they will appeal as the jury should have always been sequestered and the judge erred by not doing it from the beginning and when she did it was too late and they can argue that ordering it now indicates she finally recognized her error. If she doesn't order it they will just argue they should have been sequestered "at some point".

The real problem is this trial should have been over weeks ago. That's on this judge and her poor trial management.

LaViolette is a good witness for the defense. She is taking actual communications (perhaps out of context) and tying them directly to the characteristics of abusive relationships. However, the defense could have made her testimony much more impactful by hitting the high points and managing this testimony more efficiently.

I do think LaViolette actually believes most of what she is saying -- she has a long history of treating battered women, and that is the filter through which she views all relationships.

I am not concerned that this witness will change the outcome of the trial because I know Juan is prepared to cross examine her and he still has his rebuttal case.


I disagree if only in the fact that she started referring TA actions and words as abuse as soon as she got up on the stand. Actions and words that we all have in normal everyday relationships. I think she lost people and most importantly the jury because of that. She came off as biased early and I think this has made her words worthless.
 
Jodi's hair looks terrible today, did she miss her shower? Three a week? Correct?

Thoroughly agree... and it's good for us, because (I believe) she lost the jury on day 3 of questioning ALV.

Imagine if she had been prepared, had gone thematically instead of chronologically, had made four points and used examples from texts and journals to reinforce those points.

She would have held the jury's attention and ALV would already be off the stand and we'd be a day or two into redirect. Instead, she opened numerous cans of worms for the prosecution to exploit.

She's not very smart and definitely not effective... in my opinion anyway.

I bet when she asks to approach - Juan actually tells Willmott how to do her job. Probably telling Willmott how she can question the witness...:twocents:
 
I agree the parents were terrified of Jodi's wrath.

As a Morman, was there any counseling other than with a Bishop, available for a woman Jodi's age whose parents and friends seemed to think needed to get help with psychiatric issues? Tia

You get a psychologist who is LDS and gives you quasi-spiritual counseling mixed with psychology. You pay a fixed rate, not sliding scale, and it is not cheap.

This is the advice I received" "The middle way is the best with children like your son."

Me: What do you mean by 'middle' ?

LDS counselor: Halfway between the two extremes.

Me: Doesn't middle then depend on how you identify "extreme"?

LDS counselor: Yes, that's the parents' job.

Me: So the best way to raise a sociopath is whatever we think it is.

LDS counselor: Basically. You pray and get guidance for making these decisions. Are you having scripture study with your son?

Me: He has been having morning scripture study since he was a toddler, and church on Sunday. We have made all meetings a condition of living in our home and he attends until he falls asleep and we prop him up in the pew. He is STABBING boxes in the garage with kitchen knives-- this seems very dangerous behavior to me.

LDS counselor: Tell him to stop or you'll take away privileges like computer games.

Me: I don't allow a Nintendo in the house. I am concerned about the violence in his head that is represented by the stabbing.

LDS Counselor: So you are anxious? Do you have anxiety about other things in your life? Are you praying regularly and attending the temple? Establishing good prayer habits and regular temple attendance has been reported to ease anxiety for many stay at home mothers.

Me: Nothing because I have walked out.
 
I'm gonna make a prediction... JM will not be up until next Thursday or Friday. It's gonna take forever for ALV to get through the details of the incident... Just sayin'

Okay I've dealt with that abuse, and per AVL as an abused woman I'm coming back for more. Did they get by the sex tape in May yet?

Most of what you say is true; however, ALV has never dealt with a psychopath who drove 1000 miles to murder a wet, naked man in a shower without any provocation. JA has demonstrated in the courtroom during cross-examination by JM that she is no shrinking violet. She gives as good as she takes. She is not a battered woman.

Sadly, I think you might be right. On the flip side, I'll finally get some stuff done because I'm not prepared to sit through two or more days of this carpola.

Lawyers - help me out here please.

I really do not understand how Travis' journals can be used in this trial.

We all know damn well that if he had said anything in his writings about being scared of Jodi killing him, or her stalking him, or should he end up dead then Jodi did it...that would be grounds on appeal and her conviction possibly overturned.

How can they do this?

In fact, didn't TA say or blog something about how if people didn't see him at church or a meeting or something it was probably because he had wound up dead a few months before his death? I think he did, and probably that has been deemed too prejudicial to present in court.
 
ALV says that TA had these aggressive tirades and suggests that it is typical abuser behavior.

For the record, I would like to see what a REAL ABUSIVE TIRADE looks like. I am sure that she has some incarcerated abusers who sent texts which were much more violent, abusive and frightening, than the so called 'threats' that TA sent to the killer.

I am sure there were texts saying ' I will come for you and the kids and slit your throats.'

These texts she is discussing now pale in comparison, imo.
 
After re-watching the sequestration hearing, Nurmi calls out Jurors 1, 4, 6, 13, 17. He's going for a mistrial by removing enough jurors so that the number falls under 12?

I hope that this is true and that the jurors can see through this. I also think ALV believes most of what she is saying.
 
Ha, I've got the TV on half-listening cause I cannot stand the cover-up by Alyce. Now the western romance book ( I know) has a sociopath doing the killing, and he just brought a pistol and knife out of his backpack to get even with the girl he was fixated on and her new boyfriend. Sounds familiar, those sociopaths must like the duo of both a gun and a knife to do their evil deeds.

But according to Dick Samuels, JA only developed this healthy self esteem and backbone since her incarceration and his gift of "Erroneous Zones."
