probably okay with this exposure.

These are seperate issues. Post conviction supervision for serious sex offenders is normal.

The trial judge didn’t think the psychiatrists profile of CB was sufficient for a conviction. Given he never actually assessed him, that probably fair.

The state have had control for the last 7 yrs, he's likely on the way to be institutionalised.
