I will agree as to all four of your points that they did occur, imo:
1. GF did have poor health re: just getting over covid.
2. No doubt he made bad decisions ($20)
3. He did use drugs.
4. There was non compliance during his arrest initially, until they got him on the ground, imo.
Here’s where we get into the meat of it.
What about the 5th variable, DC’s knee on his neck.
Do you believe this played a role? As a “5th Element”, so to speak?
Was this is a contributing factor? Do you think his knee on his neck for 9:00+ cut off the oxygen/blood?
Which again, brings it full circle:
He had poor health wrt post covid imo, made bad decisions, had drugs in system, and resisted arrested, but would he be alive today without DC’s knee on his neck? This for me is the bottom line, jmo. It comes down to the knee being a “substantial causal factor”, which I think is all that the prosecution needs to prove.
I agree with you, as evident by your opinion, and the opinions of some others who have posted here reflect, that it is possible the jury may have some doubt.
So, who knows what’s going to happen.
But my opinion is, people were yelling to get off his neck, he knew, he could “felt” GF’s responsiveness (or lack thereof), DC should have known and would have known imo that this was a life threatening means of restraint, and should have gotten off his neck, that this was beyond a dangerous move. (Short answer)
