I was wondering if maybe they took the death penalty off of the table to make the family feel more comfortable with a conviction in the hope that they may be more willing to give more information since the death penalty would not be chosen.

Interesting thought. I doubt it but it WILL give them a false sense of security or momentary relief. They're already celebrating in a way. Too bad that in my view LWOP is worse. KC won't be a celebrity death row inmate. Booo Hooo.

If prosecutors could prove the elements necessary to support murder one, then they would prove the base requirements for either LWOP or the death penalty. The standard of evidence for the penalty options does not differ.
I thought they'd need certain aggravating factors like lying in wait, murder for financial gain, multiple victims, torture, etc. so thanks for the information! :)

No, but when the defendant's life is not on the line jurors are more likely to vote for conviction. When it is a pretty young "mom" juries are especially reluctant to impose such a draconian penalty.

That is why the state of California took the DP off the table in O.J.'s criminal trial. The decision was not based on lack of evidence. It was made because of Simpson's celebrity.

She will get maybe 5 years tops and will get out of jail change her name and move and with the millions of dollars from movie and book deals she will party like a rock star!~

I would not "bet the farm" on that.............she is "dead woman walking" because she will spend at least 35 years in prison even with "good time" and she will be her mother when she finally gets out. That is assuming she can keep her act together in prison and does not get anymore time added to her sentence.

If she is convicted of first degree murder, she will not even be eligible for parole. The DP would most likely be a blessing to her if that happens.

Its the age-old debate of the "haves" and "have nots".....
basically ppl who go to t14 law schools believe the cost and name on their law degree gains them prestige when actually it is a "compensating" factor for people who are lacking in "other" areas lol..sort of the old " if you can't earn it in the courtroom earn it in the classroom"
