from last thread...I was glad to hear that he admitted putting the sheath from the knife next to MM. That was new to me. I thought maybe it was deposited without his knowledge at the time...snipped...

I didn't know this or catch this, nor find where it was stated. Please, if you or someone can explain to me why he left the sheath next to MM? On purpose?

The premeditation was for the girls on the upper floor. Kaylee and Maddie. He wasn't expecting Xana and Ethan.
But in today's hearing the judge listed each of the 4 charges as the premeditated with malice murders.

BT said that the sheath was left on the bed next to MM for whatever reason (my paraphrase). He didn't say it was on purpose or by accident, but for whatever reason, unknown. Why it was left there is unknown, but it was left there, with BK's fingerprints on it. That's the point the prosecutor, BT, wanted to make.

I think he didn't mean to leave the sheath. He pulled the knife out and should have put the sheath in one of his pockets, but instead, he laid it on the bed because he was so intent on his crime, he literally was seconds away from fulfilling his "fantasy" kill.

Premeditation is probably pretty complex. He enters the home illegally (burglary) to commit murders that were definitely premeditated. He may not have selected Xana as a target and he might not have known Ethan was there (although his car was). But he may have decided ahead of time to kill anyone he encountered (Xana and Ethan). Technically, entering a house to do murder may count as premeditated murder for anyone he killed. I'd love to have a lawyer explain how that works.

Cannot find even 1 image of BKs family attending the events of today. No interviews. No videos. No photos. Nothing. Highly protected. JMOO

Following is my opinion only:

We know BK has anger-management issues.

If he goes into the general population in prison, he'll probably be taunted. He'll have to toughen up quickly, and I can't quite see him doing this. I see him losing his temper--maybe sooner than later--and who knows where that will lead? Possibly protection from other prisoners, but at what cost?

He may try to impress other prisoners with his degree and book knowledge; that may work with some, but not others.

Peace and quiet to use a computer, and read? Maybe sometimes, but not always. Difficulty concentrating, his Visual Snow issues may get worse. Especially if he has a roommate.

I'm thinking he'll have a very rough time.

Again, just my musings.

The judge asked if BK went for the purpose of committing murder. BK answered "yes". Premeditation, right there.

Premeditation can mean minutes or even seconds. It only means that The murderer has some amount of time to consider their actions. Possibly BK thought ‘oh no, now I have to kill Xana as well since she has seen me.’ And certainly he had time to NOT kill Ethan.

from Cornell Law School: premeditation

premeditation

When an individual contemplates, for any length of time, undertaking an activity and then subsequently takes the action.

IOW, that length of time could be months or seconds. It is the decision that constitutes the premed and the action that carries it out.

Based on my understanding from some legal background and some old cases, an example might be that BK was leaving when he encountered Xana. He had a choice which he considered ... he could have continued to leave, or he could make a decision to kill. It is the connection between the decision to take the action and taking the action itself that makes it premed, so not so much the length of time between the decision and the subsequent action.

Same with Ethan .... it is my understanding that Ethan was sleeping. BK had killed Xana and again, could have left. He did not ... he instead made the conscious decision to kill Ethan and carried out that action.

Check out the Snake River Correctional Facility on the Oregon/Idaho border.
Snake River lock up is medium security I believe, I doubt he will be sent there given his crime. I reckon he's gonna be sent to IMSI in Kuna but it wouldn't surprise me if he didn't put in paperwork to be moved closer to his parents, SCI Greene possibly. Maximum security is a must IMO

Kohberger was absolutely disrespectful to the judge, the court, and the victims and their families as he answered single words ‘yes’ ‘no’. Not adding ‘your honor’ for example after any of his answers. He seemed defiant and unafraid. He has gotten everything he wanted. He ruined so many lives and families.

I hope Steve rethinks his decision to skip the victim impact statements though. I believe they will be live-streamed and this is an opportunity to tell the world about his amazing daughter and how he feels toward BK. I am not sure if comments about the prosecutor and the plea bargain will be allowed — in some Cases I believe they have asked families to steer clear of those topics. But victim impact statements would be an opportunity to remember Kaylee to a very broad audience.

