I'm intrigued by the defense asking about the cough DW allegedly had, I am sure that will some how feature in there closings, plus they may through Dee brother under the bus

Same, I feel like I missed something from earlier on. Does anyone know what the questions about the cough are about?

They are definitely trying to cast doubt on DW by going after GH. It's sad. MOO

I missed the live stream Monday and Tuesday and I just finished up with yesterday's. I spent far too long searching Youtube for closing arguments before realizing today is not Thursday 😅

I blame the court for their slow pace. When I got the news notification that the defense rested before 11 a.m. yesterday, I was ready for closing arguments. Nope, court dismissed by noon. 😑

I was surprised by how short the defense's case was, particularly given how long-winded the attorney was. It's a thin case but I figured they'd drag it out a bit. MOO

ETA: "thin case" as in weak defense... IMO

The defense requests voluntary manslaughter be added to the jury instructions, arguing that Dee's intention to tell Dale she wanted a divorce "could be provocation for a heat of passion moment."

Judge Michael Olsaver said there is no or little evidence of what Dee did or said on April 24, 2021, but that there is evidence that she intended to tell Dale she wanted a divorce and wanted to sell the trucking business.

Olsaver Dale acknowledged that an argument happened based on his statements. Olsaver said Dale told Det. Kevin Greca that it wasn't the worst argument they've ever had but told Gregg Hardy that it was a hell of a fight.
Olsaver denied the motion, stating that it doesn't rise to provocation for voluntary manslaughter.

Isn't it a little late to ask for that? The morning of closing arguments?

If DakeW wanted to plead guilty to a lesser charge, he had plenty of time to offer that.

Asking for a divorce does not grant a license to kill.

And help me here too, as I am sometimes sort of thick….. did I just read that defense said something about the decedent’s ‘intention’ to tell the accused of a desired divorce?

Intention? Intentions are not actions. And seems the judge cited there was no evidence of such. SMH. MOO

when defense was asking for voluntary manslaughter they were admitting there argument would be that it was a crime of passion, or provocation, so they were admitting he did it, this was outside presence of jury so we won't know whether this is what they will argue before the jury

I think, without that charge, they are rewriting their closing right this second.

They will probably highlight how many times she took off for a day or two. Because they've got less than nothing to work with.

DaleW would have been wise to beg early for a plea agreement. Life with parole maybe. Or just plead guilty as charged.

What a waste of everyone's time.

Agreed. I do enjoy her play-by-play as the video is shown. "Where's he going? There he is".

Doesn't need to be flashy, though. It seemed pretty clear he was the guy before they even found her body.

he denied the motion to include voluntary manslaughter as a charge, they can argue any defense they wish to

Whoa. I missed this during the trial... State played the portion of DaleW's interview where he described rubbing Dee's shoulders, played without sound.

His hands are in front of him, forming a circle.

As one would do when choking a person.

Powerful.

Chilling.

NOTHING the Defense cam say can erase that image.
