Maybe I'm being deliberately naive, but I don't understand. How can the media really affect a defendant's right to a fair trial? The jury is instructed to avoid all media anyway, so it shouldn't matter if the media tweets, airs video, etc. It's the jury's responsibility to steer clear. It's not the media's job to avoid airing things a juror might see! Short of a jury being unable to avoid the news for some crazy reason, I wouldn't think the media would have any impact on the jury's decision.

This was my thought too. I highly doubt Nurmi will take this to the SCOTUS as Monica suggested. The higher courts in AZ will bump his arguments back down I would imagine and his antics would delay this trial for years. I think that is his position anyway. This trial is so out of order. We need Order In The Court! JMV

Thrown under the bus is a bit strong, IMO. In either case, it was not unfair, in fact it was just the opposite.

JSS has been thrown under the bus by the defense team. You don't think Nurmi has tried to use JSS as a vehicle for mistrial? The DT have already charged Juan Martinez with claims of prosecutorial misconduct. Nurmi has shown a lack of respect for JSS throughout the trial. JSS, to me, has tried very hard to steer away from mistrials. The guilt phase was painfully slow but there appeared to be no genuine grounds for mistrial there. The lawyers and legal experts on WS may have spotted reasons.

I think we are all shaking our heads now . . . Nurmi if this is the best you can come up with for a defense . . . delays to force a mistrial, well can the good people of AZ sue for ineffectual council for JA if given LWP? (this is not a serious question . . . . but kinda)

The jury already knows of some of her egregious lies, because they have been told of her history of lying by Martinez and they have seen her interview by Flores.

This jury is now trying to decide if she should get the death penalty. So is being a liar enough to get it, or does it have to do with the "quality" of the lies?

Martinez job is to make the jury find absolutely nothing redeeming about her so that she gets the death penalty. This has gone beyond catching her in lies, and extends now to painting a picture of a person so evil that they deserve the ultimate punishment of death.

If I had to plead for my life in a trial like this (I never would be in this situation), I sure would not do the things her defense is doing. It seems like they are just going to get the jury madder and madder at her.

From the beginning, I would most likely just apologize and plead for my life. And so long as it was sincere, I think that would be the best chance at getting a life sentence instead of DP. So it amazes me why they continue to try to come up with crazy allegations and this crazy approach.

The only thing I can come up with is since she is never planning to ever admit her guilt and since she constantly will try to appeal her original guilt, then she has to come up with crazy other schemes to try to save her life.

The problem with their approach is people are not dumb and they wont fall for the tricks she is trying. This is going to backfire and she may just get the DP because of their whole approach. And of course because of her horrific crime that she committed and has no remorse for.

Whether we will have real testimony from witnesses OR whether it will just be more sidebars and conferences in judges chambers that result in more delays is anyones guess.

Disco Donna ( MDLR) does indeed look quite different in the video. Lookin a little worn and fatigued. The gum chewing in the courtroom does her no favors.

May I remind folks, the serial killer Charles Ng was arrested for 25 murders in 1985, was found guilty in 1999. FOURTEEN YEARS. I do hope justice for Travis doesn't take that long.
This is what Nurmi, et al, are trying for: DELAY DELAY DELAY.

You're confident ..

The trial resumes at the very last moment it can possibly resume, followed by the maximum number of delays possible, only to conclude with the immediate filing of an appeal .. and continues in such manner ad infinitum.

I posted this the other day but I still cannot get it out of my head so I have copied and reposted my post (#660) on the last thread because I am blown away at the 2 opposite ends of the spectrum in the interpretation of what is appropriate to keep out of an open court. So Washington State is now looking at retrying dozens of rape cases as far back as 10 years ago because jurors were asked one question while in the judges chambers . . . . and Nurmi is getting away with closing (and delaying) court for (seemingly) a mistrial. WTH? (See my repost below and link to explain further)

So in Washington State a new Supreme Court Ruling could now overturn dozens of convictions in rape cases. This was because of a case where the prospective jurors were asked in the Judges Chambers if they themselves had ever been raped. The convicted felon is now claiming he was not made aware of his legal rights to object to these questions not being asked in open court.

Delay, delay, delay equals more pay, more pay, more pay.

It's funny that the state prosecutor, the judge, and one of JA's attorney is paid regardless of what case they are working on.
Please correct me if I'm wrong - but I think they are on salary?

I know that KN was granted special pay. More than what a public defender would receive.

So I'm not surprised at the "need" for KN to delay - and the "need" is for his client to get a fair trial :thinking: (NOT :moo:)

To be fair, there may have been instances where delays were valid.

I realize the defense can claim a lot of things however I sure wish the judge would scrutinize any allegations much more closer before having knee-jerk reactions.

For example the allegation of the video being done against the rules. A close scrutiny of the wording of the ruling appears that maybe the ruling doesnt cover that. If so, change the ruling first before automatically assuming people did something wrong.

I also thought that any testimony from any witnesses had to at least have some type of foundation to come in as evidence. It seems that the defense witnesses are being allowed to get on the stand and claim anything under the sun with zero foundation that there is even a remote chance that it is true.

For example, the claims that the parents beat and choked Jodi. From what I recall from first trial, there was no testimony before about choking. So how can Nurmi just declare that with no foundation. It seems Juan and the judge could have objected based on no foundation.

And I am going out on a limb here but I am guessing the secret witness is making another outrageous claim with zero foundation.

Just wish any allegation or testimony from the defense would be more closely scrutinized by the judge before they are taken at their word and before any actions begin to happen based on them. Because I for one think a lot of times they are just plain lying at this point.

Thanks. I agree. I really know nothing of law but I always thought people had to prove what they claim/say in court. I am beginning to wonder if (don't shoot me) the court should reconsider LWOP, over the death penalty. They (JA) want her at Estrella for Christmas. LWOP would send her away fast. I believe she will not last at Perryville once in GP.. some criminals have feelings too and draw the line. Travis never deserved death/butchering. Someone will get her for what she did, maybe in the type of death she deserves rather than the needle. Maybe the Alexander family could find more for the people of AZ.. I would. I know death and its dispairity but sometimes we must think deeper. Besides~nurmi would lose his free paycheck. All he does is babble ...IMO:thinking: :seeya:

I'm a day late bringing this up, but if I was ole nurms (and JSS), I wouldn't want the public to see and scrutinize my performance either. Man, is he a whiner... "if the media causes a mistrial then so be it". Forget the fact that it wouldn't even be the medias fault if there is a mistrial, but instead his delay tactics and JSS inability to control her courtroom and make sound decisions.
On the video that was posted of yesterdays hearing (which I can no longer find), Nurmi couldn't even back up his argument with any case law. He just said "well judge I can't remember which case it is, but...." And instead of demanding he back up his arguments, like judges are supposed to, JSS was like "yeah, okay, agreed..it will be problematic". To which they go into a secret discussion, after being told they can no longer hold trials in secret. It's a joke. The fact that it's taken 6yrs to get justice is a joke.
Even casey anthonys case, where there was the most discovery I've ever seen in a trial, took 3yrs to be resolved. Ts all just a damn joke.

PS excuse the day late, jumbled rant...but I've taken enough cold medicine to kill a small pony

Checked again. It's definitely gone. Secrecy triumphs again.

This retrial has turned into a joke for a low life convicted murderer. I don't understand.
