....especially in light of the fact that Baez and Co. seem to be trying so hard to humanize and otherwise generate some public sympathy (no matter how miniscule an amount) for Ms. Anthony by portraying her as in such desperate need for physical security and mental health assistance.

I'm curious as to why you "don't believe we will ever see it". I hope you're wrong, of course ;) , but why do you think that? You don't think Judge Perry will grant the release to the media outlet that reqested it? If he does, they'll surely publish it. So you don't think he'll grant it?

My heart of hearts hopes he will - but as we all have learned, there is a great deal of power dangling the bait. I don't think that is lost on HHJP. I do hope he takes his time. He may decide in the general scope of the matter that the tape may be too incendiary or inciting - we don't want to play into the DTs "hunted haunted" proposition. We don't want to endanger anyone else (whether it be collateral damage or just wrecking themselves in some benighted justice agenda)

Strickland sealed the vid (really sealed it) I do want so very much to see it, but sleeping dogs and all... I just can't believe it (but I can dream...)

There's something recent about this in one of the lawyers' posts on the legal thread, indicating that there's no legal reason to keep it sealed, and thus should be unsealed. The reasoning was something along the lines of needing to consider the reason that something is sealed in the first place and then determining if that reason still applies later. In this case, the file/video was initially sealed as it might prove too inflammatory to a jury and thus jeopardize Ms. Anthony's right to a fair trial. Since that's no longer an issue, I think it can reasonably be argued that the need for sealing no longer applies. Hope the court agrees. :D

Make no mistake, I want to see that video. I really really want it released. However, I think there will be a concern that it may serve to increase furor that could lead to public harm - including FCAs. However, if under the law there is no reason NOT to release it, i.e., if HHJP cannot support maintaining the seal with solid precedent, I think it will come out.

Interesting, nearly 60 days post verdict, what a phyrric victory for DT this has become.

Granted. (and I totally agree with you) But we cannot litigate that. I am really thinking that concerns about releasing the tape include that it could induce some poor souls to do something stupid that will cost them their liberty, and potentially hurt others in the process. There may be an element of "protecting the public from itself" in the decision making rationale -

But as I type that, I think that is really more a role for the legislature, and not the judiciary.

Eh, one thing is certain, we will see.

And don't forget, we have November sweeps coming....

There's no reason not to release it. JB admitted Caylee drowned which proves KC knew that Caylee was dead. I wish SA has asked to submit the tape as evidence after the OS because it could prove she knew exactly where the body was. Somehow the rules of the game changed with the OS. jmo

IIRC Jeff Ashton said in an interview after the trial, that the tape really wasn't all that compelling, it wouldn't have helped their case. But I still want to see it anyway.

I saw him say that in one of his interviews.

However, while the tape might not be compelling on its own, the tape showing her reaction to a child's body being found in the swamp compared to her reaction to a child's body being found in that park is compelling (to me anyway). Too bad the prosecution couldn't have introduced both of those into evidence. Her reaction shows she knew it was Caylee. The baby hadn't even been identified yet but she knew.

I also recall hearing or reading that the tape has no audio on it. It's just a video so we won't get the full impact of how she reacted. A lot will be left to our imagination as to what she was saying, etc.

..i don't recall that..i know we got the jim hoover tape of dominic casey with no audio on that.....i hope this one does have audio.

..we've already heard in great detail what went down from lieutenant tammy unser and billy richardson's depos-----what's the big deal in releasing this public record?

..it will no longer impact her right to a fair trial..or jury selection.....as judgeS said in his Order ( to delay the release until after trial).

..so........let's see it.

It is another tough one for HHJP b/c, again, it could change the way things are for all convictions of anyone in Florida. I don't think the appeal has anything to do with the costs much, other than raising the costs, and I think HHJP will say so.

All right now - I believe Strawberry's "bosses" must have gotten hold of my schedule because I now have work scheduled today that I didn't originally - grrr. I know...but the SA usually win the motions and the DT usually loses the motion. Since it's in front of HHJP and not an ignorant/lazy/corrupt (take your pick) jury I'm more confident the decision made will be rational.
