Any ideas what this new discovery received in November could be? New discovery to that is creating the need for two separate trials?

...Mariell Lehman, defense attorney for James Crumbley, wrote that she "..received additional discovery, which included summaries and audio recordings of interviews of potential witnesses, on November 3, 2023. Upon review of the recently provided discovery, it is apparent that a conflict exists."

The conflict has to do with two people in Florida, according to the motion filed by Jennifer Crumbley's attorney, Shannon Smith.

According to that motion, about two weeks ago on October 31, investigators interviewed two people who will be listed as witnesses for the prosecution.

"The prosecution provided the police reports and audio recorded copies of the interviews to the defense on November 2, 2023," Smith wrote. "Upon reviewing the new discovery, severance of the defendants in this case is now necessary as the prosecution intends to call one or both of the witnesses... the court must sever the trial of defendants on related offenses on a showing that severance is necessary to avoid prejudice to substantial rights of the defendant.”...

...According to court filings, James and Jennifer Crumbley said they received evidence indicating that there may be a conflict of interest if they were to be tried together.

WWJ's Charlie Langton reports that the evidence wasn’t detailed, but what was available said that law enforcement interviewed two witnesses in Florida on Oct. 31. The transcripts of those interviews were given to the defendants...

Oh boy.

Oxford school shooter Ethan Crumbley told a forensic psychiatrist that he never asked his parents for therapy and admitted that he lied when he texted a friend about asking for such help, according to new court documents filed Monday.
I don't believe one word that comes out of his mouth-- who knows the real truth-

James and Jennifer Crumbley’s attorneys have asked a judge to sanction Oakland County Prosecutor Karen McDonald for violating the court’s gag order that prohibits her from speaking to the media about the case against the parents of the Oxford High School shooter.

Jennifer Crumbley’s attorney Shannon Smith said in a Monday court filing that McDonald violated the court’s gag order in an interview she did with Channel 7 WXYZ that published Nov. 12. The prosecutor was asked about the Crumbleys’ trial and while she initially pointed to the gag order that made her unable to talk, she went on to say “we don’t charge cases that we don’t believe we can prove beyond a reasonable doubt," Smith wrote.

Smith and James Crumbley’s attorney Mariell Lehman said McDonald violated three court orders and ignored her ethical duties as a prosecutor by commenting about the guilt or innocence of a defendant. Both James and Jennifer Crumbley are charged with four counts of involuntary manslaughter in connection with their son's murder of four classmates at Oxford High School on Nov. 30, 2021...

Even if, and it's a BIG IF, he said nothing to his parents about therapy, there are still plenty of examples of an absolute failure on their part to prevent this tragedy. They purchased him a gun, their text message exchanges show that he was ignored and neglected on multiple occasions. They failed to mention that he had access to an unsecured weapon when contacted by the school regarding his drawings and concerning behavior. And, most importantly, they did not take him out of school that day when he was sitting in the office. IMO they blatantly ignored so many red flags that there is a case against them regardless of whether or not he ever specifically asked for help.

Exactly. Not to mention there will be multiple examples of other evidence showing they knew he was struggling and that they were already concerned. Therefore they, as the parents, should have helped him, without him having to specifically ask. JMO.

"...According to Smith's filing, the shooter told the same psychiatrist two different things — that he asked for treatment and that he didn't ask for treatment —..."

Even if he had always claimed he did ask his parents for therapy or always claimed he didn't, the jury would still have to decide what to believe about the claim. He could have his own reasons to make either claim. This is not a key piece of the puzzle, IMO.

He may have contradicted himself trying to protect his parents. Pure speculation on my part, though.

I agree,I don't think this is a key piece. There's lots of other evidence he was troubled and they ignored it.

Isn't this hearsay? What someone might have said to someone at some point in time? He said, she said, they said. I wouldn't put too much stock into the contradicting statements. Ethan may very well have said different things under different circumstances. JMO

Nobody, and we probably never will. at 14, I don't feel the onus was on him to ask for help anyway. He was their minor son, the onus was on them to notice the severity of their son's mental health and wellbeing. Not go buy him a gun. MOO

Mayfield Township, Mich. — For Kylie Ossege, the 19-year-old college student who survived two deadly mass school shootings in Michigan — one as a senior at Oxford High School in 2021 and another 14 months later as a freshman at Michigan State University — Blaze stands as a source of comfort in a world otherwise shattered by bullets.

Ossege runs a brush along Blaze’s broad forehead, then gives him a kiss between the eyes.

“I feel very at home when I’m with him,” Ossege says of the 13-year-old American Quarter Horse she has owned since 2019. “He’s my best friend.”...

The shooter was an Oxford student named Ethan Crumbley, whom Ossege says she didn’t know and whose name she will not utter. Instead, Ossege plans to deliver an in-person victim impact statement during his sentencing hearing on Dec. 8.

“I’m excited to have my words heard and my story heard,” said Ossege, who spent two weeks writing the statement that she estimates will take about 10 minutes to deliver...

Some people are so strong within themselves.
I'm in awe of some of the victim statements seen here on Websleuths (how well-written and brave they can be).

In a three-page ruling Monday, a judge ordered attorney Shannon Smith, who is representing the shooter's mother, to appear at a hearing next spring to explain "why she should not be held in indirect criminal contempt" for disclosing comments that the shooter made to a psychiatrist while in jail.

Specifically, Smith disclosed in a court filing that Ethan Crumbley contradicted himself in meetings with the psychiatrist, saying both that he asked his parents to get him mental health help and that he didn't. Smith maintains the latter comments show Ethan Crumbley is unreliable and are crucial to the parents' defense.

such a terribly sad story. I hope his parents get life sentences.

Jennifer Crumbley's attorney may face sanctions over information about the Oxford High School shooter she included in a public motion, according to a judge's order.

Prosecutors allege attorney Shannon Smith did not fully read documents before filing a motion and for violating Oakland County Circuit Court Judge Cheryl Matthews' protective order of shooter Ethan Crumbley's psychiatric records. They also allege she knowingly filed a motion with the intent to create false headlines that the shooter did not request mental health treatment from his parents.

Smith denies this, saying the motion was filed for the sole purpose of asking for more time to review documents she recently received from prosecutors, according to her response to prosecutors' motion for sanctions...

A group of Oxford High School students walked out of class on Tuesday to demand trauma recovery services and a memorial at the school in the wake of the 2021 school massacre that killed four classmates.

About 35 students participated in the walkout, Oxford Community Schools Superintendent Vickie Markavitch confirmed on Tuesday. Students left around 10:20 a.m. and stayed outside for up to 30 minutes, she said.

"It was orderly and safe, and everyone was appropriate," Markavitch said.

Prior to the walkout, students organized as the group "We Will Be Heard" and issued a document listing their demands, including the addition of "critical incident trauma recovery services."...

Today marks the second anniversary of the shooting at Oxford High School. No school today, and the public is asked to observe a moment of silence at 12:51PM when the massacre took place.
