I believe the motion is stating they cannot ask for DP if those 3 things are not met, not that it means they are innocent. I think it is only a recommendation though. I may have misunderstood it, will read it again. I would be surprised if Judge Deering dismissed 1-8 today. Thanks

XII. RECOMMENDATION 17 – REQUIRING EVEN MORE EVIDENCE OF GUILT AT TRIAL The Task Force majority recommends that the General Assembly: ENACT LEGISLATION THAT MAINTAINS THAT A DEATH SENTENCE CANNOT BE CONSIDERED OR IMPOSED UNLESS THE STATE HAS EITHER: 1) BIOLOGICAL EVIDENCE OR DNA EVIDENCE THAT LINKS THE DEFENDANT TO THE ACT OF MURDER; 2) A VIDEOTAPED, VOLUNTARY INTERROGATION AND CONFESSION OF THE DEFENDANT TO THE MURDER; OR 3) A VIDEO RECORDING THAT CONCLUSIVELY LINKS THE DEFENDANT TO THE MURDER; OR 4) OTHER LIKE FACTORS AS DETERMINED BY THE GENERAL ASSEMBLY

JMO, it seems frivolous. While he may be entitled to file all these motions and require all these pre-trial hearing in light of the COVID 19 pandemic and the egregiously long amount of time that has elapsed, it speaks poorly of the defendant and his defense team that they keep dragging family members and others back into court.

Some "christian" George is, making grieving family members put their health at risk to attend frivolous hearings. JMO, he's getting his revenge against them; he's furious he was caught and jailed. Deadly furious. JMO

Why argue sentencing in pre-trial hearings? IANAL, but I'm guessing this is highly unusual, especially if its not related to negotiating a plea agreement. JMO, it's the defense team trying to try the case in the news media, before the trial starts, where the prosecution can't rebut the ridiculous (JMO) arguments they're making. The motions are ridiculous and untimely because the purpose of filing them is to publicly release as much information as possible that's favorable to George. COVID 19 works in their favor again, because the court calendar is clogged with backlogged cases, allowing plenty of time for PR campaigns for George in the news media and social media.

At least Billy Wagner's defense team is professional enough to avoid the same mistakes, while still defending a violent monster of a client who also thinks he should not be held accountable for murder.

JMO, IANAL

Even worse, these kinds of motions are usually handled during the trial.

I beleive it would be the defense and prosecution doing what is required of them. The prosecution surely can file their own motions to rebut anything and have done so many times. The media has reported on the prosecution motions many times also. There may be examples of that in WS that has been talked about many many times.

Does anyone have a link to GW4's gearing today?

Looking for one now.

Here's one

George Wagner to argue against the death penalty in his case in Pike County

They will probably add the live video in the article when it becomes available.

From the linked article

"As part of Jake's plea, the prosecution agreed to take away the death penalty in all four cases. However, George Wagner's attorneys are still concerned it could be reinstated if Jake doesn't testify in the other cases to their satisfaction.

George's attorneys point to the information that came from Jake's plea that apparently indicates that George didn't shoot any of the victims.

Billy Wagner has also attempted to have the death penalty dismissed but the judge denied that request."

BBM

ETA: An article from a few weeks ago discussing Billy Wagner losing his motion to have the DP removed even if Jake doesn't testify satisfactorily.

Death penalty still possible for Billy Wagner

Per Prosecutor Canepa:

“Third-party beneficiaries do not enjoy their rights until their rights are vested,” she said. “Specifically, in order to vest, they have to accept the promises of the contract.”

In other words, they have to agree to what was negotiated.”

BBM

There's an easy solution to all of this for Billy and his son, George, if they want to avoid the death penalty.

Another live feed. Looks like they have the camera set up but are not yet broadcasting

Pike County Massacre: Eldest Wagner son returns to court

From the link:

"One of the suspects in the Pike County massacre, George Wagner IV, is scheduled to appear in court at 1:30 p.m. Monday for the first time since his lawyer said in court records the state’s evidence now proves he didn’t shoot and kill any of the eight victims."
Such artistic phrasing. He didn't shoot AND kill any of the victims. He may have SHOT them, but he didn't KILL them. :(o_O JMO

Go on, George.

All I'm seeing is LIVEU on a black screen. I keep refreshing it but it's stays the same. News 12 still has nothing. I'm trying to find another, will post if I do. Thanks Betty

LiveU is (not sure I'm using the right term) like a video streaming app used by the news media for streaming live video from remote locations to their web sites, etc. The "pool" camera at the courthouse uses it. They usually set up the camera, check everything, link it to LIVE U, then put it on pause until the action starts. All the news stations then use that feed via LIVE U to watch the video on their web sites. I'm not sure if it also works on their Facebook and Twitter pages.

So when they're ready to start showing what's happening in the courtroom, the LIVE U screen will be replaced by live video.

Hearing is scheduled for 1:30 p.m. Wagner-time, That is 20 minutes from right now.

Right. They have never started on time. Lets hope the audio is better than ever!
After watching the Alex Murdaugh hearing, there is no excuse for poor audio.
Everyone spoke into the mics.

I wonder if they're hashing out a deal in the judge's chambers? Not likely, but we can always hope.

I think that George's chances aren't good with his latest motion. Billy lost his last time when the Judge agreed Billy is a third party and not a beneficiary of the deal for LWOP if Jake doesn't testify. George's attorney is making requests that usually are dealt with at trial. JMO

The camera that sets up in court for the feed rotates between Cincinnati, Cleveland and Columbus. They do know there is a problem with the sound, not sure anything will be done about it.

Actually, Pike County is in Eastern Daylight Time. They're just starting late, as usual. I hope they're not having trouble getting a court reporter there. That happened in some of the recent hearings.
