By the authority vested in me as President by the Constitution and the laws of the United States of America, including the Immigration and Nationality Act (INA), 8 U.S.C. 1101 et seq., the International Emergency Economic Powers Act (IEEPA),50 U.S.C. 1701 et seq. it is hereby ordered:

Section 1. Purpose. This order creates a process by which certain international cartels (the Cartels) and other organizations will be designated as Foreign Terrorist Organizations, consistent with section 219 of the INA (8 U.S.C. 1189), or Specially Designated Global Terrorists, consistent with IEEPA (50 U.S.C. 1702) and Executive Order 13224 of September 23, 2001 (Blocking Property and Prohibiting Transactions With Persons Who Commit, Threaten to Commit, or Support Terrorism), as amended.
 
the topic being discussed by the o/p directed to me was regarding due process and precisely my reason for posting that particular section. heck, i would have posted the entire aea if only i'd known.

at the heart of all of this is... imo, of course and respectfully... i think some people see victims and illegal criminals as two different things.

A twice-deported criminal jailed for a decade for killing two teenagers in a drunken car crash will be released almost seven years early.

Oscar Eduardo Ortega-Anguiano was drunk, high, and speeding at 100mph when he hit another car on I-405 in Seal Beach, California, on November 19, 2021.

Teen sweethearts Anya Varfolomeeva Nicholay Osokin, both 19, were killed when their car burst into flames after Ortega-Anguiano plowed into them.

Ortega-Anguiano, 43, was sentenced to two 10-year jail terms, to be served concurrently, for gross vehicular manslaughter while intoxicated.

But their parents were horrified to discover in February that he will be released on parole on July 19 after only serving about three-and-a-half years

But the teens' families worry that even after he is deported, he will sneak back into the US anyway, as he did before.

Ortega-Anguiano was convicted of burglary in 2005 and vehicle theft in 2007, then jailed for battery on spouse with kidnapping in 2014.

An immigration judge ordered him to be removed from the US after the 2014 conviction, and he was deported on December 2, 2016, after exhausting his appeals.

He tried to re-enter the US on February 2, 2018, near Otay Mesa, California, using fake documents, but was detained and deported again.

At some point since then, he managed to sneak in undetected until his arrest immediately after the crash that killed Varfolomeeva and Osokin.

Unlike the millions of migrants who followed protocol and surrendered to border agents to claim asylum, Ortega-Anguiano was in the US illegally and would have been denied entry after a previous deportation.

You realize that illegal immigrants commit 1/10000th of the violent crimes that are committed by white Americans, right? Because there's one case doesn't mean there's "millions of criminals coming into the country to kill your family members".

So then why did the Supreme Court vote 9-0? Why is it okay to ignore Supreme Court rulings? What if we just ignore them overturning Roe v Wade? That's allowable, right?

he was ordered to be deported outside of the us.

according to the alien enemies act - under which he was finally deported - he received due process to which he was entitled. there was sufficient cause the alien be removed... bbm.

In a news release published Monday, the City of Hyattsville Police Department (HPD) said that “at no time” did its officers identify Kilmar Armando Abrego Garcia as a member of any gang.

HPD said that on March 28, 2019, a detective saw four men standing outside of a store in the 3300 block of East-West Highway. That detective saw them seem to hide something under a car, so he approached them.

“During the encounter, the detective recognized one of the men as a known member of MS-13. This individual was not Abrego Garcia,” HPD said.

 
I am pretty sure it was explained earlier that a shelter worker is the one who helps them log on and sits with them. No legal representation.


Children as young as four years old are attending virtual immigration court without a parent, guardian, or legal representation.

New York migrant shelter workers help children log on to computers, where a judge attempts to explain "rights," "asylum," and deportation in kid-friendly language.

"The reason we're here is because the government of the United States wants you to leave the United States," immigration judge Ubaid ul-Haq told a group of children in a hearing Gothamist reported. Some of the child defendants played with a toy or squirmed in their chairs.


Explaining rights and asylum in a kid friendly way? Really that’s laughable. There are adults who don’t understand what their rights are. Not laughing at you but the notion that a 4 yo would even get it. A 4 year old doesn’t understand how to tie their shoes.

I agree. Which is why it is such an abomination that Trump discontinued funds for their legal representation and refuses to honour the court order telling him to continue it.


The Trump administration has not complied with a federal court order directing it to continue funding legal representation for unaccompanied immigrant children

 
I worry about women who are undocumented, and afraid to call LEO when they have been crime victims. There is actually a form to give Undocumented aliens a hold when they are victims of crime.

I posted two documents above. The process to removal requires multiple steps,. The media does not explain the entire complex process, multiple laws, codes involved.

Step One .... The President declared cartel and others terrorists (very detailed). The declaration states each law, ACT and/or executive order.

Step two....Terrorist falls under the Alien ACT ....."any invasion or predatory incursion is perpetrated". It does not need to be a country.

I'm passionate for early US history, especially how our government was formed. , Living in Virginia (one of the first colonies) and close to DC, I'm surrounded with early history. Virginia schools, back in my day taught an entire year of just Virginia/early American history. The alien act is a watered-down version of the alien and sedation act, created around the time of our independence. We were a new country at war with many.... Mexico, France, England and under threat of invasion, with few defenses. In my opinion, it is designed to quickly remove foreign entities from US soil. The ACT has never been repealed.

It is my opinion, from reading the Alien ACT, repeatedly, no due process is not required. In previous enactments, it was based on country of origin, due process was not afforded to those deported or confined.

The USSC has issued a pause on deportation to the El Salvador prison.

Only to the El Salvador prison. It is a pause, not a block.
The US Supreme Court law clerks are feverishly combing through, documents, opinion, etc from our original Founders for our Justices to review.

Moo... I don't think deportation is going to be the issue, but using a foreign prison. It may be that we have to in prison within the United States or a US territory. We have experience housing terrorist on a long term basis... Guantanamo Bay.

It does need to be proven in a court of law.

And it only applies to foreign gang members. Not to people with any tattoo, any baseball cap, any rumour against them, or to any hairdresser, any migrant, any person with golden skin or a Latino name.
And it doesn't say they can deport them to a mega prison in another country - like El Salvador - does it?

Honestly, I am not seeing anyone complain about foreign gang members being deported. It is all the unproven allegations and the innocents that are caught up in this big sweep. That is the big problem.


The Supreme Court ruled on 8 April that Trump could use the Alien Enemies Act to deport alleged gang members, but deportees must be given a chance to challenge their removal.
