IMO, Billy knows he will be a target in any jail. Especially if he testifies against any of the others specified in his "Other Acts".

I wonder if this will figure into his possible pleas?

Maybe, but Billy is such a huge guy it seems he can probably take care of himself.

JMO, he has that same sense of entitlement the elder Wagners had and seemed to instill in their kids. I think Billy actually believes that the Rhoden's "deserved" to be killed and he shouldn't be punished for doing it. "They had it coming." He probably thinks he can convince a jury of that and win an acquittal.

ETA: I also agree with Piffcat above about Billy's tattoos and links to "white power". I've heard those gangs are very prevalent in Ohio prisons and they protect each other.

Who do you mean in the Other Acts? It is just he and his immediate family doing crimes. I don't picture him snitching he is digging in his heels.

If bw is really plugged in to white power groups he won't have much of a problem in ohio. Those tattoos alone speak volumes- especially considering the punishment by gangs of people with "fake tatoos" ie someone not in gang getting an affiliated tat. I'd like to hope that crsrs associates would avenge him but many times criminals only truly care about themselves. Pedophiles child rapists even killers of women and children definitely get a target on their back
But when it comes to murderers in jail many times they actually recieve more respect in proportion to how violent their crime is. Disgusting bragging rights if you will. I'd think angela would have a worse time inprison. Its a very nice thought they'll be punish by inmates hopefully it will come thru.

No bragging rights killing women nursing their babies in bed, this will turn off even the white supremist gangs he tries to affiliate himself with.

No names are named in Billy's 'Other Acts'. I suspect Jake and AW can and did name those names.

IMO, there is no telling who the immediate or extended family members that might be implicated in these pleas.

IMO, Billy's defense attorneys are desperately grasping at straws.

Also, IMO, there will be no cake for Billy.....none

Surprising coming from Attorney Mark Collins, he used to be an assistant Prosecutor. He represents several LE officers in and around Franklin County in some high profile cases. It seems he may be losing his touch defending the indefensible though... as of late.

I do not think he respects authority but he will face the pecking order - the order of the pack - in prison. Like a pack of wolves every wolf has a place and they fight to establish dominance.

Billy seems to be working on this belief that the only way he can interact with people is by dominating them, thus, he will find alot of inmates just like himself.

Initially guys in prison would give him his space due to his size and surly demeanor. After a bit young guys will either avoid him or suck up to him trying to gain his approval as an alpha due to his size and posturing.

Older men will observe him quietly taking a true measure of him. Is he as belligerent and hard as he portrays himself or quaking on the inside praying no one sees this part of him?

If he is bright enough he will find out quickly that he is greatly out numbered and by some who are much much brighter then he is. Believe me if he is too much trouble, such as bulling and intimidating other inmates he will receive adjustment therapy by residents.

Should he persist in trying to act like "Bad Billy" he will be persuaded that he is in immanent danger of death and should lock up in segregation for his own good, of course. If he is stubborn he may well be found dead.

Usually such guys become part of a gang for their own safety and a power structure they can feel safe and respected in. The gang will mentor him and he probably will not realize he is being used by them and they will use him in any way they can. Everyone knows his family is wealthy for starters.

A lot depends on how bright he is. How much mental horse power is he running with? Then that most treasured quality - how wise is he?

This is a quote from a Correction Officer who worked 29 years in the largest prison in Michigan.

Billy Wagner's attorneys asked Judge Randy Deering to remove the possibility of death now instead of waiting to hear what Jake says in court, saying prosecutors agreed to a contract.

"He signed an agreement 'to testify' truthfully, and 'to plead' guilty. He’s pled guilty – and ‘to’ testify; that’s what he’s agreed to, your Honor," Collins said.

Special Prosecutor Angela Canepa said the death penalty only goes away if Jake actually speaks out in court.

"The plea agreement states specifically that it’s dependent upon him fulfilling that agreement," Canepa said.

Canepa's argument ended up winning the day, as Deering denied Billy Wagner's request. Wagner is due back in court Nov. 17.

It states that the motion hearing is rescheduled to October 25th at 1:30 pm . I believe this is the one from Monday that had to be rescheduled due to no court stenographer present.

Does anyone know is this normally done?
I checked on AW’s page, it’s not listed for her agreement.

IIRC, from Jake's hearing, the reason the state agreed to take the DP off the table in exchange for Jake's cooperation was ethics. This is a very unusual case because it's a heinous series of crimes and the defendants are a father, mother and sons. The state agreed it wasn't right to ask Jake to testify against his own parents and brother when that would result in their execution.

The purpose of agreeing to LWOP was to allow Jake to testify and provide evidence against his family without causing their deaths.

I didn't read this but I had posted that this must be the reason the DP was taken off the table.

It is logical and ethical to see that you can't ask a family member to testify against another when the convicted will be given the DP.

It would be outrageous and horrible to do so even though the convicted committed outrageous and horrendous crimes.

I'm surprised the Judge is letting the prosecution "play around" with the DP.
Must be to pressure Billy into a plea deal but it won't work, I don't see Billy or George admitting guilt.

Jake could be unable to testify and they would just put out his sworn statements. Jake already testified about everything. I wish we could know Deering's reasoning.

JMO. IANAL, but I think the rule says someone cannot be compelled to testify against their spouse. But if they choose to, they can. It's their decision.

According to your article on Ohio law, Billy could stop Angie from testifying against him if she wanted to testify about something that only the 2 of them talked about.

However, this is not the case here. It was the 4 of them that discussed together the crimes and also participated together in the crimes so Billy can't stop his wife from testifying against him.

It is not a cut and dried law that says spouses can never testify against each other, there are circumstances where they can and unfortunately for Billy his wife of 30 years intends to do just that.

Pretty cold to do that to your husband of 30 years. My guess is she will be getting served papers. As in D.

As long as AW volunteers to testify it’s permitted. Also she is only permitted to testify about things if a third party was present to
