Prosecutor Jerry Blackwell says the CO issue is the only follow-up line of questioning the state has for Dr. Tobin this morning. Judge Cahill has called for a short break for the defense to process the developments. We await Eric Nelson's next move.

It seems to me the carbon monoxide point is a nothing burger. I wasn't compelled by that being brought up by the defense. The state could have ignored it with no loss in their case strength. This is just making the point way bigger than it is.

It is the NEW blood gas testing that was released last night that Tobin can NOT testify to according to the Judge. Tobin nearly tripped up just now in his testimony. Judge stated he will declare a mistrial if new lab testing is brought up by prosecution.
He talked about the blood gas when he first testified. I think the judge just wanted to make sure he didn't mention the name of the specific test that Dr. Baker apparently forgot to mention in his report.

Yep, I agree.

I still can't find the tweet about the jurors yesterday. Pretty sure I read that they were attentive to Fowler and taking notes.

Could it be that the State is nervous?

I do think that Blackwell's demeanor changed yesterday after the Judge spanked him... I wonder if Blackwell made that change because he was reading the jury?

I think it was important since yesterday the witness confused the jury by going into so much detail as to what may have caused the carbon monoxide level to be higher than normal. Dr.Tobin proved that his claim was completely unfounded, therefore it could not have been a contributing factor.

Just decided to rewind and re-watch Dr Tobin's testimony because there was too much pressure the first time.

Think he did a brilliant job in rebutting Fowler's testimony about CO poisoning and very cleverly did it without going near what shall not be named.

I will need to rewind as I missed the breathtaking moment itself. But I suspect Blackwell showed the slide that IS an already allowed exhibit for the defense but had to question carefully so that Tobin didn't refer to the portion that showed the testing was actually done as part of the autopsy specifically.

This info was out there for both sides. It is not new. The problem began when Fowler began to opine on carbon monoxide when the state was not informed he would be doing so and therefore they were not prepared to challenge that testimony. That in turn caused Baker to say hey, wait, look at this, on the defense exhibit, this says that testing was done, did you guys (state) introduce it? (aha moment) so the state tried to get it in and was denied)

Neither one. I think it was the mention of the "blood gas" by Dr. Tobin, that the defense objected to. Imo

Wait. Help. Did Dr Baker really forget to mention blood gas test results in his report? But my understanding is that somehow the State had that info separately since February, correct? They just assumed the defense wouldn’t present it as part of their case.

Am I understanding the issue correctly?

this delay adds to the drama of the cross....Nelson is getting coached now on the phone by experts that know about this...maybe Fowler or one of the "board"....pressure is really on.
