Yes, both sides are fighting over the cell phone. Besides possible incriminating pictures of them wrong-doing, there may also be phone records of them calling for help, or text-messaging. The phone logs would be saved by the cell provider and the phone should have a memory card with the pictures stored on it.

I think the police took them at the time of the incident. I'm not sure if it's the D.A.'s office that's fighting to preserve the evidence, but Geragos wants his hands on the phones from what I've read.

I heard on Fox News today that it was reported that when paramedics were treating the surviving two men after the attack that the two were speaking of a pact to say nothing about what happened and how it happened that day. I don't know how reliable the report was, and I didn't hear it via the paramedics being interviewed. But, there may be truth to this.

In a letter sent today to the brothers' attorney, celebrity lawyer Mark Geragos, San Francisco City Attorney Dennis J. Herrera asked that Paul and Kulbir Dhaliwal preserve "this potentially critical evidence."
"The digital content of your clients' cell phones, which we understand are currently in the possession of the police, may help reconstruct what happened at the tiger exhibit and cafe," Herrera wrote.
Geragos did not return a phone call from the Mercury News. He told the Mercury News earlier this week that news reports of his clients taunting the Siberian tiger before she escaped from her grotto were not true. A friend of the Dhaliwals', 17-year-old Carlos Sousa Jr. of San Jose, was fatally mauled when the tiger escaped.

The brothers have refused to speak publicly - or to Sousa's parents - about the incident. For police and city officials to examine the cell phones, they would need a warrant. To obtain the warrant, they would need to show probable cause. "In the interests of getting to the real facts of this tragedy, we propose a simultaneous inspection of the car and cell phones by experts retained by your clients and the City Attorney's Office," Herrera wrote in his letter to Geragos.

The city attorney also noted "there have also been reports that there is evidence in your clients' car of possible alcohol consumption." San Francisco Police Sgt. Steve Mannina confirmed this week that a vodka bottle was in the Dhaliwals' car. Linas, does it seem to you from the report that they actually have the cell phones in custody? I wonder if they are waiting for a warrant to look at their contents. We don't know if anything of evidentiary value is in any of the phones, but if the phones were taken soon after the attacks, and I hope they were, then there may be evidence preserved there.

I don't know how accurate the report is for sure, and I cannot tell from it whether or not LE has had any of the men's phones as of shortly after the attacks. And, we don't know if the men may have taken tell tale pics or sent tell tale texts. But, there may be a chance that that is the case, and I hope it is.

I think so. I lost all sympathy for the D brothers based on their actions, and it's too bad Carlos and a beautiful, endangered species lost their lives because of the actions of these two idiots, although the zoo should have known the correct height of their fences, and raised them long ago. I never felt safe walking by the tiger or polar bear enclosure, because on the visitor side, it's only about 3 feet high!

ITA, Linas. And, I think that zoos should be built to keep visitors out of animal enclosures--there will and have been incidents where the mentally ill or others have gotten into animal enclosures or at least too close.

While WS was down; an article said that the boys had been smoking marijuana, and the youngest brother was drunk. They boys were overheard by a paramedic agreeing Not To Tell What They Had Done.

I heard this as well, Buzz. It was described as a, "pact" between the two surviving men. I don't know if there is proof that any of the three were under the influence, but toxicology results should prove it one way or the other--if they were done. Does anyone know if tox screens were done for certain on one or all of them? I seem to recall hearing about that. But, I am not sure.

They were done on all of them IIRC, but I don't think any results have been released yet.

I figured the boys had been drinking since Carlos didn't want to go to his parents home. Probably would have been caught, and that accounts for the lie to the dad about Carlos being with the brothers. Have the pinecones and twigs found in the moat been confirmed? Those could have come from any number of people or kids throwing things into the moat or trying to cause some noise to get the tigers to come into view. Short of crawling into the enclosure with the tiger, I don't see what drinking or some pot smoking has to do with the fence being way too short and a tiger getting out of a city run establishment and killing a kid.

Sources also say that the younger brother was intoxicated at the time of the incident, having used marijuana and consumed enough liquor to have a blood-alcohol level above the .08 limit for adult drivers. The older brother also had been drinking and using marijuana around the time a 350-pound Siberian tiger escaped and killed Carlos Sousa Jr., the sources said.

I figure it went down this way: They get drunk/high and go to the zoo. Start by taunting the lions by roaring at them, then move on to the tiger enclosure which is unknowingly too short. The jerks think they are invulnerable and taunt the tiger by sling-shotting it with pine cones, sticks, and rocks. Pisses the tiger off royally and for the first-time ever, she escapes and goes after her tormentors.

The police were the ones who reported the pine cones and sticks.

It was said earlier today on one of the news channels that they were drinking and doing drugs. NYP stated days ago that there was a bottle found in the car. Some here wrote it off because of the news sources. But the NYP was right.
