Defendant's Motion For Disclosure Of The Juvenile Records Of Plaintiff's Witnesses

Failure to provide this information to Defendant will deprive him of his rights under the State and Federal U.S. Constitution Amendments. V, VI, VIII, and XIV; Ohio Constitution Article I; 1, 2, 5, 10, and 16.

"..The juvenile records counsel seeks the State to disclose are necessary to show possible biases, prejudices, and ulterior motives on the part of the witnesses for the State.."

"..Bias is demonstrated by a witness like, dislike, or fear of a party, or by the witness self-interest.."

"..confidentiality of juvenile records may not impinge on a defendants right to present all available, relevant and probative evidence.. "
I am thinking this may be JWs ex-wife.

Thoughts on these two phrases from AC on the day of Jakes Guilty Plea.

Starting at approx 1:50 and for 2 minutes or so.

AC Stated:

...removed the cell phones on all but 2 of the victims...

....they asked others to lie to cover up this particular crime....

Wondering, what OTHERS ? Who? How many OTHERS?
Would that have been FW and RN?
Or additional people in the Wagner world.
I believe charges against FW will be refiled, and she will face new and more serious charges. AC did indicate JW would testify at Grand Jury Proceedings.

On the cell phones, any ideas on the 2 cell phones not taken? I hadn't realized this - 2 were not taken. Was that an error or oversight on the part of the Wagners? What info. might have been available to BCI on those 2 cell phones?
I have a feeling one could have been KR. Just a guess.

Since there is a chip off done on GR phone I had assumed maybe they did not take his phone. It could have gotten misplaced if there was an altercation, could have fallen under something or was just somewhere they could not locate it at the time.
It could also be an old phone on discovery that GR had in the house laying around and does not mean his current phone was left behind.

I had thought maybe KR phone was also not located or was left behind on purpose.

Chip-off is a technique based on chip extraction from a mobile device and reading data from it. This is the most difficult way of data extraction. But it must be used when all other methods failed.

If George's defense wants to discredit witnesses due to their juvenile backgrounds then I'm sure this refers to personal witnesses. I mean those witnesses who actually knew the Wagners and knew the Rhodens, Gilleys and Manleys.

Uncle CN, ex wife TC, ex wife EW, BJM and JM and DS because they discovered the crime scenes, LM, Rhoden relatives, Wagner relatives, TC's mother who was hacked, Chris's personal employees, family friends, pastor etc....

Other witnesses more formal and professional:

Expert witnesses such as footprint, ballistics, psychiatrists, psycologists, private investigators, forensic, blood splatter (think Dexter), LE such as Pike Deputies, LE Dive teams, BCI agents, Scheiderer, coroner, Wagner business associates, Wagner employers etc...

No wonder George's trial is scheduled to last 3 months!

Who could a witness with a juvenile record be?
I'm thinking that person or persons are adults now.
Sounds like there are more than one.
One person that comes to mind is CN. He is witness from when GW bought his gun. AW has known him all his life.

Gary's phone is personal property belonging to Gary's family. I think BCI talked to Gary's family about his phone.

The question is, why was his phone in such bad condition that Chip-off forensics had to be used? Did the Wagners try to burn it or break it or something?

Ok, I'll throw in my 2 ¢

Canepa at Jake's guilty plea hearing April 22, 2021

"We know that they removed the phones of all but 2 of the victims and cameras and other surveillance ......... to avoid detection."

This would simply be because they only found 6 phones or because they deliberately left 2 phones.

We know of one person the Wagners asked to lie for them, concerning the custody documents, and that is RN. Angie forged RN's signature and wanted her to lie and say that she (RN) actually signed the documents.

I believe Angie used RN's signature because RN was a notary. I believe, being RN's daughter, that Angie was able to steal her mom's notary stamp as well as find paperwork to copy her signature.

The interesting thing is the word "others."

Is this referring to just RN or to RN and someone else?

I’m pretty sure I read stone said KR’s phone was laying next to him

I do not recall it being said KR phone was found laying next to him or GR dad speaking of GR phone in his interview.

These are cyber reports that were done on phones and other devices/accounts. Really can't conclude too much from them either as far as who's phones were not taken.

It could be an old phone that he had that was broken and found by LE in the home. It could have been his current phone damaged at the scene in some way and the W's could not find it.

More than likely she is a witness for the state, she came into the picture after the murders . I was thinking of a juvenile that was around before and after the murders.

EW is a witness for the State, see the Other Acts Evidence.

The witness with a juvenile record could have got that record doing crimes with a Wagner when the Wagner was also a juvenile.

This could really create a bias towards the Wagner the witness did the crimes with.

I don't think it's beyond reason to think that one or more of the 4 Wagners has a juvenile record and that they had engaged in crimes with someone who is now a witness for the prosecution.

At the bottom of page 2 (KR) and mid way on page 3 both KR and GR names.
But I don't know what this small bit of info. means.
Just curious that those 2 names are mentioned together on a report.

Seems like this may be the case. I am guessing that because of the violence at CRsr place and my supposition that GR was not expected to be there, GR phone may have been destroyed by gunfire or lost in a physical altercation.
On KR, MO, If it was night and dark in the trailer, KR may have been charging his phone in some odd spot that the W's could not locate. Left Fork is a terrible place for cell service. Could that be possible?

Anything is possible. His daughter said he kept a gun within reach in his bunk (something like that) but she didn't know what happened to it.

I suspect they didn't even bother with his phone.
