The jury could find Boswell guilty of lesser charges than the ones levied against her. If she’s found guilty on any of the three first-degree murder charges, the jury will also be tasked with deciding her sentence in a second trial that would begin immediately after.

Prosecutors previously informed the court that they were seeking a sentence of life in prison without the possibility of parole.

On a ridiculous note, the judge has restricted media when the verdict is read—NO AUDIO when the verdict is read. The judge doesn't want the jurors' voices heard. He will then let the camera op know to turn the audio back on and the verdict will be repeated. Ridiculous.

Are they deliberating presently?

I've been expecting court to go live just to excuse the jurors to the jury room to continue deliberation.

Must have happened for a journalist to be able to report the judge is planning to mute audio on the verdict.

Does that mean they've been deliberating for an hour already this morning?

They're deliberating. I haven't seen what time they began this morning, though.

The jury was briefly called into the courtroom Thursday morning before being sent back to resume deliberating.

My understanding is the jurors spent three hours trying to reach a decision Wednesday evening; and 45 mins this morning. moo

Wish we could say that for poor baby Evelyn.

Dead in a playhouse so her mom could play house somewhere else.

Boswell faced 19 charges in Evelyn’s death. Those charges included:


  • First-degree premeditated murder
  • First-degree murder in the perpetration of aggravated child abuse
  • First-degree murder in the perpetration of aggravated child neglect
  • Aggravated child abuse
  • Aggravated child neglect
  • Tampering with evidence
  • 11 counts of false report
  • Abuse of a corpse
  • Failure to report a death under suspicious, unusual or unnatural circumstances
She had initially faced 12 counts of false report, but the state dismissed one of those counts at the start of the trial.
