PONTIAC, Mich. – The third day of a pre-sentencing hearing for the Oxford High School shooter wrapped up Tuesday following three sessions filled with troubling testimony meant to help the judge decide whether or not parole will be an option.

The now-17-year-old Oxford shooter has been present in court for what’s known as a Miller hearing before he can be sentenced for the 24 felonies he’s convicted of. The shooter faces mandatory sentences of life in prison without parole in connection with the Nov. 30, 2021, massacre, but his sentencing must be handled differently because he’s a minor.

Since the hearing began on Thursday, July 27, the defense and prosecution have called witnesses to offer testimony in support of, and against, a parole option for the shooter. In short, the defense have been trying to prove the belief that the shooter should be allowed a parole option, and that he is not beyond rehabilitation. Prosecutors have been working to establish the opposite, arguing the incredibly violent and premeditated violence calls for the harshest sentence.

The hearing is still not over, and will resume at 9 a.m. on Aug. 18 for what is expected to be the final day. After it has concluded, the judge will decide on a sentence...

So one more day of Miller hearings on August 18th. I wonder if this is the date for the defense and prosecution to give their final summaries, or if there will be more witnesses.

I noticed that the judge in this case takes a lot of notes, and I assumed this was to help him remember some key statements by expert witnesses that he wanted to keep in mind. But from reading the article that you posted above, it appears that when the judge decides his sentence for EC, the judge must include on the record what the mitigating and aggravating circumstances were that went into his decision-making regarding the sentence he imposes.

Of course, the judge will have access to the full transcript of the Miller Hearing, but he will also have his own notes to review.

Following the hearing, the judge will issue a decision on whether to sentence the minor to life without parole, or to a term of years in prison instead, the Michigan bar says. Whatever the judge decides, the court is required to state, on the record, the “aggravating and mitigating factors it considered in reaching its decision.”

Also - it sounds like a separate date will be established for the sentencing hearing, so maybe not on August 18th. I guess we will see.

A sentencing hearing has not yet been scheduled. The judge said Tuesday he needs to discuss with the Michigan Department of Corrections before setting a sentencing date.

I decided not to watch the mentioned video, but if it was taken some time recently, then it shows neglect of his mental health by the state, right? They should have disclosed the approximate date for the video. All IMO.

IMO it doesn't show neglect of his mental health. The last person to testify did speak to the various medications that he is now taking. I would assume, as is true with anyone taking medication, that maybe dosages needed to be adjusted, etc. There was very little context given to the videos. The prosecution did point out that the videos were all from ONE incident and I find it hard to believe that the defense wouldn't have shown EVERY video available if it had happened more than once.

I read on this thread that he did not like how his meds made him feel so he didn't take them.

The psychiatrist who has treated Ethan at the jail did say that there have been times when the teen did not take his meds as prescribed. I don't recall specific dates or how long he might have refused medication. Dr. Fariha Qadir said that Ethan has been compliant more recently and is on a cocktail of meds for anxiety, depression, sleep problems, and mood stabilizers. Dr. Qadir did not diagnose Ethan with psychosis, so he is not taking anti-psychotics. JMO

Oxford school district lawyers advised six employees facing lawsuits in the 2021 Oxford High School shooting not to cooperate with an independent investigation into the attack, adding "it may make defending the lawsuits more difficult," according to an email obtained by The Detroit News.

Attorney Ken Chapie, counsel for Oxford Community Schools and school employees being sued by survivors and families of those killed and injured, told his clients "you do not have to" cooperate with Guidepost Solutions investigators, the firm hired by the school board and tasked with issuing the first public report on the Nov. 30, 2021, attack during which a student gunman killed four students and injured seven others.

It's the first evidence that the school district's lawyers urged school employees not to cooperate with the investigation, though the Michigan Education Association also advised its members not to participate in Guidepost's interviews. Earlier this year, Guidepost said it had endured "extraordinary" interference in its investigation, though officials with the firm have declined to comment on the source of the interference...

Very interesting article, thanks for posting it. I wonder if Ethan's attorneys will be in contact with this expert and try to get Ethan tested. I wonder how accurate and scientifically valid the testing and results are. Nonetheless, I think it should be looked into and no stone should be left unturned, due to Ethan's age and the fact that he is facing a life sentence. If he would be diagnosed with FASD, then I wonder how that would relate to the possibility of rehabilitation, which is one of the criteria for decided if he should be given life with or without parole.

On another note, this information about the lack of liver development in the unborn and the impact on the brain since alchohol can't be filtered by the liver should be made more publicly known so that pregnant women understand the physiology of the impact ofdrinking alchohol while pregnant and the effect it will have on the child.

Guidepost Solutions, the firm the board hired to issue the first public report on the attack in 2021 that left four students dead and seven others wounded, issued the update during a meeting at Oxford Middle School.

The third-party probe is expected to provide the first comprehensive review of what school officials did in the days leading up to the attack, the day of and immediately after. That includes having the shooter pulled from class into a counseling office, failing to unzip his backpack that contained the gun then returning him to class...

Retired admin here. Returning this situation to class and having reasonable issue to search backpack is evidence of poor poor training or lazy admin. IMO. Not all schools/districts are this poorly responsive. Again, IMO

This could have and should have been prevented. I have no idea how this "shooter" will be brought to justice. Horrible situation,

Sorry you are unable to read. I share many "subscriber only" articles on this site, and most seem to be able to read them. The opinion piece suggests that there are many mitigating circumstances from Ethan's early life and upbringing that might preclude a life sentence without parole.
