NY - $250m fraud against Former President Donald Trump, Trump Org., Eric, Donald Jr., Sept 2022, Trial 2 Oct 2023, #2

Kise and Alina Habba defend Trump's answers, calling it responsive to the questions. Habba says Engoron's here to "hear what he has to say." Engoron snaps: "I'm not here to hear what he has to say. He's here to answer questions." He orders Kise and Habba to sit down.

I swear, I think they're trying to get contempt charges so that they can spend a night in jail. He will milk that for everything it's worth, and will call himself a martyr.
And the donations will increase substantially.

The judge is again asking Trump's lawyers to have him answer questions directly while on the stand.

"That was a simple yes no answer," the judge said. "I beseech you to control him."

The judge went back and forth with Kise, with the judge saying, "I don't want to hear everything he has to say."

Alina told the judge that Wallace needs to ask better questions, saying, "More succinct questions will give more succinct answers."

The judge then raised his voice, to which Trump said, "This is a very unfair trial. I hope the public is watching."

The judge's warnings are critical, as the case here is only meant to determine monetary damages. If Engoron determines that all of Trump's testimony is not credible, as he did the last time Trump took the stand, he may impose significant financial damages on Trump and his company.

Trump, explaining the value of Niketown: If they want to expand anywhere, you have to go through my building.Judge: Excuse me.Trump: Hold on. (continues with his speech)

*** Telling the judge, who holds your financial fate in his hands, to hold on, is probably not a good idea. Wow.
Edited by me, because words are hard this morning.

Engoron asks Trump lawyers to control him

Annemarie Bonner
Judge Engoron asked Trump's attorneys if they could control him in the courtroom. He said, "This is not a political rally … maybe you need to have a talk with him right now."

How many times is he gonna ask his lawyers to control him?

Trump walked back into the court room at about 11:14 am ET.

He turned to reporters in the hallway and gave a silent thumbs up before following his lawyers through the court room doors.

The judge also entered the courtroom and everyone stood.

When he resumed testimony, Trump began answering questions more succinctly.

Donald Trump has never taken orders from anyone since the death of his father, Fred.

IMO he cannot and will not accept that in the courtroom, the judge outranks him.

DJT has been the big boss wherever he’s been…the Trump Organization, The Apprentice, Mar-a-Lago, Trump Tower, his casinos, and of course as President of the United States.

I’m certain he views the judge and prosecutors as mere peons, and has dreamt up a zillion ways to punish them if he ever becomes President again. I think he’s constantly fantasizing about that while he is in court.

"Kise eventually tells him: "You're in control of the courtroom, not me."

Whoa! Don't know why I am surprised at the disrespect from the defense team in the courtroom, but I am. Unprofessional behavior makes me mad, sad, and disappointed.

Per Twitter/X - Inner City Press account:

NY AG lawyer: Would you get copies of the statements in 2021?Trump: I was so busy in the White House. China, Russia, keeping our country -NY AG lawyer: You weren't president in 2021. Look to bottom of the page, Trump Tower triplex. You were involved?Trump: No

Shortly after Trump resumed testimony, Engoron cut off the former president after Trump started to go on after answering a question about the value of an Avenue of the Americas property.

"The question was" and "let me ask again" are becoming familiar refrains as Trump doesn't answer the questions.

Donald Trump acknowledged during direct examination that he overvalued at least two properties in his statements of financial condition, though he broadly represented that the statements underestimated his total net worth.

"Did you ever think that the values were off in your statement of financial condition?" state attorney Kevin Wallace asked about the document at the center of the case, which the New York attorney general has alleged contained fraudulent valuations.

"Yes, on occasion. Both high and low," Trump said, appearing to surprise Wallace, who paused to allow Trump to continue his answer.

Compared to his sons, who largely testified that they deferred to accountants and lawyers, Trump portrayed himself as an experienced businessman who "was certainly more expert than anybody else" when it came to the value of his own properties.

Asked about properties like 40 Wall Street and a retail space near Trump Tower, the former president confidently used real estate shorthand to explain why he thought certain properties were undervalued. He also repeated that his brand value -- which was not included in his financial statement -- is worth billions.

"The most valuable asset was the brand value," Trump said. "I became president because of my brand."

I don't want to agree. I want to think more highly of people. But....it looks like they are pushing for punishment so the base will react. I hate even considering that as a thought, but....

Is that how a hostile witness acts ?

Trump and team should be thoroughly ashamed of themselves.

As questioning continued about Trump's properties, the former president said he thought several valuations were "too high," including of his Trump Tower triplex in 2014.

Asked why the valuation was too high, Trump said a broker assessed the total area as 30,000 square feet, "and I have access to the roof, and when you add the roof, you’re not that far off.” He said, "I see how it was done," telling the court that "they took 10,000 per floor" and "times three" and didn’t take out the elevator shaft and other things.

He added, “Theres a disclaimer clause, so if there is a mistake ... you don't get sued by the attorney general's office.”

I totally agree with this assessment. He was elected, imo, because a sizable segment of people thought he was cool on The Apprentice, not understanding he played a character for their entertainment.

Earlier, in response to a question about the compilation of his financial records in 2021, Trump invoke his work in the White House to demonstrate that he was too preoccupied with the nation's business to engage in his own.

"I was so busy in the White House," Trump said. "My threshold was China, Russia and keeping our country safe."

"Just for the record," state attorney Kevin Wallace replied, "you weren't president in 2021?"

"No, I wasn't," Trump acknowledged.
Real estate valuations aren't a science, defense says and there you have it. Straight from the horse's, er, orifice. He was not president and acknowledges it. Just as him having documents prepared to return trusteeship to himself illustrated. He knew. Always has. So maybe his 3 year and counting temper tantrum can end? Nah, it'll never end.

As he testifies, Trump is leaning way back in his chair and has his arms crossed on his chest. He also appears a bit restless, slightly swaying his body back and forth.

Earlier in the testimony, when Wallace would ask him to refer to pages of documents before him, Trump would only look at a screen provided in the courthouse, unlike a typical witness who would refer to the pages in his or her hands.

Trump appears restless during testimony.
