I hope we get some clarity today as to why we are stopping midway through Geffner to bring in Sue. Like maybe a nice explanation to the jurors who must be totally confused as we are (jurors don't hear from Judge outside of court, do they?)

Does the state get to cross-examine witnesses any more? JA lied secretly for a day with no cross, then Geffners spent four days (which is like 25% of the entire penalty phase) saying Travis got what he deserved with no cross, and now we're moving on some other witness who'll spout another bunch of nonsense.

In secret Stephens court, constitution be damned. Anything goes including cross examination of witnesses apparently witnesses get to testify in front of the jury, under seal in a locked court room and the PT gets to sit on his hands. I wonder if JSS even allowed PT to object during their direct

For Nurmi, not just about the transcripts. He's still advocating for closed court, actually. To quote what he said a bit ago.."if Court is open (for her further testimony) then it is game over."

It was game over the days she decided to brutally murder an innocent man.

Beth has blogged that JSS told Bodney if SC denies stay motion, transcripts have been prepared & will be released immediately

However, the definition of "immediately" in JSKS' Maricopa County Superior Court is whenever LKN/JA tell JSKS she can do it.

I don't know if this is ok--if not please let me know. But maybe seeing the statement JSS made regarding the "potential damage" in full form might bring more clarity... per BK reporting-

"Judge Stephens: This matter is before the Supreme Court. My concern is that if I release the transcripts, potential damage cannot be undone. Since the response was filed yesterday, I believe the Supreme Court should be given time to review and decide. This court asked that the transcripts of the sealed testimony be prepared so there will be no delay once there is an order. However, because the Supreme Court has had this issue only since Monday and because this issue is so important and can affect the outcome of this case, it is inappropriate to release them. If the Supreme Court does not rule on the stay by next Friday, Jan. 16, the judge will hear additional argument at 8:30 am"

FWIW IMO MOO, etc, this statement by JSS indicates to me that she herself believes that JA should be allowed to testify in secret despite what the COA has said--really believe at this point that she very well may have ignored or defied the COA ruling (and to a certain degree allowed the DT time to appeal to the ASC) because she disagreed with COA findings.

I agree. The Judge whole-heartedly believes that Arias and her witnesses should be allowed to testify in secret. Her rulings are not driven by fear but by what she believes to be the defendant's most fundamental of rights.

Could it be to lay the foundation for porn being on the computer, and then defense will continue with Geffner as to the effects it had on Her Royal Hineyness, Queen of the Closed Courts?

Let me guess... It will start with a sidebar where the DT argues that the witness's name has to be kept secret too. And his background.

KN's argument is spectacular if you expand on it a bit to what he really wants. "She fears for her life if she testifies to try to save her life, so the only fair thing is to take the death penalty off the table."

Reminds one of the Menendez brothers who wanted sympathy because after murdering their parents they were orphans.

If this goes to jury deliberations (big IF there), I predict LWOP. I think the jury will negotiate b/c some will say it was too much of a circus to know anything for truth. And maybe that's the ultimate goal-- remember 'Chicago'? It's all about razzle, dazzle. Worked for CA.

And speaking of CA, someone mentioned her above regarding abuse. I'll hand it to her-- she had no reservations having those words come out in open court for everyone to hear. I know SHE didn't say them herself, but still....

I'm scared that people like CA and JA exist in this world.

This miscarriage of justice ought to be brought to an immediate end, and to be made to see in the daylight. There is something very amiss in JSS dealings and I fear the further she handles the case the MORE she is opening up the state to appealable issues instead of making sure there are none. This whole thing smells fishy

So, are they just stopping mid-stream with Geffner? How can they have Sue testify without Juan's cross of Geffner, first?

Color me confused, I thought Sue was brought in for the hearing that is the trial within the trial...not the trial itself.
