Nurmi and Wilmont need to subpoena them and get them init court. That way they've done what they can and it won't be an appellate point for ineffective consul, and it will be up to JSS to deal with them for not showing up, and KN and JW have covered at least some of their butt.

Other than pride/reputation what is the cost/ramification to KN/JW if the verdict is overturned?

I think the one of biggest reason Claw Hammer Devault did not get the DP was because her 3 children were brought in at the sentencing phase of the trial to testify. A few of the jurors probably didn't want to give the needle to someone's "mommy".

If 1 or more mitigation witnesses refuse to come to court and testify can they be made to do so by her defense team? And if no, how does that help JA during the appeals process (if her attorneys can't force witnesses to testify in her defense?)

I think even if the DT or PT subpoena them the witnesses could still plead the 5th or give the typical DT reply, "I don't recall", I don't think anyone can force them to give testimony against their will but yes, they must still come to court.

That's not really her job, I think. Her job is to investigate potential mitigation and interview potential witnesses and help put together a case. She very well may have done all of that. After all, she is the one who calls the investigator to come testify in the hearing. We're not seeing all she's doing. We wouldnt be. It's up to the defense to pursue this stuff legally and to compel people to testify. MDLR can't issue subpoenas.

I still don't believe there is/was/could have been 14 witnesses that refused to testify based on threats. Were there maybe 14 total people they called that said they wouldn't testify in behalf of jodi arias, or what they would say would be counterproductive to mitigation. I know it isn't her role to issue subpoenas, but I do believe she's supposed to go interview ect potential witnesses/set up interviews ect. I will believe there is 14 witnesses when they either take the stand OR have their video taped testimony played in open court. Until then, I do believe they are imaginary

Weren't they locked up together? In my personal opinion, I think devault was instrumental in helping jodi concoct this ludicrous defense and accusations since they were locked up together at the time of story#3 evolving. Pathetic jodi isn't even smart enough to come up with her own lies she needs another psychopath to help her

Yes, they buddied up in jail. DeVault was just plain evil. She, like CMJA used men for personal gain, MD... probably more than CMJA. I am sure she was a big factor in CMJA changing her story to self defense. She claimed she was abused and molested by her stepdad, and her mom abused her too, yet she begged them to raise the girls. I think the Casey A. trial has set a lot of these females into claiming abuse/molestation. YUCK!!!

Exactly. If I was subpoenaed to testify in a murder case, I would take it very seriously. Why would they lie? They should be able to answer the questions truthfully, and as well know, if they did that, it would contradict what Jodi says.

My bet is they've said they will be truthful if they testify and DT dordn't want to call them.

Just to clarify, while the thought of JA being able to kill again or fear of JA being able to kill again, I just know she's not someone I would ever want to be around, I don't even want her in my state. but she is. Most of all, I want a day where she's sentenced and not heard of for years & years. Maybe when there's a stay of execution filed in 12-20 years...I'd follow.

Would you want her out? Would you want her as a neighbor? All the conniving? She's way to bold and has murdered. Ut-uh. jmo

In my jurisdiction (NC) that's often the reason why defendants who might otherwise, don't face the DP. There have been several murders that could have qualified the defendant for capital punishment, but with kids involved the state declines to pursue the DP along with the approval of the victim's family. So for instance, Devault in NC would have never been up for the DP and would have received automatic LWOP upon conviction.

I don't believe there's 14 actual witnesses at all. These are people Nurmi was never going to call, just names that have been bandied about. I think it's a mix of people that don't want to testify at all (and not because of threats), people who were never actually called at all ever or they weren't seriously vetted, people Jodi had lined up and want to do it but Nurmi doesn't want to, like Marc McGee. So Nurmi convinced her this is a better plan to make her think it's a tactic when really it's to save them from looking like idiots. The rest is just an excuse. Judge already called his bluff.

But I still don't know how this would factor into an ineffective assistance appeal.

IIRC, JA called Det. Flores and tried to act all "innocent" and help find Travis' killer ... by that time, everyone knew it was JA and no doubt, Flores knew it as well.

Flores was on to her lies the minute she opened her mouth -- and she knew it. Good thing LE acted when they did !

Yes he was. I am on the :fence: when it comes to whether she was planning on going somewhere to hide out, or if she had a specific target in mind. In the beginning, I felt she had an accomplice in the murder and was going after them (to silence them) but I just think now..... did she even have ANY plan?

Also in JSS motion to deny she mentions subpoena as an avenue for them to take. The ball has been in their court for quite a awhile now.

Jodi said the last three journals covered the time for August 2007 when she moved to Mesa until a few days before she was arrested. She pointed them out to Flores, and where he could find them.

I know she list July 27th as being in Palm Desert at the house, and the next is August 2 and she over at the Freeman's watching movies. In there somewhere she says she going to live in Mesa. But she seems to cram things in between dates, so it's confusing at times.

Guys, I just accidentally stumbled on the support fb page. I read it for Less than 5 minutes. I think I have PTSD now. I need to hug a puppy to get rid of what I just read. How can people like that, survive past childhood?
