If this goes another 26 minutes, this is agony

Getting back to “intent” here is Nelson’s argument...it can’t be an intentional use of force because Chauvin knew he was being videotaped. Huh?

https://www.washingtonpost.com/nation/2021/04/19/derek-chauvin-trial/
Nelson asked the jury to consider the question of “intent” — and whether they could say, beyond a reasonable doubt, that Chauvin intended to do what he did.

“The defendant must have knowledge of those facts that are necessary to make his conduct criminal,” Nelson said.

“Did Officer Chauvin intentionally apply unlawful force? That’s what you’re being asked to decide. Did he purposefully, purposefully apply unlawful force to another person?”

“Did he intentionally perform an act that was eminently dangerous?” he continued.

Nelson said that Chauvin is unlikely to have done these things intentionally because he was being videotaped.

“Officers know that they are being videotaped. Do you do something purposefully that you know is an unlawful use of force when you have four body-worn cameras immediately in the area? Where you have multiple civilians videotaping you?
Where you know your actions are being reviewed through a city-owned camera? Where there are surveillance cameras?” he said.

I hope Blackwell keeps it short and sweet.
I would be an awesome show of confidence, imo, if he did keep the rebuttal short.

I'm glad that Nelson is covering all of the pertinent points of this case for the jury. JMO
More like throwing crap on the wall hoping something sticks IMO.

The intent is in regards to use of force. The easiest way to understand it is - Did DC intentionally use unlawful force that caused the death of GF. IF yes, then that is 2nd degree murder.
If you believe the force was accidental, even if unlawful then 2nd degree murder charge is off the table.
Clearly the force is completely INTENTIONAL but I think Chauvin in his depraved state thinks to this day it was reasonable.

I am trying to give the defense closing the same attention I gave the state's but I have to admit, I am sort of zoning out in this moment. Looking forward to Blackwell's rebuttal.

Wait, is Nelson suggesting the banana killed GF? I just got lost completely what the heck??

I guess I'm different than most. Long closings by either side does not bother me at all. EN only gets one turn...not two. It's his duty to present as much as he can to the jurors.

I've found both closings very interesting. I've listen closely to all that's been said by either side.

I've seen longer closings than these.

I realize a lot is at stake.

Did he really just bring up Hall and throwing pills out?

I think he is doing a very good job. The State left a lot of things open for Nelson to bring up that can lead to reasonable doubt by the jury. JMO

But it was still a very small amount of meth..

maybe sleepy juror fell asleep!

Now he’s just being snarky.. that just turned me off to the defense case. Smirking when saying would you give it to your children or elderly parent

  • #435
Thirty minutes for lunch...interrupting Nelson. That loses whatever momentum Nelson had.

You're right. Since the defense only has this one shot at explaining their points Nelson has to cover everything right now. And that takes considerable time. JMO

Judge just said half hour break for lunch...interrupting Nelson’s closing!

  • #438
Thank goodness the judge interrupted for lunch!

  • #439
Guess the judge was getting bored too.. lol

We will never again have to listen to Nelson.
Getting a coffee to celebrate that one fact.
Banana, though.
