Tomorrow morning will be interesting, when and if it gets started. I am assuming we will start our with a long sidebar with Nurmi whining 'Not fair judge.' I will be at my desk with phone by my side, peeking to see what's going on.

considering we know that Deanna and Travis went to the Bishop to confess their sexual contact it doesn't make sense that TA would leave a meeting with the Bishop, walk outside, and confess pedo to someone he wasn't close with.

I do wonder if they wanted Bishop Parker to verify that they were together that night, making it possible that it happened. Why not take the Church down too...another thing that TA loved.

The entire pedo accusation is the most absurd thing I have ever seen in a trial.
 
I thought Nurmi was the one wanting oral argument and I thought it was about dismissing the DP because the killer can't adequately defend herself.

Witnesses have to testify in open court. That's how it's done. If they choose not to then they are either off the witness list or subpoenaed. Ensure the witnesses they will not be photographed while testifying; if they still refuse to appear, subpoena them. If the person from out of country refuses to appear let him testify by phone--or borrow one from Anthony and use Skype or something similar. Whatever, just get on with things!

I hate that this thing is getting way more complicated than it has to be because as I see it, it has gotten that way mostly because the DT know that the judge is a sucker for whatever slime they throw at the wall. It's a disgusting waste of taxpayer money. Arias is guilty of a cruel, premeditated murder; let's get on with deciding her penalty for crying out loud.

Exactly. When the CoA issued a stay, prior to its recent ruling, it stated that there are plenty of less restrictive options for protecting/hiding a witnesses' identity. Nurmi, along with most other lawyers, is probably well aware of what those options are - there must be all sorts of cases where they come into play. In other words, it's not the "all or nothing" game that the motion portrays.

Her witnesses are not afraid for their lives; that's just something that they think sounds plausible enough to fly. What they actually fear is their lies being exposed. They want secrecy so they can say whatever they want and not have to worry about anyone questioning it or their motives.

The talk of threats began at the onset of the guilt phase, perhaps with depositions when JM warned those who planned to lie under oath that he would not let that go. Once they knew he meant business they wanted to bow out but could not find a way to do that gracefully--so they claimed it was due to intimidation. Reality is, the "threats" are and never were much more than some name-calling in social media and the prosecutor warning witnesses not to lie.

Now it has morphed into "fear for their lives." It matters not to this defendant and her supporters that they have caused much of the social media vitriol that they now claim is threatening. I doubt they fear those "threats" at all and given how easily JSS falls for their claims, they may even welcome them.

The pain and suffering he felt had to be excruciating. I can just slightly slice my finger accidently in the kitchen on a knife and it hurts very badly. I cant begin to comprehend the pain he must have felt with being stabbed 29 times.

I think she did a few of the stabs while in the shower (one was thrust into his chest very deep) then when he made it to the sink she stabbed him some more and somehow the poor man was still trying to crawl down his hallway leading from the bathroom and during that time is when she slit his throat from ear to ear then dragging him back to the bathroom where she shot him in the head. When she stabbed him in his head she did it so hard that it actually chipped his skull.:(

It would have been over in less than a minute if he had been stationary when all of it happened and if it all happened when he was cornered in the shower but he wasn't. I think all of it took 2-3 minutes and that had to seem like many many minutes to Travis who knew he was in the middle of being murdered.

I also thought it could be that Jodi lifted him quickly and it snapped his head forward and the camera caught it at just the right moment. I honestly don't think 1 minute is too little time for all the things that happened before the throat cutting to have happened. These things happen quickly and once that throat is cut, Travis is out within seconds. I also don't think it's not enough time for all those wounds to have happened in such a frenzy. I can see it happening very quickly actually and I don't think this attack took very long.

OK, since we're talking about this, I'll say it has passed my mind that when Jodi was talking about the dog that she kicked, etc... she was talking about kicking T-Dog. Not the other dog she owned/she was combining the two stories. I saw the original interview/read the transcript a while back, and it made my hair stand up both times. Most of what she said could be projected to the killing of T-Dog.

As we all know, there is a little truth in everything she says and I can envision that the camera went off in that photo when she kicked him in the head or such.
 
