Roux: The points raised by the State are irrelevant. The State needed to raise questions of law.

SCA refers again to Mangena.

Roux concedes that he was an important witness - he corrected the State re stumps.

SCA: the important part of Mangena's evidence is with regard to DE.

SCA refers to reconstruction of toilet cubicle.

The toilet was so small - there was no cover.

One of the judges wants the dimensions of the toilet and disagrees with Roux that the room was 'relatively' small. He says it was very restricted, and one of the photographs proves there was nowhere to hide.

Roux is being put on the back foot by Chief Justice. Roux says the toilet is relatively small. Justice Leach says relatively? Leach is arguing the size, no place to hide. If you put 4 shots into that toilet you must foresee that someone will be shot. There is no room for manoeuvre. Leach says it would be a miracle if someone wasn't shot. Roux says he'll deal with it.
