The grand jury indictment accused Ehrlick of willfully and premeditatedly beating the boy to death while Jenkins did nothing to stop him and concealed evidence. If convicted they could face the death penalty.

If it's Felony Murder, yes she could get the DP. If a murder occurs during the commission of another felony like child abuse, all participants (and you could interpret her lack of action as participating) are considered equally guilty of the murder and can be charged and convicted accordingly.


If she's proven to be a co conspirator then she was a legal participant anyway so they don't need a Felony Murder charge.

Patsy killed JonBenet deliberately. No one else was involved. There was no staging for police. Everything that was done was done by Patsy for Patsy as part of a psychotic fantasy revolving around an imagined relationship with a supernatural being, the fear of judgment by that God and the fear of death. What people mistakingly take as staging for police had symbolic meaning known only to Patsy. This includes the ransom note. There were two aspects to what was done to the body: the ligatures were suspension devices, the body was posed and viewed and then taken down, placed in the small room, wrapped and the duct tape applied to set the kidnapping scene up in Patsy's mind. The ransom note is full of the ideas that swirled in Patsy's mind that night and plagued her for many years.

The goal was not to kill JonBenet but to make an Angel out of her.

Patsy herself said after the funeral "JonBenet is in Heaven with God awaiting her mother's arrival and it won't be long." Patsy put JonBenet in that heaven to complete the fantasy and in her mind assure her life after death.

Do you have any evidence of Patsy suffering from psychotic breaks previously? Medications she was previously taking or after for this alleged mental condition? Or any evidence this had been swirling around in Patsy's mind for many years?

I'll agree that Pasty had issues....but a psychotic break? Nah. Not in my opinion.

I don't know how many of you are in the UK, but I've just finished watching an excellent three part ITV mini-series called The Guilty which *spoilers* has an ending with echoes of a BDI theory.

It's about a four-year old boy who goes missing from his bed in the middle of the night, and is found buried close to home five years later. Lots of parallels with the JBR case, and food for thought.

Yeah that too.

And a fairly strong candidate for Munchausen by Proxy too.

But not psychotic...they hear voices, see things, pull their wings out feather by feather etc.

Nope old PR was just a good old fashioned "mean, crazy B***". No psychosis to hide behind, just choices driven by ego and evil.

I would tend to think she had some profound personality disorders with overlap and agree with you on the direction of your analysis of PR, Blue.
Histrionic, ASPD/Pathological, BPD, psychotic; and of course all of that inspired by some level of her own guilt. (triggered by her abuse during her childhood).
