Sounds like the Hoffmans’ child may have witnessed the shooting. Absolutely heartbreaking.

I tried to understand but cannot understand why it is second-degree murder. This resource on MN law says that it is second-degree when the murder is intentional but not premeditated. These murders clearly were premeditated. Can someone explain?<snipped & BBM>

I’m 100% with you , flower shop ! I saw the charging document on an online news channel earlier, why second-degree murder , I was appalled ? And these two murders and two attempted murders were clearly premeditated . I guess it has to do with the laws of MN ? How it is spelled out , I’ll have to research this further tomorrow, it is too late tonight ! This lunatic had this planned, it was not a crime of passion, nor heat-of-the-moment, nor a lesser charge, it was planned, calculated, he created his own fake police car, and word fake police clothes, for crying out loud ! What is not first-degree , premeditated about how this guy committed these shootings?
The charging document says that VB is being charged with second degree murder - "with intent, not premeditated." Not sure why it is not considered premeditated.
I found online information that says that in Minnesota, a person can only be charged with first-degree murder by grand jury. A prosecutor's office can only charge someone with second-degree murder. I wonder if there will be a grand jury so that they can upgrade the charges. JMO, as I am not a lawyer, and not sure if I am understanding this correctly.
First Degree Murder is unique in that it is a crime that is only chargeable by grand jury. This means that a county attorney’s office must assemble a grand jury in the county where the crime was allegedly committed and present evidence to the grand jury. A prosecutor alone cannot charge a person with First Degree Murder.

So close. So sad. It sounds like VB shot the husband, then ran into the house after exchanging fire with police, and then killed Hortman. I wonder where Hortman was eventually found in the house. I hope that she was somehow still asleep when she was killed, rather than alert and trying to flee this terrifying situation when she encountered VB. But maybe that's wishful thinking...
