Just rewatched the part where Canepa said they watched videos the night “before”. I wondering what about the time close to, during and after the murders … no phone calls, texts, posts or emails to confirm they were home during the times of the murders? I know Jake confessed and IMO I believe they killed the Rhoden’s and H Gilley. With George fighting it you would think his attorney would have mentioned in the bond hearing if there was anything to prove his whereabouts during the time of the murders .
BBM--It was not mentioned in the bond hearing (August 2020). I personally feel that the reason it wasn't mentioned then--nor at GW4's arraignment--is because he has nothing to prove his whereabouts during the murders other than his phone was at the Peterson Road house, as mentioned previously by CC with the link.

However, motion 68 to depose a critical witness was filed on 3/26/2021 (link below). If I recall correctly, a copy of this motion was posted previously and it said that a witness in their late 70's (GW4's grandmother in my opinion) had information critical to GW4's case and his whereabouts the night of the murders. I didn't make a note of that post, so I'm not sure what thread/page it was on. Another poster may have that info and/or document, maybe CC or CO?? I'm going from memory here, so I may not be exactly correct about the wording or the actual document having been posted. For now, please consider this JMO.

IMO, I truly believe GW's grandmother is pushing GW4's team hard to get GW4 out of jail, either for him to help run her farm or as part of the "revenge conversations" and plans that if any of the W4 were arrested, one of them was to escape and break the others out of jail. Those conversations/plans were mentioned at both GW4's and his grandmother's arraignments by AC.

The motion to depose critical witness was filed 3/26/21. HOWEVER, less than a month later on 4/22/21, JW confessed and agreed to testify against his parents and brother. Mysteriously, it's now five months later--and GW4 had another hearing on 6/21/21--and that motion hasn't been mentioned again, either by the court granting the motion or by GW4's attorneys at his hearing in June. Wonder what happened that this "elderly" witness--who needed to hurry up and get deposed before they could possibly die--didn't really need to be deposed so quickly afterall? JMO

In a past post I copied this important statement from the Defense's Motion requesting the Deposition. The above Motion # 68.

"The anticipated testimony (from FW) points strongly to the defenfant's actual innocence and the guilt of another person or group of people. Counsel can provide details to the court under seal so as not to cause this witness any undue harassment before the deposition is conducted."

I wondered about this also, that we haven't heard about this since the filing. This was right at the time Jake was turning State's evidence and less than a month away from his April 22nd guilty confessions in court.

Something about Jake's confession seems to have turned FW off from wanting to do the deposition.

However, it is entirely possible she plans to testify at George's trial. This is what the whole deposition was about, getting her testimony just in case she was unable to testify in court due to

1.) Her age
2.) Covid

The Motion also described that her husband had passed away and that he too would have been a critical witness... HUMM ...

I am sure this witness is FW. Everything adds up.

Not alot of time plus labor day takes off a business day.

They filed just exactly 3 weeks before the September 13th court date.
So I think the court didn't have time to get everyone together before the 13th.

However, there still should be some type of response filed by the prosecution which maybe will be filed this week? I would venture the guess that something will come up on the Docket this week.

Sopose to be Rhodens, Gilleys and Manleys NOT Wagners.


Oh c'mon CC, you know you want justice for the Wagner's...just not the same type of justice as the victims and their families surely deserve :p:p.

1. Thanks for the info. I've reported my post above to moderators to have the phrase "and his whereabouts the night of the murders" in the second paragraph removed since it's not correct. She only had information that was supposed to be critical to GW4's case and could implicate someone else other than him. Yeah, right......:rolleyes:

2. (Italicized by me) I presume that "something" is the fact that her theory no longer holds water since JW outed himself, his parents and his brother beyond the shadow of any doubt. Remember, all it takes is one juror to have their doubts about a defendant's guilt to prevent a conviction. IMO that was the plan, to create doubt in the mind of jurors, with this deposition and/or her live testimony in GW4's trial.

Do I really think that GW4 would be acquitted or have a hung jury without JW's confession but with FW's deposition/testimony? Absolutely not! But, in theory, it is a possibility and GW4's attorneys have to try any angle they can find to get their foot in the door to create reasonable doubt. I wonder if this motion will ever be brought up again. If it doesn't, I won't be a bit surprised because--with JW's confession and all the evidence he's given AC--anything FW would say couldn't be proven and would most likely be a falsehood or a smokescreen. She better not commit perjury...again. JMO

Didn't Rob Junk's motion filed on 8/16/21 for time extension on turning over the proffer recording (originally ordered to be handed over no later than 8/13/21) say something about a new development or important information (??) received on the very day of 8/13/21 that was critical to the remaining W4 cases? Maybe it's something super strong for the prosecution's case and the judge won't move up the 9/13/21 hearing...? If AW is considering changing her plea to guilty and agreeing to testify against BW and GW4, that would really solidify the prosecution's case.

If GW4's team wants the recording to try and find anything to nullify JW's confession, it would be a moot point if AW were to also agree to testify against the other two W4. There wouldn't be much point in pushing the turnover of JW's recording or to move up a hearing. Just a thought. JMO

I'm thinking Jake has given up massive amounts of specific info on previous crimes, bad deeds, of all W's, other crimes of the Ohio area that he has specific knowledge of, including people we don't know of right now, people we know of at this time, possibly some that are deceased, some that are incarcerated, revealing additional crimes of those incarcerated.
Locations of bodies, weapons from other bad deeds. (somewhere in the agreement he agrees to provide locations of evidence)
MO Other criminal indictments and prosecutions will arise from Jake's revelations and he will testify.
I believe this was partial motivation for his confession - Jake wants to bring down many other criminals in Southern Ohio (maybe beyond) who currently roam free. Jake's life is prison, LWOP or DP. So, Why not? After all, did he get a Public Defender, kind of a slap in the face by the one who pays for everything.
Could be why the subpoena for the deposition of the elderly person was forgotten.
Seems this Agreement means Jake must and will testify truthfully in Tony's Civil suit and that would help in Tony's Civil Case. Good.
I would bet the FARM on it.
A good deed with possible a double edge to it.
Last thought, all of the above regarding " including but not limited to " language must play into the Judges rulings.
I imagine no one on the State level wants to jeopardize future indictments, prosecutions.
So, possibly a delay as the Judge has solemn responsibility for his opinion in the sentencing, so he must be cautious in how he proceeds.

Seriously, probably felt the need to be specific so that other defense attorney's could not twist it into something else to use for their clients advantage or cause confusion. IIRC, we sleuthers came up with all manner of speculation on the first medical request. MO

In the motion the state filed they said:
Ongoing and developing circumstances they became aware of on August 13.
That is why they said they needed more time to turn over the proffer. That motion was previously posted in WS.

My memory could be wrong, but I think I recall the actual motion itself with a memorandum attachment containing the explanation was posted here in the thread.

Just like with JW's plea agreement, there was the formal motion but there was also an attachment at the end that gave more detailed information about the motion--that page was easily overlooked.

I'll look into it.

The motion was posted. The state filed it. ---Ongoing and developing circumtances they became aware of on August 13.

I think they may be covering all bases in case JW knows something useful, not necessarily because he knows something useful. It is hard to guess what may be going on with this case. It could even be a bluff to make someone think he will rat on them...

Not alot of time plus labor day takes off a business day.

They filed just exactly 3 weeks before the September 13th court date.
So I think the court didn't have time to get everyone together before the 13th.

However, there still should be some type of response filed by the prosecution which maybe will be filed this week? I would venture the guess that something will come up on the Docket this week.

it states that it has to do with a “remaining piece of evidence “.
