really counting on Tobin to mind his answers carefully and not stick foot in mouth and cause mistrial. I do believe this is a case the state is winning, it would be a shame for it to end in mistrial.
I completely agree. Legal rules drive me crazy at times. It almost makes me wish that jurors would watch the news to get a broader picture of what’s happening. (Not that the news isn’t full of disinformation...)
At any rate, DC held him down next to the tailpipe, so even if a juror gives CO undue weight regarding death, DC is still the one who forced GF’s face toward it.
Maybe if the judge would of given the state more time to prep this witness, that wouldn’t of happened!
Problem is, this judge is biased. IMOIn fairness... they had all night to prep this witness. Nelson said he just got the rebuttal or the "new" results at 7:45... he also couldn't get in touch with Fowler after that because he was on a flight. So who should get more time?![]()
Yes, I think his testimony was fine even without the "new" evidence. He clarified that the oxygen level was 98% so the highest amount of carbon monoxide that could have been in his blood was 2%, which is normal.The O2 saturation levels have already been previously introduced, so I don't think Tobin has violated the ruling at all.
It is the new blood gas evidence Tobin called prosecution about last night that can NOT be testified to according to the Judge. Tobin nearly tripped up just now in his testimony. Judge stated he will declare a mistrial if new evidence is brought up by Tobin, imoThe O2 saturation levels have already been previously introduced, so I don't think Tobin has violated the ruling at all.
