GUILTY NC - Eve Carson, 22, UNC student, shot to death, Chapel Hill, 5 March 2008 - #2

I havent followed that case at all but there could be some consideration being given to not trying that case at all. Would probably be up to the victim's family.

I can't tell you how happy I am that this jury so quickly arrived at its verdict. This crime has bothered me simply due to its senselessness. The two were/are true evil that enjoyed killing. Robbery was their occupation; murder was their hobby.

Wow, PrairieWind -- so eloquent -- You're absolutely right. I never thought about it that way -- probably because most people can't think in those terms, but you really nailed it, IMO. Perfect.

They wanted money (several folks said they never saw Lovette with any money), so they did what they had to do -- and got lucky when they randomly picked a student that just happened to have a $9,000 balance in her checking account. What a jackpot! "We're gonna be rich!" They would just have to be patient and keep hacking away at the $700 daily limit, but they could each live on $350 a day. Big Men -- clothes, good food, women, shoes, bling, some stud guns like the stylin' guys have, maybe a couple of nice leather jackets. They hit the Big Time...... "Yeah, we got a rich sorority girl's money now...."

I think it was Lovette who had the yen for the killing part. At least, however false it may have been, Atwater did apologize to the family at his sentencing. Lovette didn't move when his verdict was read. It wouldn't surprise me if he continues to be very aggressive when he gets settled in prison. He is stupid, still young, and, as you said, likes it.

Well, our boy is now documented (incomplete as it usually is, initially) and "in the house" at Polk Correctional. It normally takes about 2 weeks for the full info to be completed (specific crimes/sentences, etc), but he is in "close custody" and he's "one of them" now. And I'll bet he's getting some looks and maybe more.

I remember reading an interview with a pastor who visited/worked with inmates in NC prisons, and he was asked which institution was the "scariest," and he said Polk. Did not elaborate. :waitasec: It is full of young men who, IMO, are full of testosterone, cockiness, and many of them have lots of muscle and a wish to be tuff -- bad combination for a bunch of confined males.

Here is a link to what is on file at this time:

I hope there are inmates at Polk who are die hard Carolina fans who knows what he did to Eve!

Thank you for the info, borndem!

Hi, Matilda - Although there most likely are some die-hard UNC fans at Polk, I think that trait may not even be necessary. I hope what he did to her is on the criminal "dishonorable" list -- as it should be. Taking a female who was no match for two young tuff guys who scared her out of her wits and shot her down, defenseless, in the street... how does that sound for tuff-guys? They may as well have had a 6-year old out there. No pride or bragging material there, IMO. "Yeah, newbie, just how tuff are ya, huh?" I would like to see something like that -- there must be some kind of initiation that goes on there -- again, we are talking about guys who are at the peak of their strength, cockiness as well as stooopidness. I hope they send him to bed with something to cry about. :furious: .. :maddening:

Well, as PrarieWind so eloquently stated, "Robbery is their occupation." I can only hope that some inmate 'Occupied' Lovette during his first night in prison....if you know what I mean.:D

The type of criminal Lovette is goes from crime to crime to crime as a part of his daily routine. Such mundane activities as going to a fast food restauarant or convenience store are opportunities for another crime.

I remember well when this crime was unfolding and how horrifying it was, and is...peace to her loved ones. And lots of rotting in prison to the killer.

You're so right David In TN --

This guy was young, but his passion was terrorizing, robbing & killing the witness(es). As, as you say, he would be thinking while in line at a McDonald's or in a 7-11 that this is a place to rob, and he sees the restroom as a place in which to terrorize and kill a hostage.

Some entrepreneurs look at an undeveloped area & see a future shopping center with 4,000 sq-ft condos; some see a community garden; some see a playground for blind or handicapped children; some see a scene on canvas -- in other words, "What can I do to improve this area for others?"

Lovette sees a killing field on an asphalt street. He likes to scare innocent, unprotected people to death.

I'm just glad he's behind bars for the rest of his life, and I hope Eve is his last victim. But his thinking has not changed -- only his address has.

Thanks to you all for following this trial along with me. It was such a comfort to have other sleuths to lean on while we learned the horrific details of the unnecessary and cold blooded murder of Eve Carson.

Eve was truly a lovely young woman. So...I dedicate this post to celebrating the life of Eve Carson.

May You Fly With the Angels, Lovely Eve! You will never be forgotten on this side.....

Somehow, her family has gotten through another Christmas -- for those of us who celebrate Christmas, it, IMO, is THE time to be with family and friends, to worship as a family (and I'm sure Eve and her family did), and to celebrate the meaning of Christmas in one's own way.

I hope the Carsons were again able to do as she would have wanted, and to truly celebrate the season and the Big Miracle as well as the miracle so many experienced -- the one of knowing and loving Eve and the legacy she left for all of us.

And those rotters in the Big House killed her body, yes -- and they are paying for it in mere crumbs, but her spirit is all around us.

Bravo, waltzingmatilda, Bravo!

I have enjoyed you and your insight, sweetness, and outrage on this trip very much -- we all would have been much, much less without you.

Thanks for riding on the bus with us -- it was a costly trip, but we arrived at the place we wanted to go.

