I follow you cubby, it just frustrates me that the inability to deal with the reality of this situation prevents her from being Bianca's fierce advocate in the pursuit of justice for her child.

It's not my wish to be mean or hurtful towards a woman who has already gone through so much.

Just venting my frustrations I guess.

Therein lies my dilemma, too!

She should be an advocate for her baby,
but then she would have to admit to herself her part in the situation.

And she is in such an incredibly sad situation!

But... if she does not come to accept her D'Andre as the monster he truly is... will she, AGAIN, fall for another man of equal bad intentions, thus putting her children AGAIN in harm's way?

Will the cycle continue? :waitasec::please:

I didn't think you were knocking her. I just used that expression for a lack of better words. Maybe it's the decades/generations of family being Cubs fans that gives me patience, lol. Lord knows after 100 years we have to have some patience, so sending some Cub fan patience dust to everyone as we follow this case. :) Justice will come for Bianca, it just takes time.

I knew there would be more to his story about what happened that night! I think we all discussed that in earlier threads :( It just brings me pain to hear that this poor child most likely suffered through all this abuse that night! Sorry but there is no way I buy the falling out of the bed BS :mad:

Every time DL opens his dern mouth this gets worse! :doh:

What I've been thinking lately though is... why bring this info up now? Unless maybe he is concerned they are going to find her??? It is the beginning of warm weather and people will be hitting the water soon and be out and about more even on land surrounding the river.

Finding Bianca would bring some truth and closure to Banika and her family..... I hope they get that :please:

This was information from the police interview/interrogation right after the alleged car-jacking. But I think you're right, he was afraid she would be found and be in horrible condition because she'd been beaten to death so he offered up all these excuses as to why. The worst was that he hit her with the paddle to keep her awake at 3:00 AM because she was falling in and out of consciousness due to a terrible fall out of the crib after being spanked repeatedly earlier that evening for soiling herself. May justice begin to come in the form of murder charges for DL on Thursday.

RIP Bianca.

Does anyone know what the MI statute is for homicide/manslaughter that happened during the commision of child abuse?

That might be how LE is going to get him. TIA!

I found this from the Michigan Penal Code:


First degree Murder:

(b) Murder committed in the perpetration of, or attempt to perpetrate, arson, criminal sexual conduct in the
first, second, or third degree, child abuse in the first degree, a major controlled substance offense, robbery,
carjacking, breaking and entering of a dwelling, home invasion in the first or second degree, larceny of any
kind, extortion, kidnapping, vulnerable adult abuse in the first and second degree under section 145n, torture
under section 85, or aggravated stalking under section 411i.
(c) A murder of a peace officer or a corrections officer committed while the peace officer or corrections

ETA: In Michigan, first dgree murder has a mandatory life sentence.

We first from D'Andre that Bianca might have bruises on her legs when she was found. Now we hear that she would also show signs of a head injury from falling out of head. In her father's care, Bianca didn't have a chance for survival :furious: This little girl is in a much better place now as she dances and sings with the angels.

All this from the man for whom it was a toss-up between a social worker and a teacher.

Also, a few snippets about first degree child abuse:

(2) A person is guilty of child abuse in the first degree if the person knowingly or intentionally causes serious physical or serious mental harm to a child.

(f) "Serious physical harm" means any physical injury to a child that seriously impairs the child's health or physical well-being, including, but not limited to, brain damage, a skull or bone fracture, subdural hemorrhage or hematoma, dislocation, sprain, internal injury, poisoning, burn or scald, or severe cut.

been out of touch for days. Apologies as I am sure ya'll discussed recent testimony and the statements given to LE by D'Andre days ago but this was all news to me and I am livid.

So first little Bianca was fine, but maybe had a bit of the sniffles, and was sleepy the morning of her "abduction"

Then, well, she may have had a bit of diarrhea from a bug that night before.

BTW she may have bruising on her buttocks and legs from "discipline" over a bedtime potty accident the night before.

