The requirement for a capital murder crime has been met...........a child under 13 years old.

Still worse, prosecutors allege the premeditated and entirely willful murder of a totally defenseless little girl. Yet they dropped the death penalty. It easy to appreciate that if they had the evidence to prove such a heinous crime was committed, they would not have dropped the death penalty at this time.

I am sure that will make my cold better (maybe Trac's, too,) but I doubt I'll be well. My stomach will still churn as I read/view interviews. :crazy:

IMO, the only reason why those tapes were release was due to the fact that the interviews took place in Seminole County and a SC officer helped with the interview which would fall under the Sunshine Law.


If I were to guess if LA was interviewed I would say no. Remember GA & CA still haven't gone back for their follow up interview.

hmmmm, now if they weren't guilty of something then they would have gone.

Why would they have been in Seminole County? The Anthony's live in Orange County. Casey is imprisoned in Orange County and the crime occurred in Orange County.

Did you not watch the FBI video with CA? It's clearly stated why they were in Seminole.

ETA: It was the FBI not OCSO.

That is why the state is taking the safe route. Despite the odds, I am betting my farm on LE and the prosecutors. I think Casey is going down. She's left a trail behind so wide and well-marked a blind man with a cane could follow.(IMO)

I highly recommend Irish coffee! Put one spoonful of sugar in a cup, fill 3/4 full with hot fresh coffee, a good measure of Jameson's, top off with whipped cream.
Drink as many as needed or until you feel better. Your speech will definately change!

I so agree, Jolynna!

A path even Rick (CA'a brother) would agree that CA (as blind as she is) could follow and does - she just will not admit it!

I can't believe I'm saying this, but I'm genuinely too sick to drink. Which really sucks because I still have 3 more interviews to listen to...

I was wondering if maybe they took the death penalty off of the table to make the family feel more comfortable with a conviction in the hope that they may be more willing to give more information since the death penalty would not be chosen.
I think the SA's decision not to pursue the DP was motivated by a myriad of factors, including sensitivity to the Anthony's plight and the compounded suffering which would likely result from Casey's execution, if convicted.
I think you pose an interesting idea-- I personally maintain some hope that Lee could be turning evidence against his sister. I think it's possible that he may have intentionally or unwittingly helped her conceal evidence (ie. the computer crash on June 16) and I've continued to wonder if he made some sort of arrangement/deal with LE. I think most people would have a really hard time testifying against a family member if they knew their testimony could help ensure their loved one's execution.

I thought they'd need certain aggravating factors like lying in wait, murder for financial gain, multiple victims, torture, etc. so thanks for the information! :)

You were correct. After a defendant is found guilty of a capital offense (guilt phase), a new proceeding (penalty phase) begins in which jurors evaluate aggravating and mitigating factors to render their advisory sentence-- LWOP or DP. The judge tends to adopt the jury's sentencing determination, but does not have to.

More generally: I tend to disagree with Wudge's statements within this thread, as they relate to the meaning of "capital offense" and the substantive requirements of first degree murder.

The quote that was given on NG tonight was a cause for concern, at least for me. When she said that the state of Florida had decided not to seek the death penalty because it was not conducive to their case and then the additional witnesses...I don't feel LE has much that we haven't seen. They aren't seeking the death penalty because they don't have enough. And they are adding extra witnesses to try and overwhelm a jury because that is all they have. It's sad, but in my opinion, we are seeing the beginning of what will become that freeing of casey.

ETA: To get off topic a bit, any non alcoholic cold remedies, I'm dying here.

After the trial, and if found guilty, with the DP off the table, doesn't that mean that KC will be put in general population?
