If this judge let the murderer testify in secret because she/this judge was concerned the murderer would not have a fair trial because of the media, isn’t she/this judge basically saying she doesn’t trust the jury ??? What difference does it make what the media puts out there, the jury was told NOT to read or watch anything to do with this trial.
 
I wouldn't want JSS job. It's a no win situation.
 
The judge (any judge) is entirely within their right to keep cameras and video and live tweeting out of their courtroom, if they want. They are not entitled to block the media from attending or make courtroom proceedings secret. I don't believe we'll see this judge pull this again where no one is allowed to attend the courtroom proceedings.

No, because she's not saying that. She doesn't think Jodi wouldn't have a fair trial because of the media, but she was concerned that if Jodi refused to testify because the media was still there, then Jodi wouldn't have been voluntarily giving up her right to testify. It was about Jodi giving up her right and didn't have much to do with the media affecting the jury at all.

If I understood the COA ruling correctly, of course.

So unfair. No one likes to testify in public. I'm sure Deanna wasn't thrilled to have her personal (sex) life discussed on trial and still being discussed in this re-trial. She didn't ask to be referred to "Pseudonym" or to do her testimony in secret so America didn't find out who she was and what she has done. Sure some close family and friend would have known but it wouldn't have been broadcast all over the news.

If she could do that and handle that gracefully, these 11 or 14 witnesses need to suck it up and get this over with it.

It's even worse than that to me. You have witnesses testifying in the open for Travis who are going to get ridiculed and embarrassed by the slimy defense team vs some "expert" who is getting paid for his testimony. It's absolutely pathetic.
 
It's possible JSS was waiting for this to backfire. It did backfire, and her hands are now clean of this. The transcripts will be released, Jodi nor other witnesses will testify, the trial will come to a close, and she will be sentenced.

That's exactly what I think. I in no way think she has purposefully ignored the COA's ruling. She ruled that the transcripts should be released immediately. It's NOT her fault that the court clerks didn't have them ready!!! She gets blamed for everything, even the Winter Break!

I wish we could be accepting and respectful of members' opinions even if disagree with them. We are entitled to our opinions but no one's opinions/thoughts is more valid than anyone else's. Members who are critical of the Judge have good reason for it. Their thoughts are not silly. They deserve to feel free to express their frustrations.

There are times when I am befuddled by the Judge's rulings. It does help to see things from a different perspective---to read about how the Judge is impartial and fair. However, tone makes a big difference. When posts in favour of the Judge are encouraging and gentle then I pay more attention. Content is important but so is the manner in which it is conveyed.
 
You left out the unfairness to the victim and his family....or, are they merely "the public"?

The Alexander family was present for the secret testimony and they have a right to be present for all in-camera hearings. They are not considered the "general public". They have Victim's Rights, and as much trashing of the victim as there has been, blame that on the defense. The judge is not in their back pocket.

There are many Judges who preside over death penalty cases and they don't have the difficulty doing so that JSS has. JSS, has made this case an anomaly all by herself. IMO, she is the main factor why this case has lingered on for so long and why it has cost the citizens of AZ so much wasted money.

If I had seen other Judges conducting their court like she has done ..even from the beginning.. I may have some sympathy for her but never have I seen a Judge conduct themselves like she has done in this case.

I could understand somewhat if this was a RICO case involving hit men or the mafia or a case about an abused minor child.

But it has been JSS who has decided that star chambers in this case is far better than openness and upholding the Constitution.

She never makes a decision from the bench immediately which I have seen many death penalty judges do. I would bet that she has had more ex-parte meetings than most any other case in recent history. There is no reason or law that makes her have every sidebar secretive even when the jury isn't in the room yet she does so. I have also seen many DP Judges refuse either side when asked for a sidebar telling them 'to move along.' I can only remember maybe one time in all this time that happened here.

I absolutely think she is the worst Judge I have ever seen in any case that I can recall. I am just being honest, and to me all the backlash she has gotten is deserving based on her bizarre behavior in this case ...especially the resentencing phase... although all of it has been like no other trial I have ever seen.

From what I understand from AZlawyer she did not have to stop the trial while waiting for KN to appeal. And she let him drag his feet knowing he was going to appeal at the last minute to the ASC. Imo, this is not about KN appealing but she is hoping the SC will reverse the lower courts ruling that she erred when giving JA secrecy in testifying. IMO, they will not and she will be rebuked twice, once by the lower court and one by the SC. I bet she cant cite one case where a typical convicted defendant of premeditated murder has testified in secrecy. But it isn't just the error she made with Arias' secret testimony.......the entire DT case has gone off the scales...with more secrecy, delay after delay, and even letting experts use fake names when testifying. Honestly I have never seen that before.

She is the one that is making Arias' case into something it is not. There isn't one thing special about her case except not often do we see a victim so horrifically slaughtered as Travis but other than that JA is the typical DP defendants we often see. Other than that this case is just the run of the mill death penalty case that is tried in courts all across America without all the fanfare and drama.

And countless DP cases are tried much more efficiently and quicker yet they hold up under appeal.

Nevertheless, she's in a no win situation. Critics coming at her from all sides. The defense, the State and the public. Jodi is the bad guy here, not the Court. This will be over soon and I imagine JSS will be relieved beyond imagination

Websleuths is the only place I can stand discussing or reading discussion about this retrial. It's never easy to read "I think you're wrong and this is why." I'm sure people do ridicule others' opinions, but I don't see it here. Maybe I'm just oblivious.

I think us being restricted to the information we have in this sentencing trial, we are quick to judge :giggle: pun intended; and it easy to find every little detail frustrating.
As a poster pointed out, some of the issues arising are due to AZ Courts not having some of these things come up before, therefore, were a non-issue.
I'd rather this is done (secret testimony) NOW versus having this drag on longer than it has been.

What's going on now is probably innocent miscommunication regarding getting the court reporter stuff transcribed vs printed and so on, so I don't think that's a huge deal (at least not yet). I think the $400 will be disputed by Bodney - why should they have to pay when (as it turns out) she ruled improperly in keeping them out? In any case I don't think she's stalling if they get in the press's hands this week.

But as I've said before, where I think she made a huge mistake was giving KN from November to January to sit on it. As soon as the COA ruling came out she should have said they'd be out within 24 or 48 hours, putting the onus on him to file for a stay and an expedited hearing. Instead she let it slide for two months or six weeks - depending on whether you start counting when the decision was announced or when the written version of it came out. All this nonsense that went on in January should have been settled back in late November/early December.
 
IF Arias gets blocked at every point down the line in her appeals quest, I'll be glad and ultimately thankful.
 
If you were on this jury currently, where would your mindset be? It sucks that we've only had tweets, but based on the testimony so far (excluding JA's secret one), what would you be thinking?