Yes, let us celebrate what Eve Carson started and what she lived, loved and believed!

Well, well, ladies & gentlemen of the jury, our man (using that word loosely) Laurence Lovette is facing another murder trial; this time it's in Durham County.

He is charged with 1st Degree Murder and robbery with a dangerous weapon. He is alleged to have robbed & killed Duke grad student Abhijit Mahato on January 18, 2008, just 7 weeks or so before Lovette kidnapped, robbed, and killed Eve Carson. Mahato was an engineering grad student from India who was found shot dead in his apartment on January 18.

This article is dated, but it is still good info.
http://www.wral.com/news/local/story/4314757/

At the present time, Lovette is scheduled to appear in Superior Court on 09/04/12, in the Durham County Courthouse, Room 001S, for the above charges of 1st Murder and Robbery with a Dangerous Weapon.

His suspected co-conspirator/murder & robbery partner has been scheduled for court on the same date & has a slew of charges, including 1st Murder and robbery w/dangerous weapon: Stephen Lavance Oates. Oates is already on the books for several convictions for common law robberies. Another prize.

Why doesn't Lovette just take his medicine & take a plea? Or does he look forward to being out of his regular jail cell and coming to court every day for a while, only to hear similar testimony and, I hope, a similar verdict.

Since the above murder/robbery of Mahato was such a "success" for him -- hey, somebody withdrew a whopping $500.00 from Mahato's savings account -- I guess that prompted Lovette to look for a "rich sorority girl" at UNC and to rob & kill her, too. What a lark -- I'm so cool.

Since both Oates & Lovette are scheduled for the same court date, I would think that there is some type of scheduling going on for these two.... not a trial. Maybe a plea??? Fat chance, methinks.... We'll see....

The bad guyz just don't stop coming, do they?

Let's hope this is the last chapter of this horror story, folks:

State says Lovette murder appeal has no merit

Raleigh, N.C. — Attorneys for the state of North Carolina say convicted murderer Laurence Lovette's appeal has no merit, according to a brief filed Wednesday with the state Court of Appeals.

Yes, well . . .

The North Carolina Court of Appeals ruled Tuesday that Laurence Lovette Jr., one of two men convicted in the death of former University of North Carolina at Chapel Hill student body president Eve Carson, must be resentenced because of a U.S. Supreme Court ruling regarding automatic life sentences of offenders under age 18 at the time of a crime.

blah, blah, blah . . :furious: :furious:

http://www.wral.com/eve-carson-s-killer-to-be-resentenced/12066177/

It's enough to make you cry. This guy is dangerous. His body is young, his heart is very, very old, and evil. He isn't going to improve with time.

Let's don't even talk about disrespect of the victim and the pain to her family. I mourn the loss of what she would have accomplished for humankind had she been allowed to live.

im:furious:.

Thinking about this ... He cannot be sentenced automatically to life w/o parole.

Can a judge CHOOSE to sentence him to life w/o parole?

I wish.

  • #297
Its a fair question. Technically the application of AUTOMATIC Life without parol (LWP) is prohibited. You would think that would mean that discretionary application of LWP is still admissable. However, there has been a full fledged assault on "discretionary application" of sentencing. I can only assume as an attorney, that every LWP sentence is in doubt at this point. I find this ironic as one argument against capital punishement has been that there was alway LWP that insured the defendant would never get out.

from link: Today’s decision does not end life terms for young murderers, but it says judges or juries must consider the defendant’s youth before imposing a life term with no parole.

http://articles.latimes.com/2012/ju...ife-without-parole-cruel-and-unusual-20120625

(I've also read Justice Kagan's majority opinion, where she states that
"the Court's ruling does not categorically ban juvenile life without parole in all circumstances" and "a judge or jury must have the opportunity to consider mitigating circumstances before imposing the harshest possible penalty for juveniles." She also thinks "appropriate occasions for sentencing juveniles to this harshest possible penalty will be uncommon.")

I've been told by people who know more about the criminal justice system than I that there is really no such thing as "life without parole." In other words, as long as an inmate is alive and breathing, he can walk out of prison.

A bitter lame-duck governor, who wants to stick it to those who voted against him, can always commute a sentence.

Well, Joe, taking the "opportunity to consider mitigating circumstances" part should be brief, considering they left her on a residential city street to take her last breath on earth, hurting and alone, and considering she was under extreme torture while they forced her to leave her house under gunpoint and forced her to be in the backseat of her own car with one of them back there with her to touch her anywhere they wanted, & to subject her to the abject fear that they would prolly kill her when they felt like it. That's a very cruel and heinous way to treat an innocent young woman.

And here is a new development about an old, pre-Carson murder/robbery:

I just saw on the Durham County court info site a date for Laurence Lovette, Eve Carson's convicted kidnapper & robber & slayer, where he has got a court date of 5/20/13, apparently for the murder and robbery of Abhijit Mahato. Status hearing or the real thing? Who knoze?

http://www1.aoc.state.nc.us/www/cale...t=Submit+Query This is a Durham County court date for Lovette in the Abhijit Mahato robbery/murder. Is it simply a status hearing or is it an actual trial date?
