Before the court went in recess for lunch, jurors heard opening statements from prosecutors and the defense.

It was an emotional start from the bat-- from those statements to the first witness, TBI agent Brian Fraley describing the night Evelyn Boswell's body was found, the condition and how investigators had to go layer by layer when unwrapping her body.

Jurors saw the photos of Evelyn that were taken as evidence. Several were crying but it's important to not that Megan was also sobbing throughout the photos being described and shown. Court is in recess until 1:15. That's when they'll pick back up with Fraley's testimony.

Wow -- the soldier EP was NOT the father of Evelyn-- just another lie by MB!!

ETA: MB initially, successfully, delayed Tommy Boswell from reporting the baby missing as she told her dad and others that EB was with EP and how he'd received an emergency order to take Evelyn!
I wonder who is the father and if mb even knows.....

She then told the jury that they will hear a lot about Ethan Perry, who was believed to be Evelyn’s father. Boswell claimed Evelyn was with Perry for a time as an excuse, Massengill alleged; however, Massengill said Perry is not actually Evelyn’s father.

Megan had moved in with her new boyfriend (who MB believed was wealthy) in a nice area of town and was taking trips to Gatlinburg and Pigeon Forge while EB was rotting in the playhouse. When MB couldn't/wouldn't produce the emergency custody docs or produce EB, Tommy contacted authorities. And MB continued to lie -- now alleging her mother had Evelyn!

I wonder if that bearded guy the judge yelled at is the boyfriend.

It’s crazy how many mothers accused/convicted of murdering their toddlers went out partying while the babies were still missing. Psychopaths IMO.

Back, jury out of court as lawyers argue over certain statements made by Megan. Centers around the charge of false statement that was dropped but I’m not sure why.

ETA: apparently Megan said that Evelyn was dead in a recorded statement and defense claims that opens the door to cross examination of agent Fraley about it because prosecutor mentioned it in opening statements. That’s the best I can understand.

Back, jury out of court as lawyers argue over certain statements made by Megan. Centers around the charge of false statement that was dropped but I’m not sure why.

I believe the defense probably wanted this charge to remain so they could allege EB's death was accidental and/or that she was dead when she was placed in the rubbish bin. (i.e., statement by MB that boyfriend rolled over EB in bed and may have smothered her-- again, MB pointing finger elsewhere). JMO

Defense citing cases that support his argument. Judge was mad and said that’s why he had so many preliminary hearings, defense counters that he didn’t know that charge would be dismissed.

I believe the defense strategy here is to go for as much reasonable doubt as they can muster -- BUT not to find MB innocent but a hail Mary to mitigate her punishment. Seems they want to add every party who ever came in contact with Evelyn as a possible party to the neglect and/or abuse that caused her death. IMO, they're no better than MB-- blaming everybody but their client for Evelyn's death.

If I recall correctly, MB fired her last attorney over this very strategy (except she thought it would get her acquitted and he wasn't buying it). MOO

I hope dropping the false statement charge today doesn't backfire!

For example, if she told LE that Evelyn died in bed when bf rolled over her, and in her next breath claims Evelyn is at a campground with Angela Bothwell, did she actually tell LE that Evelyn was dead? Was this also when she claimed she couldn't take a polygraph because she was pregnant? What a mess...

IMO the judge’s decision is an important one as it could be used in the inevitable appeal if Megan is found guilty. If he rules against the defense I suspect he’ll have the proper legal precedents to support it. He appears to mean business in this trial and won’t suffer fools. JMO

Here he comes… hurry up and wait…
