I guess I was overly optimistic when I heard there would be a ruling on taking DP off the table/Prosecutorial Misconduct. I expected either the trial to end today (ruling in favor of the DT's motion/s) or for it to continue (ruling in favor of the State), not some amalgamation thereof. So disappointed that the judge has allowed the mitigation/sentencing phase to become something other than a sentencing phase--if I understand correctly thes issues related to the guilt phase are to be addressed in appeals. I cannot imagine what the jury is thinking about this testimony--they have to be very confused at this point. Honestly, I am so over all of this.

Whatever the judge ruled we probably won't find out until later when it is filed. Perhaps that's why people are assuming there's no decision even if there has been.

One of the tweeters said it looked like the judge allowed JA to look over paperwork, maybe she knows and no one else does. Who really knows with this 'don't tell them' trial anymore.

"Pending the outcome on the supreme court stay I will release the transcripts immediately if the stay is denied" 1 week later..

"I will rule on the motion «by» Monday" Monday, no ruling yet.

I am thinking jss lives in a world where her perception of time is vastly different than everyonev else's.

#jodiarias Det. Flores says no reason to alert anyone he had awakened computer and inadvertently overwritten files.

Oh for Pete's sake, there is a difference between a computer coming out of sleep-mode and a computer being turned on--it's not like Flores woke the computer and played a few hands of solitaire on it. If the DT is insinuating that Flores did not follow procedure and is the cause of them not finding "all of the 🤬🤬🤬🤬"-- then this trial is officially off the rails.

I'm changing my mind.

Because this testimony clearly points to DT attempting to prove prosecutorial misconduct -- I don't think it has any other obvious relevance -- JSKS hasn't yet decided how she'll rule on the motion.

Maybe JSS wanted more testimony on the record before she makes or released her decision?

If Flores did something to the crime scene that would have affected the verdict, like put her palm print in blood on the wall, put pictures from a previous date on Travis's camera and change the date so it would look like Jodi was there that day, etc. I could see why this would matter. The 🤬🤬🤬🤬, even if he had had hundreds of pornographic pictures on his computer, has nothing to do with whether the mitigating factors outweigh what Jodi did. This judge is letting the defense bring everything in, even though we are already in the sentencing phase. I don't trust what she's going to do about the death penalty. I've tried to understand the difficulty of the decisions she has to make, but I'm about to give up on her.

'Xactly. Sounds like a denial but the judge, for whatever reason, has stopped announcing these things publicly.

Melendez was the forensics guy sent to crime scene. Wilmott bashing Flores for not correcting MM's report that the word used was inadvertent rather than deliberate for waking up.

I'm incline to agree with you. KN with this judge's help will not let the public have access to the secret transcript.

But why in front of the jury? They don't have anything to do with deciding the motion....unless....Sherry has decided to ask them what they think she should do? :facepalm:

I think there is more of a chance Jss did not rule at all than that she ruled to remove the DP. JMO
