Since the beginning of this case I've held a very unpopular thought that there is not enough evidence to prove that Kimrey gave the fatal dose of chloroform to Mariah. I really wish that there had not been a 'gag order' on this case. Of course we do not know what evidence the State has on Kimrey with the exception of a neighbor witnessing him loading something into his vehicle early in the middle of the night. Hopefully the State has much more than that. With the little bit of information that has been gleaned, it looks like a "she said/he said" case.
I feel certain that he was the one who disposed of Mariah. I'm wondering though, who told LE exactly where she could be found? The area she was disposed on is twenty-five miles away in a swamp area called Holly Shelter. Someone had to have informed LE the exact spot to find her. I think that person had to be present in order to know the exact location. I do not think that Kimrey told LE. This is just my opinion. I do believe that both adults in that small mobile home should have been charged.

Have no clue what the appearance will entail, but hopefully, the gag order will be lifted and we will know Monday.

Do you live near the court @lonetraveler ? Will you be going on Monday, or to the trial when it starts?

I don't get the feeling this will be livestreamed, hope I'm wrong though.

Sixty miles away. Unfortunately I can't make Monday, too short of a notice. But, if there will be a trial I'm planning on attending some of it.

Thanks! This is soooo long overdue.

I agree with your thoughts on the crime.

Monday, December 12th:

The cause of death was chloroform toxicity. Details of death sealed, search warrants & 911 call were unsealed 2/24/18.
Trial was set to begin on 3/21/22 continued to 11/8/22 was vacated. (expected to last 2 months).

Court info from 7/18/18 thru 3/4/21 reference post #813 here:
https://www.websleuths.com/forums/t...w-county-27-nov-2017-10-arrest.360534/page-41

3/21/22 Monday, Trial Day 1: Trial was cancelled. New trial date is 11/8/22.
7/5/22 Update: As Onslow County continues into its post-pandemic phase, District Attorney Ernie Lee is still trying to put a dent into the backlog of pending murder cases that COVID-19 restrictions halted in the past two years. Lee said over the next couple of weeks his office plans to schedule even more trial dates. However, scheduling can often be difficult & has a lot of moving parts as he has to speak with prosecutors & defense attorneys. Kimrey's trial has been moved multiple times, but Lee said the office plans to start his trial in the fall. However, he added that Kimrey's trial will be based on how things go with another murder case. Kimrey's trial is a capital case & the DA's office is seeking the death penalty.
12/9/22 Update: Kimrey will be in court on Monday, 12/12/22.

I too am wondering the same. I did not have a time when this was supposed to start - but isn't it like 1:30pm there now?

I looked through the two articles posted here and no time was listed. And yes, it's currently just after 1:30pm there. I'll keep looking for updates in MSM

ETA: this was the most recent article I could find so far, posted at 915am EST and says due in court "this afternoon" but no exact time given either.
Man accused of killing Mariah Woods in court this afternoon

ETA again:
2pm is a time I saw floating around but still trying to see if I can confirm this somewhere reliable/WS approved/or MSM

One more article -- please forgive if it is a repeat:

Mother's boyfriend, who reported 3-year-old missing, pleads guilty to her murder

A man who reported the disappearance of his then-girlfriend's 3-year-old child, sparking a search across multiple counties in eastern North Carolina, pleaded guilty on Monday to the child's murder.

RALEIGH, N.C. — A man who reported the disappearance of his then-girlfriend's 3-year-old child, sparking a search across multiple counties in eastern North Carolina, pleaded guilty on Monday to the child's murder.
Adolphus Earl Kimrey II pleaded guilty to first-degree murder and felony child abuse inflicting serious bodily injury in the November 2017 death of Mariah Woods.
[...]
The maximum sentence Kimrey could receive was the death penalty, but with the plea, he agrees to spend the rest of his life in prison without the possibility of parole.
[...]
There were no obvious injuries on Mariah, aside from a bruise near her left eye and some scrapes on her face, according to the autopsy report. There was no evidence she had been sexually assaulted.
The child died of chloroform poisoning, the autopsy showed.
Chloroform can be used as an anesthetic in small doses, but it can be toxic in large amounts. Among its other uses, the volatile chemical is used in the production of Teflon and in refrigerants for air conditioners.

Okay - so I read all these articles posted & could find a sentencing date or was he sentenced on Monday?
I see one of the articles saying "he could receive".... so it sounds to me like he will have a sentencing date coming up, NO??

  • #937
I thought he was sentenced Monday via the plea deal, life without Parole. I read the transcript provided with the video on the one article (the transcript was horrible by the way so many words/phrases etc that were wrong) and one of the lawyers was explaining that although the family will never get Mariah back, they will never have to come to court ever again. So I assume there is no future court date for sentencing. But I don't often follow cases to trial so I'm not very knowledgeable about court proceedings/plea deals etc.

I did find this other article:

Dec. 12, 2022
ONSLOW COUNTY, N.C. (WITN) - A man who made national headlines after being charged with murdering an Onslow County toddler was sentenced to life in prison without parole.
[.....]
Kimrey this afternoon pleaded guilty to first degree murder and felony child abuse as part of a plea deal. As part of that plea, the state agreed to take the death penalty off the table.

I'm really eating crow on my theory. He is the one who told exactly where Mariah's body was disposed of. DA has known all along.

This article has an account of what happened during the early days. He failed a polygraph. The mother passed her polygraph.

Much more information. Keep reading.
