I believe the motion is stating they cannot ask for DP if those 3 things are not met, not that it means they are innocent. I think it is only a recommendation though. I may have misunderstood it, will read it again. I would be surprised if Judge Deering dismissed 1-8 today. Thanks

JMO, it seems frivolous. While he may be entitled to file all these motions and require all these pre-trial hearing in light of the COVID 19 pandemic and the egregiously long amount of time that has elapsed, it speaks poorly of the defendant and his defense team that they keep dragging family members and others back into court.
Some "christian" George is, making grieving family members put their health at risk to attend frivolous hearings. JMO, he's getting his revenge against them; he's furious he was caught and jailed. Deadly furious. JMO
Why argue sentencing in pre-trial hearings? IANAL, but I'm guessing this is highly unusual, especially if its not related to negotiating a plea agreement. JMO, it's the defense team trying to try the case in the news media, before the trial starts, where the prosecution can't rebut the ridiculous (JMO) arguments they're making. The motions are ridiculous and untimely because the purpose of filing them is to publicly release as much information as possible that's favorable to George. COVID 19 works in their favor again, because the court calendar is clogged with backlogged cases, allowing plenty of time for PR campaigns for George in the news media and social media.
At least Billy Wagner's defense team is professional enough to avoid the same mistakes, while still defending a violent monster of a client who also thinks he should not be held accountable for murder.