Oh, well, actually, she fell out of bed at one point and, stellar parent that I am, I thought it best to keep her awake (concussion concerns you know) by whacking her bottom repeatedly throughout the night with my "discipline" stick to keep her awake.

SERIOUSLY???!!!

what a piece of work this parent is.

Poor poor baby. you just know this poor child was ill, had diarrhea and was beaten to death for it.

I am livid. I hope Bianca's mother is letting some of this unpleasant reality sink in at this point. I know it is awful to contemplate that the person you trusted with your child has murdered her, but I am hopeful that as this trial progresses, Banika will find the strength needed to confront this reality.

Lane's roommate, Lisa Dungey, testified she returned home early Dec. 2 after spending the night away and saw Bianca and another one of Lane's daughters sleeping in bed.

Your right they've know this all along. Just new info to us about this "head injury" Grrrrrrr guess I was just so disturbed reading it I wasnt thinking straight ......it just makes me so sad :(

Thanks for looking this up, Melissasmom. I'm playing catch up tired here, but wanted to remind everyone the charges against D'Andre also include 'habitual offender' status. I vaguelly recall that habitual offender status has something to do with increasing sentencing.

Maybe someone can refresh my memory or I will look/search for it tomorrow. (Will be too hard tonight with the WS search engine disabled).

Yes, habitual offender status means that judges can give longer sentences. The sentencing guidelines and how they figure out all the details are really confusing. Unfortunately I know this from too much personal experience with the MI court system (no, I have never been in prison ;) )
But hopefully it won't matter anyways, he will be convicted of 1st degree murder, automatic life no parole.

Lane told police that after he disciplined Bianca she fell off of her bed and hit her head on the floor. He said he tried keeping the toddler awake by popping her with the stick when she would nod off. Lane said he eventually put Bianca to bed around 3:30 that morning. Hours later, Lane says his daughter was "still kind of out of it".

I take it that "still kind of out of it" is euphemistic slang for "dead".

Is he mentally "quite there"? This is the stupidest lie I've heard for a while. Your child has a cold, diarrhea, a head injury, sleeps for a few hours and in the morning she is "still kind of out of it", and you did not take her to the ER like any normal parent would have done but took her with you and went driving across the town...

So, what happens to the nephew's testimony? Didn't he say that Bianca was fine, normal? DL says she was out of it. Who to believe...Hmm.

I've not followed any one case in particular after a 3-year stint on "another" case. I have been keeping up as best I can with this one and thank you all for posting tons of inormation.

By now, IMHO, there is more than adequate information to send D'Andre to trial. I hope Banika will come around to understand that she did nothing wrong by sending Bianca to visit her father. She couldn't know what he would do to the little girl. I pray she can deal with the loss of her daughter before the trial begins so she can be a stellar witness as she puts together the bits and pieces in her own head. I know they are there, but she doesn't want her daughter to be dead.

:eek: Sorry about the lack of careful editing in my recent post. Someone rang the doorbell, so I sent the post without proofing :blushing:

I was out running errands earlier today and heard a "preview" regarding D'Andre's court appearance this hour (1:00 EDT). During the report, a clerk read from a transcript of an interview that DL gave to police when he first reported the car-jacking/kidnapping incident. He told the officer about Bianca having fallen out of bed in the wee hours and hitting her head. Seems he tried to keep her awake out of the fear that she would lose consciousness. The audio report isn't posted on the WWJ Radio (CBS) site yet but it might be available later in the day.

If the circumstances are true, and Bianca really fell out of bed and sustained a head injury, she should have been taken to the nearest ER immediately! I think daddy dearest caused the head injury, among other bumps and bruises, and that he feared getting caught more than getting help for his injured child. Shame on this sorry excuse for a parent :furious:

I think those carjackers must have dropped the car like a hot coal when they found out that in addition to a vehicle they got a deceased, abused toddler.