Ahhh man 😔
I hate that he feels like he has failed his daughter and hate that he's visibly in absolute agony, but the judge isn't his enemy. The prosecutors are not his enemy. Idaho law enforcement are not his enemy and the Kohberger family are not his enemy. He's in so much pain that he's lashing out blindly and I get why he's upset, he had his mind set on a death verdict which is the most severe sentence given, I get it. We have to remember though that this man has been full of chew for years - slamming on everyone, leaking to media, even the firing squad t-shirts in court 😑 I just wish he would try to remember though that there are 3 other sets of families going through the exact same pain, no more no less, and the fact that however sly he finds this plea deal, it's definitively certain now that the monster will never have the ability to harm someone else's daughter.

I do hope that he in future channels all of his emotion into something productive as opposed to blind hatred which will land him in hot water eventually. A charity or legislation for women's safety in college or something in Kaylee's name.

Brutal 😞

Steve wanted the ultimate punishment for his daughter’s murderer, anything less is failure to him. His state has that option. There are individuals on death row for crimes against one person, much less four. He did not want this to be a decision made by a prosecutor and a defense attorney. He wanted that trial with all of the facts exposed, he needs people to hear exactly what his daughter suffered at the hands of Bryan Kohberger. He doesn’t understand how he is expected to quietly accept a plea because it is a sure thing and it is better for others involved. Kaylee was his kid, and he will fight for her right to justice because he feels that is his duty. Do I agree with his methods? No, but who am I to judge? Would we be okay with him if it was just his daughter that was the victim, or are we cringing because she was only one of four and the other families are accepting? I will say that the Judge, who is great, seemed more annoyed by Steve’s request that people tie up the phone lines of the court, than the murderer standing before him. I honestly feel like that start to the proceeding was a Kohberger win. The couple of years spent on this trial that never was is far more disruptive than a day of tied up phone lines. And let’s not forget four dead people.

Yep!! BK was given the opportunity to re-victimize every single one of them. Disgusting!

Sarah Paulson / Boone (suitcase murderer) who tortured and murdered Jorge Torres was facilitated in court to terrorise and victimize JT's family, children, friends, supporters by giving long hateful speeches that she proclaimed was 'forgiving everyone'. It was quite remarkable victim blaming and posthumous slander.

Re: BK's motive and pattern. There was a youtuber we're not allowed to quote here who immediately went to the house when the murders happened and he reckoned that BK would have been parking up the top of the hill / drive behind some trees which then gave easy clear view into the top bedroom(s). I suppose it could have been arbitrary / random that one day when driving by, BK noticed he could see the young woman in her bedroom -or- he could have been interested in a young woman and stalked and tracked her, then becoming even more fixated when realising he can see in her bedroom? Maybe taking binoculars or creeping closer and closer to the window.

Stalking / surveillance frequently precipitates and escalates into murder(s).

On an unconscious level I personally believe BK was making himself relevant and of interest to his tutor who thought he was gifted. This has probably now transpired to be true that she will interview and engage with him in order to 'study' him. He's given himself a placeholder in the history he was studying.

If he was a disaffected incel type then this type of unconscious / subconscious relating may not have even been overtly known to him.

Since he suffers from being different, socially awkward, addiction, possible autism, possible enduring mental health or personality disorder, let's call it 'setbacks' then he would have started to realise he's never going to have a normal regular life in a healthy happy relationship or family setting. Many people have that struggle and they don't go out murdering anyone so BK must have had an extra bit of dysfunction that sent him further. A bit like Jeffrey Dahmer 'killing for company', perhaps BK has been 'killing for intimacy'.

OF course, SG feels railroaded. The judge was far more concerned with his office receiving phone calls than he was with four victims who were killed in their home. Imagine how the judge woud feel If his loved one was killed while she slept. The judge was rather irate over receiving phone calls, which are completely harmless. The whole process is a sham, and sadly, SG is recognizing this in realtime. Only criminals have rights. I am sorry for the loss of his daughter as well as the other three victims.

Hopefully Steve, bless him, will find the peace and strength to turn around his emotions.

Leave all the anger behind and go back to his raw grief, write it down in an honest statement and read it out at sentencing, in front of the world, as an ode to his beautiful daughter.