It is puzzling that the pedophilia allegation would have any mitigation value for the defence. Firstly, if you take it as fact (which it isn't) that Jodi caught him looking at a naked picture of a young boy, it obviously didn't worry her to the extent of her discontinuing sexual relations with Travis. Secondly, and more importantly IMHO, it has no bearing on the manner of and reason for his particularly heinous murder. The only issues that carry weight in mitigation should be any threats, abuse or violence by Travis towards Jodi at the time of the murder that precipitated his murder....and we all know there were none.

She's playing the vigilante card- she did the world a favor by ridding it of a pedophile, i.e, he deserved to die (except not for Jodi's real reason- that he was onto her evil!)
 
I agree but I'll go one further...she doesn't want to lose. Lose the case, lose to Juan, or lose to the family. You are right that she keeps reaching for a win...she doesn't want to lose.

Right.

And she doesn't want to lose even more than she doesn't want to die.

If saving her life were her priority, the nonsense would have stopped for this retrial.

Not every defendant gets a second chance but this one did and just look at what she has done with it. She could have pleaded to the court and the jury that what happened that day in June 2008 is something she will always regret. She could have expressed grief and sadness at the loss of this man that she loved, sorrow, remorse, that it is something that she will have to live with for the rest of her life, and so on...

But she did not do that. She instead continues to attack her victim. And she does that because she cannot accept losing.

IMO, her inability to accept losing played a huge part in his death.
 
I am so sick of this carp! Thank goodness these new "witnesses" are going to be torn apart. Can we move on now and finish this trial? For the 262847th time Nurmi, the death penalty will not be waived. And for the 15th time, nobody testifies in secret. COA already ruled on this issue. Stop stalling.
 
AZL, so I guess this all is happening since Juan's questioning of LaViolette & the other dude Samuels? Make Juan the bad guy? Witnesses are afraid of taking the stand in Jodi's defense? Tie his hands, make his boss watch over his behavior due to appeals for Jodi? I smell a rat big time. Go Juan!

He must have been in shock... he didn't feel any pain.

Shock numbs the pain and shock ,in sooth, is the way in which your own body is motivating you to fight or flight to stay alive. Reacting to pain would get in the way of that and that is precisely why pain is significantly dulled, mind goes blank and instincts kick in.

I'd have to look through the Minutes to see if I could find the 'court records' mentioning this, wish I could find what I read a week or two ago, think it was a motion by JM detailing the gunshot first but I won't swear to it, I was looking for JA's arrest report and went through lots of docs hoping to find that (but never did).
I think the most reliable source of information on what was or wasn't said about sequencing is the actual trial and hearing footage. The press often summarizes with little regard for the finer details and clarifications that we hanker for. Certain reporters (*cough* see second article) have a serious case of selection bias when it comes to the facts. And in any event, I'm not sure why this is so troubling.

There is nothing at all peculiar about ideas and theories regarding any part of a crime developing and sometimes changing as information and evidence is enlarged, updated, clarified, examined by experts, and so on and so forth. It's perfectly normal. After all, lawyers and detectives are not medical examiners or fingerprint analysts. Nor are all the facts and evidence immediately available.

In this case, all that's happened is that a big issue has been made (in a certain quarter) out of a perfectly ordinary situation - some rough and ready first thoughts enlightened by medical evidence and expert opinion, resulting in a firm and substantiated theory.

You have to count from the ceiling picture (5:31:14, as that is when the prosecution says the attack began), until the pant leg pic (5:32:16) 1 minute and 2 seconds, I don't believe that's enough time for 27 stab wounds from shower to sink/toilet area and down the hallway to bedroom and throat slashing and dragging him from the carpet onto the tile floor.
Martinez asked for a two-minute silence in court, to demonstrate the length of time that Travis suffered, from beginning to end. This makes the sitting down pic the start point, giving a time of just under 2 mins. She could have stabbed him just one or seconds after that pic.

If that's the back of his head, nothing is holding it up, it's in full view with nothing touching it and the neck is visible (if this is what they say it is).
But the head's not in full view. The top and left are obscured.

The camera's taking the same picture upside down or right side up, sure, but it's not on the floor.
I can't tell for sure if the camera is or isn't on the floor, and to be honest, I can't see what difference it makes. There are all sorts of reasons it might be raised - maybe she had it it her hand and inadvertently snapped the pic, or pressed on it while it's sitting on something else. But I can't see what's to be gained from making a list of possibilities. The end result is the same.
