he denied the motion to include voluntary manslaughter as a charge, they can argue any defense they wish to

True but to argue it was a crime of passion admits he did it.... hands a guilty verdict to the jury.

But then DakeW did that all by himself.

I agree, I have no idea what they will argue, I am wondering why they asked his ex wife about the cough, I expect Dee brother maybe in the mix somewhere, the investigation was poor, (which initially it was as they had all the evidence on camera from Day 1, but it took new detectives to see the glaring mistakes and investigate it properly), not long to wait to see how they try to overcome the mountain of video of Dale disposing of her body, the only bit of camera footage they don't have is the actual murder, they have everything else on camera, very good pictures, can't say it wasn't me when we can all see what he is doing

does anybody know if the estate of Dee and Dale has been settled, they each had a few children, plus there minor child, I was wondering if the farm and businesses had been sold, his defense will be costing him a fair bit

OMG Defense is leading with a tragedy occurred, a killing occurred "unfortunately"...

I'm gobsmacked.

I think she is doing the best job with what she has, I wonder if she will just continue to there is reasonable doubt, or whether she will say who she thinks did it

  • #393
Fallacy that jury is to look item by item for reasonable doubt.

Nope. Judge will instruct them. Totality of the evidence.

1000 explainaways don't equal reasonable doubt.

Does the State get an opportunity at rebuttal?

  • #395
Dramatic misrepresentation of premeditation from the Defense.

He can premeditate murder in moments while having zero pre-idea for how to dispose of her body.

I don't understand why the prosecutor who did opening did not at least do rebuttal,

I had to tune out because I was getting a bit snoozy from watching him walk around his property again. Is the defense still trying? Or have they finished closing?

  • #398
State is up on rebuttal.

"He hid what he was welding."

This won't take the jury long IMO.

Prosecutor's rebuttal: Only painted the repair weld. Dale on jail call recognized as the tank that was repainted. Why only paint the new weld and not the whole tank?

Are they deliberating now? A see people, but no audio.
